Q: What is an Encumbrance Certificate? Please give some details.

My replies to this discussion
The Encumbrance certificate is one of the most essential legal documents for properties. It is issued by the state registration department. The most critical information mentioned in the EC is the name of the current owner of the property. While negotiating with the apparent property seller, it is very useful to check whether the seller is registered as the current owner of the property according to the government issued EC. Imagine paying the advance to a fraudster who has forged documents and given them to you! As a prospective owner of a property, it is essential that you are aware of any impending dues on the property. Imagine buying a property without knowing that it had been given as collateral to a bank for a loan by the earlier owner. What a nightmare this could be!The Encumbrance certificate is one of the most essential legal documents for properties. It is issued by the state registration department. Q: How to find an encumbrance certificate online without visiting the registrars office?

Hello maatrum, You can apply for Encumbrance Certificate by filling Form 22 with Rs 2 non judicial stamp affixed. You need to attach address proof to avoid any misuse like driving license, passport etc. On Form 22 you also need to mention....1) The period for which you require EC, 2) Property details like area of property, survey no, address etc. 3) Purpose for which EC is required, 4) Ownership details. The fees is charged depending on no of years for which the EC is issued. Standard Encumbrance Certificate is issued for 13 years or 30 years but you have to force them to issue for 30 yrs.
