Hi everybody, Good news for owners of Hiranandani Gardens.....In a relief to residents of Hiranandani Gardens in Mumbai, the Supreme Court on yesterday dismissed a special leave petition filed by real estate czar Niranjan Hiranandani's company challenging a Bombay high court order that stopped him a few months ago from constructing small homes around their plush towers in Powai. The Supreme Court requested the HC to now soon decide a suit filed by these residents who are seeking conveyance of the land from the developer.
Right Diwakar, The developers had signed a tripartite agreement with the MMRDA and state to develop 230 acres in Powai for construction of MIG homes of 40 and 80 sq.mt. Residents' main opposition is that no additional buildings can come up on Sector IV-A of Powai Area Development Scheme. They do not want smaller homes in their "backyards".

We the purchasers at Bharat Belmonte a project of BharatInfra group are suffering big time due to the apathy of the builder. The builder has cheated us and is not giving the completed project and the amenities as promised in the agreement. This is day light cheating. There are gaping security issues and safety issues like no certificate to operate lift etc, Debris, Unclean Overhead water tanks etc which add to the risk and may even result in loss of life. The builder has taken money from us for various things like yearly maintenance, transfer of membership to the existing society (this is a redevelopment project) and has not bothered to complete his obligations Extremely unfriendly and unprofessional approach by Bharat Group and partners Taksha Developers. Bharat Belmonte: Firstly the project delayed and delivered with huge delays. Moreover, the possession was the most difficult with unfavorable conditions against the buyers, no parking allotment, with incomplete work
Hi Belmont, It is a clear cut case of deficiency in service. File a case against the builder in consumer forum. Builder can not change the floor plan. They will have to offer the said amenities.

Hi Shreya, If you are seriously looking forward to buy the property and want to get a good deal, then do not show your eagerness to buy. Hide that over enthusiastic and needy person inside you. The agents/sales executives are paid commission on closing the deal and they will go to an extra mile to close the deal with you. Show them that you are not in hurry and your life does not depend on the property. Show them that you are a serious buyer who is not in hurry and if they have to win you, you will require a good incentive to invest money.

@Sanin, I too have received the same demand for Tower - C1, Floor 13th and 14th + BRICK WORK ). I found the demand out of schedule as per what they had published at the start of the project. So, I had raised a number of questions with the customer care on this and asked them to get the reply on my emails from a senior person. Their VP Mr. Ramnath called me and advised they the BRICK WORK and Plaster work is not linked to the sequential construction plan and can be asked based on the start of the work. Thanks for sharing the info and it gave me a bit of comfort that everyone is being asked for this amount. I was concerned if they are really doing the work on such pace that they are demanding the money every month. If anyone has the updates then please share.

@Roshni, What i am thinking is that any effect brought in by REITs on the real estate market will, however, take a long time to implement. It will take at least 3-4 years to become an effective instrument in the Indian real estate sector. However, it will definitely gain popularity among developers and investors over mid- to long-term.
But as per me if you plan to buy a property, look for ready-to-move in projects as inventory is still available. If you plan to take a home loan, it makes sense to wait for lending institutions to reduce interest rates.

Hi Anuskha, I am looking for 2BHK in 1215 sq-ft in Hiranandani Zen Atlantis, Powai. I heard that they are quoting different price for different facing flats? What will be the floor rise charges and what about the project approvals? Have they got approvals up-to 30th floors?
Yes, there are two side facing flats in Hiranandani Zen Atlantis. They are charging Rs. 22000/sq-ft. for Lake Facing and Rs. 22800/sq-ft. for Garden Facing. And Rs. 150/sq-ft for floor rise. Zen Atlantis by Hiranandani Builders is a BMC approved project and they got all the required approvals. They also got construction approvals up-to 21st floor.

Hello Anuskha, According to me, investment in Kharghar is a good idea for those who are either working here or want to stay invested in property market for next few years. The current property rates in the locality is Rs. 6500-9500/sq-ft. but the values may vary depending on the location, infrastructure, amenities, facilities and other related issues.

You can invest in the project but before that you have to do a lot of homework. The developer is a brand name in Mumbai's Real Estate Market. It is true that it's some of the project is getting delayed. So, my advice to you that you should verify all the legal approval, bank approval, connectivity of the project, basic amenities from the project site, transport facilities of the locality and then go. According to CREDAI, Carpet area of unit is calculation as internal wall to wall measurements of all Rooms, Internal Passage, Toilets, Store Room etc. (without considering plaster thickness, skirting and column offsets) with addition of the internal area of Balconies and area of projection of Cupboards upto lintel level. No architectural features should be taken in Carpet Area Calculation. True Suresh, Kopar Khairane is a fast developing micro market of Navi Mumbai, whose realty market has been showing positive signals. It is one of the best locality of Navi Mumbai. Hi Anuskha, This could be the one reason for a large number of of investors, both from Mumbai and Pune, are choosing Navi Mumbai as their second home destination, and Kopar Khairane ranks high on their list of preferred destinations because of its location near the Mumbai-Pune Expressway and very good connectivity to various key city centres via its strong rail and road network.
I accept that Veena, We can not over look the social and general infrastructure at Kopar Khairane as it is improving rapidly and many quality educational institutions and hospitals are nearby. The residential supply here is strong, with many reputed developers offering a wide range of residential options at affordable prices. Some projects even cater to the requirements of the luxury segment.

@Lalit, Time taking is not the matter but the result should be sweet and productive. The first extension was allowed in April and the revised plan was expected to be put up for citizens' suggestion, objection in September. In the backdrop of the second extension, this process is now estimated to take more than a year.
Hi Tarun, Don't forget that the ongoing revision of Mumbai's Development Plan has already put the city's property market in disorder. It has affected almost all deals involving land parcels, society redevelopments and even slum rehabilitation.

It is right Shreya. Engineers and junior officials alleged that Architects are called to the building proposals office late at night to process their files. Currently, developers have to obtain NOCs from various departments like traffic, fire brigade, pollution dept. etc. But, now they have to obtain no-objection certificates through private consultants instead of civic officials.
Something is better than nothing Kalki........Civic Chief Ajoy Mehta informed civic group leaders that the administration would approve building permissions within 90 days. The BMC has decided to bring down the number of building permissions from 150-odd to just 70.

Police have already submitted the compliance report on action taken against the accused in the high court. Local inhabitants too lodged some FIRs against the builders and the police have registered suo moto FIRs in a few cases after scrutinizing documents.

Yes, often members of a society take matters into their own hands and commit illegal acts such as enclosing balconies or even converting residential premises into commercial premises. Doing so without the proper permission is an unlawful act and very often it leads to conflict with angry society members and civic authorities alike. However, there is a way to legalize it. members of a society who want to enclose their balconies have to make an application to the Ward Officer along with a copy of the plan of the balcony. The applicant has to pay the prescribed fees for the same and if the applicant has already enclosed the balcony then the ward officer has the power to regularise the case on receipt of the application. @Saran, Even Maharashtra Navnirman Sena president Raj Thackeray had questioned the delayed opposition of the Sena to the project pointing out that the Sena-ruled BMC had approved the proposal in July 2015.

Hi Shreya, It definitely is refreshing to hear that the Mumbai proposal is the lowest among the 10 major cities. However, I am skeptical as to how far this will remain accurate when it comes to the implementation of the project. If we look at the past project proposals both in Mumbai as well as other cities in the country we an see that more often that not they have overshot their initial estimate. While the low proposal is still welcome, I doubt that the project will be able to stick to it's proposal considering the high amounts of corruption, bureaucracy etc.
I agree with you but at the same time i would like to remember you that so many initiatives are taking to make this mission successful. There will be a separate dept. which will keep close eye on them. They will have to give the details of every single penny.

Better, you form a what's up group and gather all the flat buyers. Visit the developers office and ask for the possession. If you are not getting any positive response from builder's side then write a mail asking for possession with delay interest. The absence of a valid Completion Certificate/Occupancy Certificate mean the building may not have been constructed as per the approved plan, as it can be classified as unauthorized structure and you are taking the risk of demolition as we have seen in the Campa Cola Society cases.Hi Ashwaane!! Q: HDIL is demanding extra money in cash over and above the agreement amount for giving possession. What can be done in this regard. The builder has delayed the project over 5 years and we have suffered huge loss on account of interest etc.

Hi Arun, In case of delay in delivery of possession by the builder, the legal options that are available to the allottee are to file a consumer complaint or file a civil suit against the builder for the refund of amount paid to the builder and the interest thereon.
That is why i am telling you to take the possession first. And then file a case against the builder for deficiency of service and ask for the compensation on delays with interest. There is provision if builder is giving possession of the property late then he is liable to pay penalty.

Q: Good project. I visited the site yesterday. Sales representative was very genuine & sophisticated. They also had good knowledge abut the area & infra around it. Wonderful project by Acme. I'm confused between Boulevard & Oasis. But I might end up with oasis as the price is much better.

Hi, I have recently visited the site Acme Oasis, kandivali, project has turned out very well 23rd and 27th slab have been completed respectively. Work is in a full swing. Possession date will be December'2017.
Yeah, located in kandivali east. One of the best projects in that area. Builder is also trustworthy. Latest price is around 1.27cr for a 2BHK apartment which is better compared to other projects in the locality. Around 70% of the work completed of 27th slab & 24th slab in the two towers respectively.

Freeway 37 is a ongoing project. Builder has got the IOD and applied for the commencement certificate. It is a BMC approved project and Axis, ICICI, Indiabulls, ICICI Home Finance, HDFC, PNB Housing Finance etc have approved it. As far as project possession date is concerned, 3 yrs from start of construction work i.e December 2020.

Q: i have purchased a flat directly from builder in a complex where society is already formed. Now society is demanding for transfer charges payment to register myself as a society member. Is it compulsory to pay transfer charges in case if the agreement is directly done with the builder ?

Hello Subodh, Co-operative housing societies levy transfer charges and transfer premiums according to the bylaws. The transfer fee charged by the society has a legal basis as in an existing cooperative society, the owner of the flat only holds a share in the society and enjoys the right to occupy the particular flat that he owns. The transfer fee amount is decided by the members of the general body of the society.
I agreed with Salini. On the other hand, transfer fee to a builder illegal too. There is no legal basis on which a builder can levy transfer charges on the apartment owner. However, numerous complaints have been brought to the forefront related to illegal demand of transfer fee by the builder. According to complainants, the builder succeeds to exert influence as banks and home financing companies demand that the buyer procure a ‘No objection to Mortgage’ certificate from the builder, failing which the loan cannot be availed. Also, the builder takes on the responsibility to form the society or condominium and can manipulate undue influence by leaving out a particular owner’s name as a member of the society.
