Q: I have booked a flat in Mohili Meadows Reosrt, Karjat. As per registration builder should handover me the property within 18 months. Now almost 24 months are passed anyno construction is there. Can I ask for refund/ compensation?

Latest Answer: Hello Anjali..if something is promised on papers ..you can always claim for that. Builders always mention the expected date of delivery..they never promise for that. You should take legal advice at earliest.

Q: But present condition is that there is only plinth on the sight and if u ask them they are saying we will give you possesion in one year. The 18 months have already passed (i.e. in Nov. 2012) and from then I am in contact with builder but they are not answering me properly. But as a compensation they just offered me a 30 days free stay in there resort and that too they are counting it from January. I am asking them to give a possesion date on paper but they r refusing so wanted to stop there payment till possesion. I have taken a DHFL loan and they are just charging me interest and cannot start EMI unless there is full disbursement as per there policy. So I want to know 1. Can I take a legal action against builder and ask for compensation? 2. Can I stop there payment till possesion and if I stop there payment can they charge me a penalty? 3. Can I quit from the project and get the curreent market rate?
