Q: I had booked a flat under subvention scheme RERA P51700009055. However due to recent update by NHB, subvention scheme is no longer applicable and I can not buy flat without the scheme. Please suggest if builder is bound to return full booking amount along with GST upon cancellation of the flat

Yes, builder is bound to pay full booking amount as Subvention Scheme is no longer valid. Have you got any mail regarding subvention scheme from the builder before booking the flat?
Hi Padma, Thank you so much for your reply. Yes, I have an email mentioning the subvention scheme as they had not earlier documented it anywhere.

Hi Padma, Just out of curosity as I would be going ahead and cancel the booking what if builder states that they will put the flat in RAC and I will get my amount only after someone books the flat. In such case what can be done?

Hi Swapnil, Builder is bound to refund the booking amount. If he is paying then ok and if he is trying to ignore and misleading you then Email from builder will play vital role. If builder fail to refund pre EMIs monthly as agreed by him in Email. Then you can cancel the booking and seek refund. Yes email are legally admissible as evidence in court.
