Q: I am intersted in buying a flat .But I am told builder has not got Oc and khatha and he is collecting large amount to get the Oc and Khatha. I want to know if these serious issues are true or not.Please enlighten as I am keen to buy a flat in this beautiful complex.

I have heard a few horror stories from my friends who lost couple of thousands by placing their trust on brokers(touts). Q: I have a question. I intend to buy a resale property at Bangalore. However the present seller does not have Khata in his name. He has executed sale deed and sale agreement only with his previous seller. The khata is in the name of previous seller. Does this create any problem if we buy now? How is the procedure?

Q: I need to get Khata transfered for the plot I purchased recently in Anjanapura. I was told that BDA requires the original of the old Khata from previous owner for the transfer. All my originals lie with my bank as I have taken loan. Does BDA really require original Khata for transfer? If yes, will my bank give the original for this purpose alone so that I can submit it later? Thanks

Q: Hi, How are the terms on Occupancy certificate mentioned in the Sale agreement or Construction agreement? I am looking at purchasing an apartment from a fairly new builder (has done 2 small projects so far). I asked for a term to be mentioned in the Sale agreement. I asked for the below two 1. That builder commits to providing Occupancy certificate within 6 months of possession of the flat by the purchaser. 2. That the last payment 5% (or could be 2.5%) would be made only after Occupancy certificate is provided by the builder to the purchaser The builder is willing to provide '1' but not willing to add any clause that says what if the occupancy certificate is not provided within 6 months per the term '1'. Is this good enough? The project is on Sarjapur road in a area of over 1 acres. The builder is confident of providing Occupancy certificate. From where the construction is today (it's a G+4 with 2 Basement parkings), there seems to be no significant deviations. Thank you.

Q: Question is regarding occupancy certificate. Is it mandatory ? Most of the builders dont provide and evade the question when I ask them about OC . I came to know that the flat owners have to pay heavy fines when they are reselling the flat and are not able to produce OC.

Occupancy certificate should be demanded by all buyers from their builders. Unfortunately there are so many deviations done by the builders these days. The buyers who are unaware of these gimmicks are getting stuck in such projects. Q: Hello, I need help on property registration rate in Bangalore. I am getting conflicting messages. Somebody says it is 6.7%. Somebody says its 6.7% for stamp duty and then, additional 1% for registration. Somebody also says there is additional 1% TDS too. I want to know what is exact rate.
