Q: Hello all, I am planning to buy a MUDA site at Mysore which is in the following condition. The property was purchased by a person who has died now. It shall be transferred to this mother's name as he was unmarried at the time of his death. The original buyer who has died had bought it from a person who was alloted the site from MUDA. They are in the process of doing the khata transfer from the deceased son's name to mother's name. They have all the documents like Sale deed, Possession certificate, Old khata, Allotment letter and latest Encumberance Certificate. Only thing they don't h ave is the Title deed. They are telling they have not taken it as yet and now since the owner has died they cannot take it now. Only thing they can do is khata transfer at MUDA, Mysore. I am not sure if they are right. Can I buy such a property where everything is clear except for this. How essential is a Title Deed when the Sale deed is there. Is sale deed a sufficient document or I need to insist on Title Deed. I have photocopy of lease cum sale agreement between MUDA and allottee. I don't have original with me. Broker informed me that this is procedure in MUDA. MUDA keeps original lease cum sale agreement with them and issue photo copy to allotee. Is it true? Please confirm.
Mr. Victor. What is the procedure to obtain the original copy of lease cum sale agreement. Kindly let me know. I have to obtain the same.

Q: Hello all, I have purchased a Land loser site from MUDA 20 years back. I had not taken the Title deed at that time as they were not giving at that time. Now I want to take the title deed. If anyone has taken Title deed kindly let me know the procedure for obtaining the same. I am seeing that the fine amount is very high. Apart from that I wanted to know how much time it takes to obtain the same officially. Any inputs on the procedure will help. Pushpa

Did you get the title deed from MUDA?. In my case, I am the original allottee. I have not sold the property to any one. I have original Katha and Possession letter issued by MUDA. To get the Title deed, there should not be any fine. Is that Ok?. Uma
You need to go and find out at MUDA. If you build the house then there will not be any fine. That was the rule. I don't know how it is now. It is better to go and check over there only. It varies from one site to another. I have not yet got mine as yet.

Hello Pushpa, Please inquire with the concerned office for charges to get title deed. You can register property and on the basis of registered documents, you can get title deed.
You did not get my question. Title deed will be issued to the orignial allottee. If not taken at that time one has to pay heavy fine. That is the reason I am trying to find out the fee for the same. Concerned clerk is a cheat and he is not giving the correct information.

Yes, Copy of sale deed can be obtained from MUDA, Sub-registrar Office. The penalty clause kicks in only when the property without the title deed is sold to another party.
Thanks Sheshagiri Mehta. I have already given the application. I could not follow up in between. It has been more than a year. Fine seems to be little high as per my research on the net. It is around 25% of the subregistrar's value of the plot. I have met the Tahasildar also. He is also useless. Only thing I have not done is meeting the commissioner. I am really not sure if it will back fire if I meet the commissioner. Because I cannot keep meeting the commissioner all the time and work has to be done by the case worker. Do they expect lot of bribe. I really don't know. If you have done it for your site kindly let me know how to approach those case workers. It is so difficult to deal with them. I asked him what is his fees also. Even then he is not opening his mouth.

Yes that is the case Swathi Pachasia. The seller has sold it to me without the Title deed. Now I need to get the Title deed in my name as the property belongs to me now. So I need to pay the penalty now.
