Hi all, Yesterday, the Delhi High Court, with regards to a recent case, ruled that service tax cannot be levied on under-construction flats in a housing project. Service tax on under construction property is charged on 25% or 30% of its value. is not charged on the entire value of the under-construction property, and is instead levied on a certain percentage of the total value, i.e., the cost of construction.
Yes, i read the Delhi High Court judgement against a Noida Builder and and fined him with 6% interest. And from now the effective rate on the entire value of a property costing below Rs.1 crore is 3.75% (i.e., 15% * 25% of the property value), and for a property above Rs.1 crore, the effective rate is 4.5% (15% * 30% of the property value). Accordingly, if you are buying a property costing Rs.75 lakh, you will have to pay Rs.2.81 lakh (3.75% of Rs.75 lakh) as service tax. Similarly, if the value of the property is Rs.1.5 crore, service tax would be Rs. 6.75 lakh (4.5% of Rs.1.5 crore).

Yes Anoop, from April 1st all the properties can use water only if they have fixed meters.. otherwise the AMC will take action against them. Hi everybody, At last Parliamentary Committee on 31st of August 2015, recommended a slew of measures favouring property buyers and submitted its report in the House, which consist a 3-yrs jail term or a fine for a defaulting builder under a new law which will now cover projects of 500 sq-mt or 8-flats.
Yes Rabindra, It has become a burning topic for the country now. Every next day you will hear some news on it. The panel recommended that promoters should get their accounts audited within 6 months after the close of every financial year by a practicing chartered accountant.

At the same time a builder or developer will have to enclose details of its existing projects, details of approvals, land title and payment dues while applying for registration of any project with the authority. The panel define again the carpet area, according to them, the net usable floor area of an apartment, excluding the area covered by the external walls and that under service shafts, exclusive balcony or verandah and open terrace areas, although it would include the area covered by the internal partition walls of the apartment.

I totally agree with you Arpit...... "All's Well That Ends Well" is a Idioms that suited this market perfectly. It is true that the bill can help farmers but at the same time it will not harm the real estate sector or developers if it is handled in a right manner.
It is also came to hear that to protect small property buyers, a parliamentary panel is recommended to cover housing projects on land below 1000 sq-ft in the proposed Real Estate Regulatory Bill. Earlier it was provision in the bill that builders could register with the regulator only if the project was on the land exceeding 1000 sq-mt.

I think even the panel is waiting for this bill as they have not changed the penalty provisions of the Bill and retained the original proposal such as imprisonment of developers for any violation of the proposed law. It indicated that everybody want that the sale of plot, apartment or building in an efficient and transparent manner, to protect the interest of consumers in the real estate sector.

Hi all, For investment and for a longer horizon like 5-10 years, it might be a better location. But as of now, in next 2 years, it wont be much better to live. There are much better locations to live right now. I advise you visit the place once. If you like it, then go ahead. I really like the project because its from Godrej and construction is being done by L&T. But I dont feel like investing in a flat personally and for self-use, there are much better areas in Ahmedabad.

Hi, We have seen that Ghodbunder Road, Thane has registered a capital appreciation of almost 85-90% in the prices of residential property during the last five years. The residential property price was Rs 4000/sq-ft in the first quarter of 2008, the property prices here grew up to Rs 7450/sq-ft by the last quarter of 2012. This area recovered appreciation of 20% in 2009-10, 30% in 2010-11 and 20% in 2011-12. The average prices of residential property in the area were Rs 5700/sq-ft in 2011 and Rs 6870/sq-ft in 2012. Current price range on Ghodbunder Road is minimum Rs 7500/sq-ft to Rs 9100/sq.ft based on the location. The area has witnessed a capital appreciation of 3% during the last six months. So investing here for a time horizon of 10 yrs will definitely give you a record appreciation.

@Abhishek, The famous developers having projects here include Hiranandani Constructions, Cosmos Group, Vijay Group, Prestige Constructions, Rosa Group, Bhoomi Group, and DB Realty. Lodha Group has also coming up with a new residential project in the neighbourhood. The impending 8-laning of the Majiwada flyover is expected to improve traffic conditions and also raised the residential property prices in Waghbil after the completion of this flyover.

Hello Mr Anand, As far as i see, both the projects are good and also in proximity to each other.. the plot size is Sahaj is 683sqft while the Riviera plot is bigger at 841sqft. If pricing is to be considered then the Rivera is costly at Rs 42 Lakhs while Sahaj is at around Rs 32 lakhs. Hi Anand, i guess the 32 lakh is just the basic price of the project and i don't feel much difference in the specifications.... 3 bedrooms in the first floor is not a drawback but you might consider that as a fact if your parents or elderly person is there who might find it difficult to climb stairs to approach a bedroom.

How about the amenities and the floor plan in both the projects??
Well, both the project have Well equipped club house with Ac hall, Gym, indoor games area, childrens play area, water supply, and security.. i think Sahaj does not have a swimming pool while riviera has one.... other than that if you look at the floor plan then Sahaj has Drawing , dining, kitchen and 1 bedroom in the ground floor and 2 more bedrooms on the first floor while Riviera has all 3 bedrooms in the first floor with just drawing, dining and kitchen in the ground...

Well, i was told that the Satva Sahaj will take at least 1 and half years more to be made... while Riviera will be available quicker with mid of 2015 as the possession year.. so again the difference is not very much ..probably a month a 2 here and there...

Q: Hey guys! I remember reading a couple of months back about the proposal of a 4 lane road on Khandwa road. Is that happening or not? Also there was something about a BRTS corridor proposal in the area. I don’t know what happened to that either. Hi Jyothi, As per my knowledge, the dilapidated colonies will be replaced by multi-storied high-rises in which the residents of the old colonies will also get new houses without any additional cost . Hi Vikash, As per my knowledge, Ambawadi & Navrangpura are nice locations & fully developed also. Even as of now some infrastructure development is happening. Both locations are prime residential decent location. From connectivity point of view, both locations are well connected with other parts of the city by city transport , bus, train & railway. Rental appreciation is very good & high in these above said localities.
Hi Vikash , According to me,Ambawadi, one of the centrally located suburbs of Ahmedabad, recently gained prominence for rental preference. Ambawadi emerging as the new preferred area for rent is its proximity to GIDC industrial area and IT companies located within the area itself. It is located close to the GIDC industrial area as compared to Satellite and Bopal, the most preferred localities for rent.

Well according to me, connectivity directly affects a buyer decision of selecting a locality. Cheers folks !!!!! The select committee of Rajya Sabha would have tabled its report on the The Real Estate (Regulation and Development) Bill, 2013 yesterday. Hoping, that sluggish realty market will soon see some improvement in sales.
I read several articles on it. The major consumer protection measures proposed by the 21-member committee, headed by BJP MP Anil Madhav Dave, is the mandatory condition that developers have to deposit 50% or more of the home buyers' money in a bank which shall be released according to the progress of the construction work. According to me it's a good proposal for both the developers and well as for the buyers. How many of us are agree with this proposal?

Hi Everybody!!! 1) For transfers other than in (b) in urban area :- 8% + 25% of duty = 10% on market value of Property 2) For transfer relating to premises in Co-operative Society registered or deemed to have been registered under Gujarat Co-operative Society Act, 1961, by such society in favor of its member or by such member in favour of another member or for transfer of premises relating to Board Constituted under Gujarat Housing Board Act, 1961, or Gujarat House Board Act, 1972 or to which provisions of Gujarat Ownership Flats Act, 1973 apply :- 6 % + 25% of duty = 7.5% on market value of Property.
Whereas in Ahmedabad, stamp duty is charged at 4.9% and registration fees is 1% of the market price of the property or the transaction value, whichever is higher. But there is a exemption for the women property owners from the registration fees. From now onward, there is a hike in property tas as buyers have to pay Krishi Kalyan Cess-0.2% and Swacha Bharat tax-0.2% which is effective from June 1st.

You are right Ravi........ All's Well That Ends Well is a Idioms that suited this market perfectly. It is true that the bill can help farmers. But, at the same time it will not harm the real estate sector if it is handled in a right manner.
It's true Daya, It is also came to hear that to protect small property buyers, a parliamentary panel is recommended to cover housing projects on land below 1000 sq-ft in the proposed Real Estate Regulatory Bill. Earlier it was provision in the bill that builders could register with the regulator only if the project was on the land exceeding 1000 sq-mt.

@Daya, I think even the panel is waiting for this bill as they have not changed the penalty provisions of the Bill and retained the original proposal such as imprisonment of developers for any violation of the proposed law. It indicated that everybody want that the sale of plot, apartment or building in an efficient and transparent manner, to protect the interest of consumers in the real estate sector.

I have read that nearly 150 road projects are up for sale as infrastructure developers try and reduce debt on their balance sheet. Long-term investors, many of which were careful of the Indian infrastructure sector so far. They are also starting to show interest in cash-flow generating business.
For road sector, IDFCs' strategy is to obtain controlling shares in operational projects and merge the shares into a holding company, which can in the end be listed through an IPO or InvIT (infrastructure investment trust) route. They are also willing to sell the portfolio to investors looking for long-term yield.

Right Ketal, And RBI's move comes at a time when things have begun to look up for the real estate sector as the economy has been performing better, salary increments are expected to be healthier and if the amount of office space that was leased in 2014 is any indicator, job growth is not far away either.

As they can see that courts, state governments, as well as the centre with its proposed real estate regulatory bill taking a strong view on cases of cheating, fraud, delays in delivery against builders.
And recently they have seen the Unitech case, where its chairman, two managing directors and a director had to spend a night in jail, and bold actions from the National Consumer Disputes Redressal Commission against different builders have come as a kind of confidence booster for home buyers who have been fighting builders in different forums.

It is illegal and you don't need to pay any scanning charges. If builder is forcing you to pay then challenge him in the court. Builder is charging unnecessary charges because Ahmedabad Municipal Corporation has asked the developer to pay "Betterment Charges" which he want to recover from the buyers.
I am agree with Devesh........and also advised you not to pay such unnecessary charges to builder. Following the AMC notification, developers are expected to pay up to 20% more over the current jantri rate. This could increase land costs which would ultimately be passed on to the consumer.

It is very well connected to the rest of the country via roadways, railways and airways. It has an international airport too. The process of expanding the airport is under way and now we will have a Multi-modal International Cargo Hub and Airport at Nagpur (MIHAN).

Q: Hi, I have a piece of land purchased long back without any documents. There were several pieces of land surrounding it which were purchased in bulk by others. All the purchases by me and others were made together. Now I want to get the land registered. May I know the process for it? The boundaries are clearly demarcated in terms of identifying the piece of land. There is no property constructed on the land nor there is any electric connection. It is just an open piece. I received a tax receipt from the officials which says the owner as Not available. So how do I get the land converted to my name in the absence of any documents?
