Q: WE HAVE PURCHASED FLATS FROM BUILDER. 340 FLATS HAVE BEEN HANDED OVER AND MORE THAN 80% OF THE PROJECT IS OVER. SINCE 10 YEARS OUR ASSOCIATION IS LOOKING AFTER THE MAINTENANCE. BUILDER HAS NOT HANDED OVER THE COMMON AREAS, ROADS, MOTORS ETC. WHEN THE BUILDER HAS TO HAND OVER THE SITE TO THE ASSOCIATION?

The builder has to handover all the legal documents, Approvals and common areas at the time of handing over the maintenance to the association. The Builder is bound to do this legally. For more clearer answer we have to look in to the bye laws of the association and under which act the association is registered and also is their any written commitment happened between the association and builder at the time of handing over the maintenance etc.
