Q: In Mumbai housing society, where builder's sales person helps owner to rent out his/her apartment can charge tax on the commission they get from the prospective tenant? Is it legal?

Hello, Praveen Modi Thanks for replying to my question. There is a well-known builder in Mumbai area and they have quite a few apartment buildings around Mumbai. As I am looking for rental property, I talked to one of their sales office who is helping some of the owners in renting out their newly purchased flats to prospective tenants. They told me that they charge commission plus tax of 12. 36% (or so) on the commission amount that they get from the prospective tenants. If they are doing this, is it illegal? Should this be notified to some Government authority? I was wondering are you quite familiar with real estate issues? My budget is under Rs.15,000.00 rent per month and deposit amount under Rs.60,000.00. Please suggest the best area in Mira Rd. or Dahisar west or east. My budget is around Rs.14,000.00 rent per month and around Rs. 50,000.00 or so deposit.

Well in case if you are looking for the rent property in Mumbai , you really need to work hard for this. Searching the real estate property is not as easy as compared to other locations in India. There are various online and offline brokers who can help you to grab the safest and cozy Mumbai Rental Properties .

Hell Yamini, There are various online websites which can help you in grabbing the best possible flats, apartments and even space for your office at affordable prices. But before you are about to finalize the deal and pay the broker make sure that you are heading towards a safe and valid contract .

Q: Mumbai apartment housing society Maintenance office asks residents to submit photos for ID cards. ID card was to be issued when everybody's information was collected. Several months later, when asked to the management officer about the ID card he said, it will be issued within 15-20 days. Eight months have passed and now they are saying they have lost my photo and asked to submit the new one. Apart from this, there is lot of mismanagement going on in this reputable housing society, so I refused to give another photo and asked them to find the lost photo. What action should be taken against this careless society? YM

Hello, Rakshit Thanks for your prompt reply. It has nothing to do with disturbing me or not. It is the carelessness and irresponsibilities of the office staff I have come across many times. Recently, when I asked the person whom I had given the photo nearly, seven months ago, where is my photo and what happened to it? He gave me bunch of excuses, run arounds and diverted the issue by giving unrelated useless explanations. When I gave the photo, he had put it in a box so I asked him what happened to the box how did the whole box got lost? Do you mean to say you have also lost other people's photos. He did not reply to me. I told him go and find my photo. Apart from this, it does not take 6 to 7 months to prepare a photo ID. I have no way of knowing whether other residents' photos got lost or not. I did speak to the head of the dept. There are lot of inconveniences here and I will be moving out of this place. Q: What to do after renting an apartment If you find out that toilet, geyser are not working/malfuctioning and there are several other problems. Also, apartment was not clean and owner said, she spent Rs. 2000.00 to clean the apartment. But apartment is not clean the bathrooms and kitchen are dirty and there are cockroaches even in the bedroom.Owner had left some of her things in the apartment and broker said he will have it removed but so far he has not done so. Broker is not responding about the repair work either.. What is my recourse? Before renting an apartment I had asked the owner whether she can install a fan in the kitchen? she had agreed to it but later on said she would not. I have signed 6 months locking period in the agreement. I am an NRI trying to resettle in Mumbai. What are tenants Rights in State of Maharashtra? Please reply this is URGENT. Thanks. NM
