Q: I took a flat on lease. I deposited Rs. 40,000/- as security deposit. When I vacated the flat I was outside the town so my friend vacated the flat. The landlord returned only 20,000/- at that time and told me that when i will return he will return rest of the amount. Now when I came to town, he is not returning my deposit he tells me that he charged Rs. 9,000/- for last month rent(OK), Rs. 2250/- towards society maintenance charges(nothing in the agreement), Rs. 2000/- for cleaning of flat(Too high), Rs, 3500/- for repairing of TV,Fan, Tubelights(TV was about 10 years old, Fan was waorking), and rest amount for water and electricity bill(OK). When I call him he picks my call and tells me that i won't pay. Since last two weeks he is not picking up my call. What should I do? Should I lodge FIR against him or lodge a case against him? please help as soon as possible.
Latest Answer: The landlord should return at least 75 percent of the deposited amount and keep the rest Rs 10,000 for maintenance charges and others. Did he gave you any written statement along with the 11 months agreement that he is going to charge Rs 20,000 after you vacate the room? If yes then you cant help and if no then go ahead and lodge a complain against your landlord.
