Q: The Lake District Project is delayed beyond comprehension. We have booked a 2BHK Flat in Bldg C4 in Jan 2011 which is a part of the Phase1. As per the agreement the Apt should have been handed over by Dec 2012 considering all the grace periods of more than 6 months. The building has only reached 6th floor out of the 12. How many are such agreived parties? Can we join together and issue a notice to the builder?

Can anyone suggest some good lawyers or consumer forum where I can lodge a formal complaint against the PRA guys ? This has been ridiculously delayed over 2 years now. All I keep getting email response is further delays. As per agreement in the event that there is a delay in possession beyond the committed timeline the developer is liable to compensate @9% for the amounts until then received. Does anyone have any additional update on the Handover status for Phase 1?
I went to the site on August 23. The A-2 looks complete from outside but the elevators are not commissioned/working so we could not climb 12 floors to see our flat form inside. So we do not know if all interior works as promised by them is completed or not. On my part every week I religiously keep writing to PRA and the usual reply is they are do the final touch for handover. I quite honestly do not know how serious they are in handing over this already delayed project. Among the owners also I see a lot if reluctance in going the legal way ....with just one or two members suggesting it. Rest everyone is blissfully silent hoping to get a "peaceful" possession soon. Asif Ali who used to head their Sales and Mkttg has left a year ago and I am told has joined another company called Phoenix construction. Nikhil Pai has been promoted to his position.

I also recently spoke to them and they said that the possession will be given in 45 days, this is after I was communicated on email that they will hand over the apartment for fit-out by May 15. When asked if that is the real possession they mentioned that the complete possession with all the permissions will be handed over after 6 months, and going by how it is now, it doesn't look like the possession will be given in 2014. What is the legal course, I think there are enough members here to form a group and take combined action.
I agree Agnelo, I have a trail mail of correspondences with all the senior management team at PRA and they repeatedly been ONLY giving excuses. I am not bothered if the issue is related to contract labour shortage or water supply. There is a contractual obligation to handover the flat and there is a penalty for the delay. However going by the past records I have my serious dobts if they ever will stick to these fancy deadlines.

Incidentally if you all recollect, there is a interest pay clause if the possession date is delayed by 18 months from the date mentioned in agreement. What is the status of the same, any comments from builder to any one here, please? Regards, Praveen
Hello Praveen......yes there is a interest clause ....and I have got them to agree in writing to the delayed penalty....the latest I was told is possession by May 15, 2014....
