delay in getting municipal approvals for the project
Q: We booked a Flat in Rustomjee Urbania Thane in Nov,2010. The builder promised the regisration of property in Jan,2011. It was assured to us that all necessary approvals would be in place by then.However its now close to 6 months since the booking of flat.The registration is yet to happen as the builder is yet to get the municipal approvals for the construction.I understand that the builder is still selling the flats without approval.We don't know as to when the approvals would be in place.I would be interested in forming a group of similar buyers to exert pressure on the builder.

Which building in Urbania you booked in? Is it Astrea? Did you pay beyond your down payment? I booked flat in Athena C in Nov 2009 and TMC approval was received in Mar 2011. I did not pay beyond 20% as bank refused to pay the amount for lack of TMC approval. Rustomjee continued construction without TMC approval between Nov 2009 and Mar 2011. Subsequently we registered the flat agreement in May 2011. Now, Rustomjee is asking for interest payment of about Rs 13 lacs beyond agreement value which we are of course refusing siting lack of documentation at their end. On Jun 20th 2011, I received Intimation of Cancellation from Rustomjee. Today I am meeting my lawyer to go to Consumer Court Thane to address the issue.
