Q: Can builder sell the undivided share and covered parking to penthouse owners for which the paln is not approved by BBMP?what are the possible action that we appartment owners can take on builder. Initially builder had communicated that the penthouses will be given for rent only and it will not be considered for parking and undivided share.But now we have come to know that he is selling penthouses with undivided share and parking space.

My comments to replies
Is there any genuine reason as to why the plan was not approved by the BBMP? It is advisable that you file a case against the builder as he has been selling the property with undivided shares.
As per the plan approved by BBMP it has approved for G+3 but builder constructed additional 4th flloor and selling it with parking and undivided share.
