Our co-op housing society registered in Mumbai on Feb 2010 with 184 flats; most of the flats owners got possesion before 2008; occupation certificate issued by BMC in 2009. Buildings land conveyence between developer and society is still not done. Our society and 12 more buldings located inside the same estate boundary with single entry main gate. Entire estate land of 200 acr is owned by Developer (leased from third party owner for 99 yrs). We dont have BMC water supply. now for borewell water when we called the Borewell service peaople with their equipement vehicle. they were stopped at the Estates main gate by security of devoloper.Does developer (builder) had the legal right to stop us from doing so? Does conveyance of land required for bore-well ?

If you have legal permission from the BMC, then you can send a letter to the builder regarding digging bore-well. But if you do not have any permission from the authority then you cannot dig the bore-well and moreover the builder will have the legal right to stop you from digging the bore-well. I have also purchased a flat in the D block Synchronocity, Powai. Everything went smooth with the builder so far. However, since the lift is not ready yet , we cannot move in. We have taken the furniture possession but without the life cant move in. Though some families have moved in, it is difficult for people on higher floors. Is there any body from D wing who has some correct information? I tried calling OTIS but even they are not confirming the completion date. The summer break will be over soon and I have to move in as my child has taken admission in a near by school. Any information would be helpful. Thanks

Total extra money that Lodha has asked till now is Rs. 100800 (Parking)+Rs. 27000 odd for MVAT + Rs. 87000 odd for Service Tax + Rs. 47000 towards upkeep of public amenities. My father purchased a plot in a co-operative society about 20 yrs back, in Akola, Maharashtra. Society was formed by teachers. That time, he had plans to construct house & got loan from HDFC. But the president of the society, mis-used the funds collected & committed suicide. Then it became clear that the society will not do the work as promised & my father closed the HDFC loan. After a gap of 3 - 4 yrs, individual members of the society started constructing their houses & started living there. My father got transferred to a diff city & could not do any work. Now after 20+ yrs, he is interested to sell this society plot. But the current president of the society is telling my father that selling this plot is difficult as registration with state govt has not been done & no bank will give loan to the new buyer.
Help me to understand how this works ? Is it that co-operative society members do not have to go to sub-registrar's office to registrar their plot ?

As far as I know first your father has to do register the plot in his name. For this he can use the loan papers, sales deed and whichever document he had obtained earlier related to this deed.
