Q: During 2010., I have purchased a 2BHK flat by having full belief on the words of the builder that the building plan is approved by CMDA and will produce the Completion certificate at the earliest. Now 7 Years passed. The clearance certificate has not been given till date. While taking attempt to sell my flat buyers are having reservation because of Plan Approval is for 1 X 3 BHK., but made center partition wall and sold 2 X 2 BHK, in which one flat is without Kitchen, which is my flat. There is no positive sign from the builder to help in this problem. Hence I request you to kindly guide me to get ratification of Plan Approval with the addition of Kitchen.
Latest Answer: You can file a civil suit or you can also file a suit in the consumer forum for deficiency of service by the builder. At the same time, check with RERA, where this project comes under RERA or NOT. If yes, then complain to the state RERA authority.

Q: We are 7 flats. and no two flats are identical. Two owners having 3BHK. but not accepting for the Maintenance Charges to be fixed under Built up area . As well as not co operating for registering the society what to do?
Latest Answer: There are two common ways in which each housing society can decide the service charges for each member. The society is free to choose the design that suits their respective needs. The two popular methods used to calculate maintenance charges are: Flat Wise: Flat wise service charge module calculates sum or total maintenance charge to be incurred by the society and divides equally among all flat owners irrespective of the size of the flat. This method brings a sense of fairness to each flat owner and society resident. This method is best adopted in housing societies where each flat is of the same size. Area Wise: Under the Area Wise maintenance charge method, the total costs incurred by the society are charged according to the area in terms of per square feet owned by each member. The common areas are divided equally using a fixed rate while flats are calculated depending on the size of the apartment.
