I am planning to buy a property in MGR Nagar, Chennai. The property was allocated by Government to a person named Rama. Rama had signed in Tamil at that time in the allocation document. Rama has then sold it to a person named Easwar. But the agreement document (between Rama and Easwar) has Rama's signature in English. It seems that Rama had left to US to join her sons. She had also signed a affidavit stating her signature in Tamil and a different signature in English. My question is this - Is it safe to purchase this property? EC is clear and has both Rama and Easwar's name. Please let me know your thoughts.

EC is clear and has both Rama and Easwar's name then you need to find out that Easwar is the only owner of the property. This can be done with help of legal expert and visit to sub-registrar office. The rules and regulation circulated by the management committee of Gini Sanskruti society is truly in sense to maintain discipline among the owners and tenants but with one clause. the residents of our society has been issued with vehicle pass for ease of entry and exit for security reason. at the same time it is stated that all the vehicles need to be registered at the entrance after 11 PM irrespective of having vehicle pass.
it is contradicting one to other. if the vehicle pass is issued for identification then there is no need to register the vehicular to register his/her entry at any given time.
it is imperative to register all the vehicles who does not have society pass.
rather it is the responsibility of the watch man to make a note /register the vehicle no. and entry/exit time at the main gate, not the owner.
it a harassment to the owner who are entering in their own society as a outsider. If this rule have some specific reason pl let me know.

They have good business in south India and I suggest delay in project is not a big issue in real estate sector as all reputed dealer delays or extends the project completion date two years than promised time. Ensure that you have funding for your renovation and you have permission from your property manager or apartment owners association for renovating your home. For small makeover such as furniture re-arrangement, changing carpert or curtains etc need no permission but if you are opting for some construction such as changing flooring or changing wall color etc need permission from association or RWA.

There are two basic types of carpool one is where Poolers use one car owned by one driver and another Poolers can rotate car use and driving so that each person’s vehicle and driving time are shared equally. Recently there was a change in plan and I dont know many of you guys aware of it. The pillar will run through the centre of the hall and to cover that mistake they changed the plan.The terrace apartments are charged with Rs.200/SQFT excess but they ruined the whole plan by shifting the kitchen to hall and changing the kitchen as bedroom. Why would one need a terrace for a kitchen and also the water duct for kitchen will run through the terrace which will look so ugly and occupy terrace space. myself and friends feel that we did a lifetime miskate by booking an apartment here. The customer service is the worst I have ever seen and no access to senior management so that they can hide the mistakes.
Not sure whether GEM Groove management is aware of these issues.

If the project is not as per what they have discussed earlier or if you feel that after changes they made in plan, the project is not matching your style or requirement. Sure you should talk to legal expert regarding opt-out option from the project. I am sure there will be a small loss as they will deduct your amount but it better to suffer small loss than living in home which always makes us feel uncomfortable. Nowadays if builder says Dec 2012, property buyers must prepare for extend period of six months to one year. But for time being we can expect project to be delivered on Dec 2012. @Bhat: For getting property tax asessed you must have your property details. You can visit your BBMP Citizens’ service center or visit registration office and find out your property id by giving your property details such as ward it belongs to, property number & when or where registered etc. These will help officials to give your property id number. Once you get Property id number, you can easily know how much tax has been paid till now and what is outstanding. Thank you

My wife wants to gift me 50% the property(land) which she owns and we jointly took a home loan to construct the house . I could not take tax benefit on the interest portion of the loan as I am neither the owner nor the co-owner of the house.That why gifting the property is one of the solutions for this.1. Just needed to know approx how much total time it takes if I pursue for the stamp duty and registration in case of gift deed ?2. Original documents of the property are residing with bank. If your wife gifts you half of the property, then you can register with both as co-owners for the property. Today I ran into the most unprofessional staff at Adarsh Palm Retreat's marketing office. They first keep you waiting for a long time...while addressing others who come in later. Secondly they do not care to listen what the customers asking for. They try to ignore you OR get away from you as soon as possible. God save customers from Adarsh Palm Retreat's marketing office folks. I wish that the management / owner at Adarsh reads this and takes some disciplinary action against the marketing office team members.

The statement "the club house will be commercially exploited " is not a legal term and club house renting out is not an exploitation unless it cause a nuisance for residents or the facility is restricted to owners. It would be wise if he decide in a will that, after his death, the property should move to his wife and she can decide whether to keep it or divide them among the children. If the property owner is dead and there is no will made, legally all inheritance has equal right on the property. Thus, the property will be either divided into four or if everyone agrees, they can sell the property and divide the amount.
