Q: I want to know if anyone has an idea by when will this project be completed. Already there has been a significant delay in the project and there is no communication from builder on likely date of completion

Some of the allottees (not me) have received demand letters which include service tax also. As the delay is on the part of the builder, and, had the builder given possession well within the stipulated time, there was no liability of paying service tax. Therefore,liability to pay service tax legally lies with the builder, not with the allottees. We should write to the builder first. Certainly, the builder will not respond favourably. We shall then approach the consumer court, and certainly, we shall get relief. At least, I am going to do so when I get the demand letter. Unfortunately, I could the meeting on 28-11-2010.
