Right Hitesh........the Urban Development Department has finally cleared the proposal yesterday to increase stamp duty by 1% in Metro Rail corridor. The corridor is the area lying within 500 metres on both sides of the Metro track. The duty will now be 7.5% instead of 6.5%. The 1% registration charge (maximum Rs.30000) will remain unchanged. According to Section 4 (1A), (iii), (viii), (x) and Section 10(1) of Maharashtra Ownership Flats Act, 1963, the builder/developer has no right to sell the terrace. The builder also does not have the authority to sell the terrace of a building. As per law, all open spaces in a building, including the terrace is a common easement for the benefit of all the members who are entitled to enjoy the same as shown in the Municipal Corporation records. As per my knowledge you will be required to get this done on your own. In case you are purchasing resale property you will be required to do

As Balaji Dream City project is a delay project, you can visit the builders' office and ask for the cancellation. But before that you should check your agreement for cancelling clause and penalty. Similarly, if there is any clause for penalty for builder. If they are not ready to cancel the booking and saying that 10-13% will be deducted for cancelling of deal. Then consult a property lawyer and send them a notice for cancellation of flat with penalty. You can also file a case in the consumer redressal forum for delay possession.Hi,

Mohan Group has Delayed the Possetion for four years.Although the possetion date was written in the sale agreement. Also some of the flat were having leakage issue in Mohan Greenwoods. Also Builder has taken one time society maintenance fund from all of us. They are calling it as Soeciety Maintenance Corpus fund. and the same will be hand over to society after society is formed. Our Society is formed but builder has not handed over all the money properly to society. Out of that lot of money used by builder to pay their employee salary and to hieght Diwali Bonus that too huge. Which is very wrong. They have misuse our hard earn money. Guys be aware about these issues which we have faced. This might help someone. We got be wise and alert.

Q. During Oct 2013, A builder has launched a Project with 20% and 80% scheme. I paid 20% and received the allotment letter. Up to now, the said builder has not started any development and there is no hope that he will start the construction very soon.
During the several meeting he highlighted many technical and financial issue. Now my question is if i terminate the agreement and request for the refund, will i get the benefit (interest) on my 20% deposit?
