if a cancel a booking of flat due to legal issues,whether seller can deduct VAT/service tax for refund
Q: i had booked a flat by making an advance of rs.100000/-.in the booking from it is mentioned in fine print that if I cancel the booking, while making refund VAT/service tax will be deducted.Now the title of the landlord is not cleared by my lawyer and i want to cancel the booking on this ground.I just want to know whether the seller is entitled to deduct VAT/service tax

My comments to replies
If you have already paid the service tax at the time of booking and you are cancelling the booking now.Builder can refund the service tax paid by you.
