The Builder indicated in his brochure that the 2BHK Flat will be given possession by 31st Dec.10 and so far not given as construction was at snail's pace. He has mentioned in the agreement that Rs.5/- will be given for the delay, if any, per month. After paying Rs.28 lakhs we have stopped further payments as the construction was very slow. Now, the builder is unwilling to pay even the paltry compensation mentioned above and intends to charge 18% for the balance amount due to be paid. (i) For his inordinate delay, whether we can demand higher compensation? (ii) Whether National Consumers' Commission or Supreme Court has given any Ruling on such errant Builders? (ii) How far it is justified that he is withholding payment of compensation and on the other hand invoking the clause of 18% blaming the owners as defaulters? Whether National Commission for Consumer Grievances or Apex Court has given any judgement in this regard to tame/discipline the Real Estate Companies?

To add to the miseries, the Builder has now demanded exorbitant legal charges of Rs.25,000/- to be paid before possession letter is issued. At no time, this has been informed to the allottees. This is a rude shock to the hapless and gullible flat owners. The construction of Flats is very sub-standard and one will be jolted to see the poor finishing. For the price paid for a 2BHK of 1150 feet, what you get is only 585 sq.ft. You may kindly give additional information as to how many times, circle rates have been hiked for Sec.61 from April, 2011 upto January, 2013 and each time the per centage of hike may also be indicated.

I have collected authetic information now. GARDENIA GRACE IN SECTOR-61 HAS EXTRACTED RS.25,000/- IN CASH FROM EACH FLAT OWNER IRRESPECTIVE OF THE SIZE OF FLAT FOR BRIBING THE SUB-REGISTRAR, NOIDA WITHOUT ISSUING ANY RECEIPT. AS I AM AGAINST CORRUPTION, HOW TO GET BACK THIS HARD EARNED MONEY FROM THE BUILDER? HE HAD STATED THAT UNLESS THIS AMOUNT IS GIVEN, REGISTRATION CAN'T BE TAKEN UP. TOTAL FLATS: 142

In the List of Documents required for execution of Sub-Lease Deed at S.No.12, it was clearly mentioned as Rs.25,000/- (Cash) towards Sub-Lease expenses although it was not signed but the I/C Accounts Deptt's own handwritten name of the flat allottee's name and flat number stands as a proof to establish the culpability of the crime. Other Flat owners also vouch for this extortion by the unscrupulous builder.

AS PER THE SUPREME COURT ORDER,STILT CAR PARKING SHOULD NOT CHARGED BY BUILDERS.BUT NO BUILDER IS OBEYING THE LAW.ALL THE BUILDER ARE COLLECTING FOR CAR PARKING AS THEIR WISH.WHY SUCH THING HAPPENING OR NO GOVERNMENT OFFICIAL ARE NOT INVOLVED TO TAKE ACTION AGAINST BUILDERS .REQUESTING YOU TO ADVICE ON THE SAME TO PROCEED FURTHER.

Consumer Forum-VI, New Delhi has directed in CC:1129/13 on 16.2.2015 M/s Gardenia Shelters Pvt Ltd, Noida to refund car parking amount of Rs.2 lacs collected from ABV Vijayalakshmi along with 9% interest w.e.f.27.10.2009 until the date of payment and Rs.35,000/- towards harassment, deficiency of service and legal expenses.
The Competition Commission of India (CCI) too pointed-out that the Parking Area can't be charged for separately and must form a part of common area and facilities. If the seller / developer mentions Car Parking Area as a separate item, one can challenge the Developer. Car Parking is a part of the Society's Common Area. It is not part of the Floor Space Index. Hence, the Realtor has no right to charge any amount for this Space.
