Q: Hi, I have booked an apartment in Electronic city, Bangalore. The flat is under construction and will be available for possession during feb 2013. The builder has given us the cost break up which has Rs.2,62,000.00 as service tax and VAT on the property which cost Rs.32Lakhs (basic cost + car parking). Kindly clarify me, what is the calculation for service tax and vat? Also pls clarify me what is the need for two separate agreement, say sale agreement and construction agreement? Now my builder is telling me that he will be giving me only one agreement. Kindly advice me on this. your clarification will be much helpful for me. Kindly help me. Thanks Rona

Hi Dipten, As per my knowledge, Karnataka High Court had directed the BBMP to install processing plants in all the 28 Assembly constituencies in the city to reduce the burden on landfills. Mahi Garg, Please don't believe the builder. Get verified by yourself. Go to the BBMP zone office and ask for plan approval document for the property. If the builder has violated the sanctioned plan, he cannot get an OC - period. He can get a duplicate OC - Beware, Builders are doing that now. Rule of thumb, if SBI is not approving the loan, then the builder has not build as per plan or the builder would be black listed. I would suggest you please buy the property from the reputed builder. The real estate marked has crashed and there are good deals for buyers. Don't listen to real estate developers who say that there are only few apartment vacant. Not possible at all in this scenario.

Hi Bhagi, I would advice you to do your all due diligence before booking the flat. Check all the legal approvals, check whether this projects in registered under state RERA or not, read all the reviews on the multiple websites and then go for it.
