Q: I have seen a building where builder has taken approval for 4 units and built 8 units of flats and there is no floor deviation. And promising that he will get A-Khata done for all the 8 units. So will there be a problem buying a flat here? Can A-khata be provided for all the 8 units ? Will there be a problem in future if not now?

Latest Answer: It is illegal to buy a property with deviation. It is not the developer or the bank problem. It is your problem. Most people say that 25% deviation is ok. But what they are not telling you is that if the building has 4 floors and you are on the 4th floor, your are 100% illegal (1 out of 4 floors). That means if some action happens, it will happen on your floor. Similarly, they have approval for 4-units, so they will get OC for only 4 units and rest of the 4-units are illegal so i do not think that they will get approval for it.
