Builder is asking to Withdraw the Booking
Q: I booked a 2BHK in 2011 with renovated builder. I was behind the builder every month to make an agreement but he was saying that some approval issues and it will get resolved in a short time and then we will go for agreement. Time to time I asked whats an issue and he was saying minor issue which will get resolved shortly. Now builder is saying that there are some issues between business partners and they dont want to go beyond 5th floor for that 10 floor building. 4 floors construction have been completed but as they need to pay much money for above approvals, they dont want to go for it. He wants me to withdraw the booking and he is saying I can not do anything just by booking with 1 lac amount. If I will withdraw, according to current market rates, I will be in 15-16 lacs loss. Please advice in this matter.

Latest Answer: I would suggest you that before withdrawing the booking amount had a talk with your legal expert or lawyer. Even you can ask the builder for some compensation to allot you some other apartment either in the same project or on other projects if they have any.

The Crystal Castle Approvals issue
Q: I have booked the 2BHK flat in C wing, The Crystal Castle, Dhayari one year back in July 2011.(Multicon group project) The below commitments were given to me because of which I did booking of flat - Agreement will be in Aug2011 - Possession will be in May 2012 Till date, still my agreement is not done and progress of construction is also stagnant till 4th floor from last year. From last year, every month, when I am asking builder, he is saying that some issue with plan approvals from PMC and he is following. But he is not even committing on agreement or expected possession now as it is pending in PMC and not sure when it will be approved. He is not even explaining the issue why it is pending. If I will withdraw the booking, the rates are almost increased by 1000Rs persqft due to which I will be in loss for minimum of 8-9 lacs for the same area. Please advice me how to handle this situation legally. Thanks in advance.
