Q: Hi, Buying a property is a very difficult task these days and so is the builder. I have selected a project called Fortune Butterfly City, Srisailam Highway, Hyderabad. I want some details about the project and its builder?

Q: Hi, have visited DB ozone & have found the property interesting. Would like to know if its good to go considering the long delay in project delivery (still is in progress). Hope all the documents are cleared & updates if any.
Latest Answer: Hello Jayaksh, I have bought one in building no-9 buildings 1 to 4 have been given possession. They are giving contracts to finish the work. The project is registered under MAHA RERA and its RERA Registration number is P51700003433. So, they are bound to finish the project by Dec 2019. All the documents uploaded are clear. Q: Sir,
The Mapsko Builder for the project Mapsko Casabela, in Sector 83, Gurgaon, till 31st March 2014 had charged Vat at 1% with the surcharge of 5% which makes it to 1.05% as per the notification from Vat Authority and the payments which have been made after 31st March ,2014 till possession, they had charged Vat at 4% with the surcharge of 5% which makes it to 4.5% . Further, the builder is saying that there is no clarity on such charges from Vat Department, however, it is a mandate from the company to charge Vat at the time of Registry. Further, the Builder is saying that there is a clause in the registry that in case of any notification from Vat Authority for the increase or decrease in Vat %age.if the same has to be given to you without interest and if there is an increase in VAT amount then it has to be taken by the client.

In my scenario I had paid Rs. 1 lakh extra as I was not having any option but to say so that I can get registered my flat. But imagine there are so many flats and the money collected by the builder. He is enjoying on the money of the people.

What action can be taken in this regard.

Latest Answer: It is advised to file a complaint before RERA Gurgaon ti claim your money back with interest. Further, your complaint shall be decided by RERA within 90 days from the date of filing. In order to penalise the builder, please file a criminal complaint for cheaing and fraud and further approach court to get FIR registered. Shreshth Jain, Advocate

Latest Answer: Yes, you will be paying a premium for those properties. I booked my apartment with Vajram Essenza because they sounded very professional and after one year of being with them, they have been very responsive to every document that I have asked of them and every receipt. Touch wood, so far, they have not given me cause for concern and I have found them to be extremely professional in their dealings. Yes, they are new, but every builder is new at a certain point in time. It all depends on your risk appetite.

Q: I bought a flat with them in their project BBCL Ashraya, delayed by more than 2 years, still not completed , may take until end of 2018 / start of 2019. No compensation at all, some owners were forced to sign documents which state they have no issues with BBCL in order to apply for possession. I personally know some senior citizens were insulted by their staff , not shy of rowdyism used on them. They will lure you with a low rate, get a deposit , then slam you with more taxes , charges and more money, it is almost close to extortion.

So BBCL are not builders , MAFIA.
Latest Answer: Did you file a complaint in the consumer redressal forum? I think you should all unite together and write a final mail to the builder and ask for the possession date. If you are not getting any positive response from the builder, file a suit and ask for the possession along with compensation. Yiu all flat owners of this project should file a case in groups for the quick response.

Q: Absolutely no license or permission for any legal issues, no registration done till now, it's been 2yrs I paid money, no registration or refund, anybody with same problem please contact to get together to file a complaint

This is a warning letter for everybody.

Bestech group ,which is involved I real estate business is neither ,refunding the money given nor delivering the property possession.

So be careful paying them money or buying from them any property !!!!
Latest Answer: Did you discuss with the builder about your issue? Take the advice of a legal expert in this matter and send builder a legal notice. If he is still neglecting your mail then file a consumer suite against the builder and ask for the refund along with interest for the delay.

Q: During booking time we were inform by Jains Housing that flat will be ready with 15 days from the date 10% payment clearance. Evan after 40 days also flat is not ready and full amount have been paid no response to mails and Phone calls from Jain Housing.

Latest Answer: Yes, you can also check out old Mahaveer projects like Calyx etc does not have OC. In fact, they have deviated more than 50%. Be careful while buying their properties. Though I have no idea if their ethics and company have changed over these years or not. But do your all due diligence before investing anywhere in India.
