Q: Were paying rent of 14000 and Agreement is over by Feb'14 and Landlord updated us in Jan'14 that he is increasing the rent , so we told we will not renew the rent agreement, will vacate the property within one month., But now he is saying I will deduct one month rent from Deposit as we have not Given him Notice of 3 months. First Our he didnt updated us till 15Jan increase of rent. Then Our rent agreement is over by this month so we thought we have to vacate the house, He also uploaded the advertisement on CommonFloor that His flat is ready for immediate possession. Agreement say in One line that We have to inform him Before 3 months. Thats it. My question is that Our agreement is over and WE are not suppose to give notice of 3 month and we gave him 1 month notice. 2. Agreement doesnt say that he can deduct the amount if we didnt serve the notice. 3. his mistake he is increasing the rent by Approx15% not by 10%. 3. What Can I do now

Q: Dear Sir We stayed in an apt in Goregaon on rent (Bangur Ngr, Mumbai) from Jan 2013- Aug 2014. While leaving the apt the owner refused to pay us the 20 k from the 1 lakh deposit. He cited the following deductions.Rs 10,200 for car parking, Rs 3500/- for AC repairing, 2665/- rent towards additional days. and the rest towards gas and electricity bill. While we agree for expenses towards rental, light, the contract doesnt mention the expenses to be paid for parking. The AC which was repaired while we moved in broke down within a month as it was already an old one. Also the breakdown is due to internal technical issues and not external. We have not used the pipeline gas connnection and hence we are not eligible for the payment. The contract also has not mentioned anything on the same. The owner have been totally harrowing us since the time we have shifted to his house as that house was full of leakage and he never bothered to rectify the issue. In addition he is now refusing to return our money which we believe is our due. Request your help.

Q: I had a bad time in vacating the rented apartment in AWHO, Gurjinder Vihar, Greater Noida. Flat owner has clearly said NO to return my security deposit and falsely made claims that I have damaged many things and now he will get them repaired. looking for any remedy to get my hard earned money back. Q: I am buying an apartment in Bangalore and I have received a sale deed draft from the builder. Can I go ahead with the registration process using the draft? How does one usually go about with this process. Please advice

Hi Jyotsna, The sale deed is the most important document when purchasing any piece of real estate as it decides your fate. This is the document by which the seller transfers his right to you, and you acquire an absolute ownership of the property. One of my friends registered the sale deed the builder provided without getting it reviewed. He landed himself in deep trouble because of this. Most of the times the fine print is always in favor of the builder. I suggest you get the document reviewed by an experienced property lawyer.
