Welfare charge for reselling flat
Q: Hello, I presently reside in Bangalore and I have a flat at Kolkata in a small society (around 300 flats society). I recently received following notice from my housing society and I would like to know is it legally possible to charge anything (now 1%, later it could be 2%,3% .. etc.) to the flat owner in name of welfare charge? "IN CONTINUATION OF THE BYE-LAWS , 1% WELFARE CHARGES WILL BE LEVIED ON THE SELLING PRICE OF ALL RESOLD FLATS IN XXX SOCIETY, EFFECTIVE FROM 1ST JUNE OF 2015 . THE AMOUNT WILL BE PAID BY THE SELLER. THE REVISED SECTION 8 OF THE COMPANIES ACT , 2013 , WILL SHORTLY BE CIRCULATED TO ALL MEMBERS." Best regards, Suman Dey
