There is only so many reason why builder is not ready to sign the agreement. Either they didn't get the IOD, Deviation in floor plan, NOC from the concerned dept. etc. Do you have booking receipt? If yes, then consult a good property lawyer,

Hello Laxmi, It is come to heard that the builder is offering a 36 months installment plan. Rates are much better than other projects in the area. When i approach a local broker they told me that even they are looking for flat in it seeing the current rate.

Hi guys, Good news for all the home buyers. As per the current news, the Parliamentary Select Committee for the Real Estate (Regulation and Development) Bill 2013 is likely to push for more strict clauses that may lead to imprisonment of builders if they do not fulfill their obligations to home-buyers.
Then it will certainly help a lot to the home buyers because financial penalties alone won't work since private developers will simply factor in the cost of these penalties in their projects and pass it on to home-buyers.

Right Anirudh, The final report of the Select Committee of the Rajya Sabha is still under preparation and will be tabled before the upcoming monsoon session. If it comes then there will a provision for imprisonment of up to 3 years or a fine extending up to 10% of the project cost or a combination of the two, but only in cases where developers repeatedly fail to register their projects with the regulatory authority or do not obey with orders for registration.

In January i read in TOI that Developer Runwal Group had obtained civic permission to commence work on its Mulund property, Runwal Infinity, in 2005. It had purchased a 10-acre plot which belonged to Rallis India. Construction started and skeletons of 5 towers came up before work stalled.

As far as real estate trend of Mira Road is concerned, the average property price in Mira Road is Rs. 7000/sq-ft., maximum property price is Rs. 7500/sq-ft. and minimum property price is Rs 6800/sq-ft. But don't forget that still we have to take permission from the State Forest Department which according to CIDCO is expected to be resolved within 3 weeks. The issue is regarding the handing over of 250 hectares of land by CIDCO to the state forest department. And the process was moving at a snail's pace, as it required the revenue and environment department of the state to work together.

Hi Dwarkesh, I am not an expert but just wanted to guide you. I would say decide between Oberoi and Wadhwa. If you are looking for luxurious apartments, then Oberoi could be the game changer and their floor plans seem much better than Wadhwa. But before investing visit the site atleast or send you parents for check the ground realty.

Hi, From my personal experience, if you are looking for Realty with Reliability, Runwal is the name I can suggest. Lodha is a big brand, yet it makes the consumer experience on rolling funds from 1 large project to another and results in delay of multiple projects. Whereas Runwal Project are much deadline oriented. Loading in Lodha is too high in comparison. I guess they are trying to cover the entire cost of marketing from their projects. It is also said he has great political connections means even if we try to fight against Lodha for some or the other reason, consumers are going to have tough time.. So I suggest its better to be safe than sorry, Runwal is better option.
I think Lalit is right. All that glitters are not gold. Because delay in project become the fashion for the developer. They roll the funds only and will say that there is delay in approval process. But the ground realty is something different. Suppose, a project get delay by 2 years and in between those 2 years, property price in the locality get increase. In that case if you insist the builder for the possession, their clear cut answer will be cancel the deal so that they can sell the same property to the another buyer at a higher rate.

"Thoda Khaye But Achcha Khaye" .....Sarkar ko ish trah sochna chaiye If we look at the list of cities which have been selected as smart city, many of them would already have annual municipal budgets running into multiple times of this figure. On the other hand, there are few states which have shown doubt for implementing the scheme and if there is not enough support from them in terms of funding and administrative help, it would be difficult to take this scheme to its reasonable result.

Hi Dev, Asangaon is a locality in Thane district that lies on the Mumbai-Nashik Expressway. The area is 70 km from Mumbai through the expressway and is still under development. At present, the locality offers 1/2BHK units within Rs 20-30 lakh. These are available within a size range of 450-1200 sq-ft. You can also find a few options of 1BHK units in a budget of Rs 10-15 lakh.

Q: Hi, I have bought a flat in Navi Mumbai and I have not received the Occupation certificate. The building which was constructed come under the Coastal regulation Zone. What are the implications of it ? The building was constructed in the year 2010. Would we ever get a OC. What can we do now?

CRZ rules are the bane of builders, who tend to find construction potential in every square foot of the city regardless of social and environmental costs. Unscrupulous ones try to pretend that CRZ doesnt exist by building on land that should be free of construction.
I am telling you why the residential development is restricted in CRZ. CRZ area means- water area up to 12 nautical miles in the sea and the entire water area of a tidal water body such as creek, river. Clearance shall be given for any activity within the Coastal Regulation Zone only if it requires water front and foreshore facilities. The following activities will require environmental clearance from the Ministry of Environment and Forests, Government of India. Residential buildings, office buildings, hospital complexes, workshops shall not come within the definition of operational requirements except in very special cases and hence shall not normally be permitted in the CRZ.

@Shreya, If acquisition of properties are bit compact for the developers, benefits are bound come to the buyers. Thus, it gives us a clear view that, if a developer is granted with a reduced cost for acquiring land, the price of the projects will automatically come down. Some of the major issues that are currently following the Indian real estate sector, realty experts zeroed on five major things that will help reduce property costs to a large extent. These are :- 1) Reducing Multiple Taxes, 2) Involve Stakeholders while deciding Guidance Value, 3) Stable tax regime, 4) Proper Regulatory Policy Framework and 5) Lowering Land Acquisition Cost.
You are absolutely right Shaunak, It is obvious that, when the developers are enforced to pay huge amount of taxes, the pressure indirectly comes to the consumers. Presently, there are multiple taxes, both direct and indirect, that home buyers need to pay to the government. In order to bring down property costs, a major initiative by the government by way of either reducing or doing away with certain taxes will be the right step forward.

Similarly, guidance value are increased randomly without any agreement from the industry stakeholders. And this increase directly results in higher property cost. Due to increase in guidance values, few properties in Taloja, Navi Mumbai were selling at a price of Rs 4350/sq-ft. Looking at the infrastructure of the place, these values are not at all justified. Thus, government should form a panel involving all the stakeholders in order to arrive at a right guidance value.
It is not just the guidance value and the land acquisition, rather the discrepancies existing between various states in terms of stamp duty and registration too. It is important to have a stable low tax regime, particularly in the area of service taxes and in terms of registration and stamp duty. For instance; Tamil Nadu, today has almost a rate of 8% for registration and stamp duty, which is relatively higher and shores up as a serious deterrent for catalysing home demand.

Yes, Majority of the clearances required for the project have been received. As a part of the smart city mission of the Centre, the state government wanted to develop 30 towns, focusing on "themes" such as education, medical, entertainment, industry, etc.

Hello Shalini, Yes, there are some major challenges in approval system. 1) As part of the Intimation of Disapproval conditions, developers are needed to meet about 40 approvals from various departments like Tree Authority, Storm Water and Drain Department, Sewerage Department, Hydraulic Department, Environment Department, Approval from Pollution Control Board, Ancient Monument Approval, Airports Authority of India, Traffic and Coordination Department, fire clearance etc. Meeting all the conditions is mandatory to commence construction. However, timeframes are never observed by the authorities in these departments.

Hi Dev, Even i am planning to book a 2BHK of this project and had a word with the sale executive. He told me that the possession date will be December'2016. The locality of Andheri east comes under BMC and all the necessary approvals are in place and they are ready to show at booking time. HDFC and Indiabulls are offering loan for this project.

Hi Pradyuman. I was born and grow up in Mumbai and working in a transport company. Because of that i have to visit several parts of the MMR. The demand of rental property in Mira Road is due many factors. It is considered to be an affordable destination. Situated in north western region and part of Mira Bhayandar, Mira Road is very well connected to the key business hubs of BKC and SEEPZ via the western express highway (WEH). Hello Roshini ji, The minimum cost of a 1BHK flat will be Rs. 41 lacs excluding. Construction work on Elmore has been finished up-to 36-40% so you have to pay Rs. 2 lakhs at the time of booking and within 45 days 35-40% of the agreement and the rest of the amount equivalent to 60% based on bank loan and your payment schedule. They have all the necessary approvals like IOD and Commencement Certificate and the construction work is in full pace.

That is why the fence-sitters are watching the market's movements eagerly. Their guess is that prices could go down further in the next few months which in turn has increased their hopes of landing a better deal for their money and delaying their purchase.

Hey Vasanth, The reduction in apartment sizes has also brought down the price tags of these houses by close to 15 to 20% but without any change in the per square feet rate. Now, the buyers have understand their tricks and they will not come in their trap. Builders have to search for the other options.

Foe example, if you are availing an interest-only EMI on a 15-year for Rs 30-lakh loan should work out to around Rs 24000. On a normal home loan, it would be Rs 31326, including the principal component. Hi Saras and Dev, But at the same time, bank will obtain an authorization from the borrower to raise the EMI if there is an increase in interest rates. This will also ensure that their principal liability will not increase in future.
Hi Akhilesh, Yes, this is a normal process of bank and everyone has to go through this process. Flexipay home loan would benefit those whose salary does not allow them to the size of loan they are seeking. It would also not benefit those who seek to refinance their existing loan.

The upper age limit for this scheme is 45 years. Given the target group, the bank offers loans with a repayment tenure of 25-30 yrs under the scheme.

Q: Wanted to know if the NOC from CIDCO is required for transfer of housing society membership for re-sale flat. The flat is in a building constructed on plot based on tri-party agreement. The price of flat has been fully paid up to the seller, without any loan, and agreement duly registered. To give a brief history. after the OC from CIDCO, and after Housing society was formed, just when builder in process of providing conveyance, which he eventually did, one fine day a letter from a lawyer was given at the gate. It mentioned that the set of heir's of original plot owner had put up a court case against Builder, CIDCO and another set of hier's. Former set of heir's were claiming that latter set had shared the compensation with them. We, the members of housing society, consulted a lawyer, who told use this is not unusual in this region, we should not worry, as the case has not been filed against us, unless there is direct notice to us. But now after few 3-4 years, when resale of flat went ahead, now the present Housing society committee are denying to transfer membership to the new owners, after CIDCO has not provide NOC. So is NOC CIDCO required for resale of flat not built by CIDCO, and when there is no home loan involved ?. And a housing society deny transfer of membership to the new owner with CIDCO NOC ?

In short, i want to explain that if you buy any property in Navi Mumbai,you are liable to pay transfer charges to CIDCO.,when you buy from the builder as a first purchaser,you are not liable for transfer charges. Last year, it is seen that the investment arm of IDFC and IDFC Alternatives signed an asset management and development partnership with real estate firm Sare Homes. In this stage they will develop projects where IDFC will invest with them. Where they will invest in projects of other reputed developers, PE Investors will monitor their investment and manage the asset.

Hi Imtiyaz, Owning or occupying the terrace of a housing society building is unfair and illegal. The builder/developer has no right to sell the terrace. Some developers of co-operative housing societies resort to the unfair practice of selling the rooftop / terrace. People those who have invested their hard earned money in their project are still waiting for the possession. AS of now, they have not get approval from CIDCO. Q: I bought a house which was transfered to me by previous owner and now it seems i do not have the registration paper for that document. It was not given to me by previous owner and also the stamp duty was paid less as the previous owner had paid less stamp duty. The property i own is a Mahada property of full ownership. Please let me know how can i get my rooms registration and pay correct stamp duty. Now i have come to know that the previous owner of my room is dead, so still can i do the registration of my room.

Hi Manzur, Legally, there is no such rule to disallow bachelor in the flat but yes, some societies make rule for the safety of their residents and specially in those societies where maximum families are residing.
I agree with you Sandeep. Some societies disallow bachelor because they thought they may create some nuisance at night, can play loud music and may involve in some illegal activities. Societies can make these rules in their by-laws if all the owners agree to it. But if such rules are not included in the by-laws, there cannot be any restrictions. But in most societies the by-laws don't directly dictate such terms but are indirectly implied in which case, you can stay there if the landlord doesn't object to it and if you are not in violation of any rule

Hi, Check your sale/ allotment agreement on the clause pertaining to cancellation of the booking. It will be as per the agreement. Some agreements have clauses such as; "that after the buyer terminates the contract to buy the apartment if the developer does not commence project construction within a year of allotment letter, the builder will refund the amounts paid by the buyer with simple interest of 6% per annum". So please be aware of your rights as per the agreement. I have mentioned both condition here. Hi Aishwarya!! Cancellation can actually be a tedious process. The fact is that the real estate sector is not known for its transparency. It doesn't follow best practices in its dealings, in reporting results and, certainly not when it comes to giving refunds. they discourage cancellations, but if buyers insist, they refund the money after deducting 10-15% of the total value of the apartment. What is worrying for buyers is that there is no norm that the builders are required to follow while cancelling bookings. So, i would suggest you to stay invested for some time and see the progress of the construction work.
Yes, i am agree with Kishore. There is no guideline for refunds and most developers insist that once you have signed the sale agreement, you are legally bound to follow it. No surprise then that sale agreements vary from builder to builder and always favor them when it comes to cancellations. Check your sale agreement, it is clearly mentioned on it " A request for cancellation can be made at any time after allotment. It may, however, be noted that the earnest money (10% of the total consideration) will be forfeited, as the same is non-refundable". Decision is your now. Whether you want to go with it or want to cancel.

Runwal Forest/ Runwal Greens/ Runwal Anthurium all at delayed projects. Runwal Anthurium is 8 years old launch. They left Runwal Infinity in between. The group has very bad execution history. Check brickwork and plumbing at Runwal Greens site before booking. There is seepage at Orchard Residency. In Runwal Greens and Anthurium the owners are already having dispute with builder. Thanks for the information Dev... How is the locality of Kanjurmarg and its connectivity to the other parts of the city like Thane and Jalna? Which is the nearby railway station to this locality? How is the social and physical development in the locality?
Well Pradyuman, Kanjur Marg is a suburb in east central Mumbai. Kanju Marg Railway Station is the main access point for IIT Bombay, KV Powai, NITIE, Hiranandani Gardens and other locations in Powai. It is a fast developing locality in Mumbai. Much of the development may be attributed to the suburb's strategic location and its proximity to Powai, the IIT and easy access to the IT hubs of Seepz, Vikhroli IT parks and the IT campuses of Airoli and Mahape. Kanjur Marg is also the starting point for the JVLR which connects the Eastern and Western Express Highway. There are many reputed schools and educational institutions nearby. Health care facilities are also good in the locality.

Though I have not cancelled the units neither I have applied for it. Can someone genuinely share the reason for such a long delay ...... It is hard to find residential property in Mumbai and there is no easy way to find it in a day. You have to do a lot of homework. Then you may be confused between buying an independent house or an apartment. Bandra:- If you are foody then this is the best place where you can look for. You will variety of eating outlets near it. And if you are shopaholic then varieties of shopping malls nearby Hill Road and Linking road. Q: Dear consumer, do not be fool by investing in this fraud group. I had made this mistake and after three years, I am just running between there branch and bank and neither plot is in my hand nor my money. During investment, they welcomed me and now they are ignoring me and not taking seriously. I am suffering since my life time saving is invested in this fraud group and now they are not returning money. I had booked a plot (Plot No. 96) at a project Prestige - III of Vatsalya Builders And Developers Pvt. Ltd. situated at Rau-Indore. After 3 years, no development has been observed at site neither project is in status of possession and still it was in stage I had seen during booking time. I had taken continuously follow up from them and every time they had cheated me by giving fake assurance of possession. Finally I had decided to withdraw money from this project and they had given me cheques after long time and all cheques were bounced and now they are saying we are not having money. So its my advice, do not come under influence of there marketing team. They will welcome you and take off your money and after that they will forget of you and your money.

Hi Vinay, Why are you not filing a case in the consumer redressal forum. You can also file an FIR in your nearby police station for fraud case. And ask for the compensation along with the interest from the time of possession date. Better, if you are filing complain in group, you will get immediate action on it.
Yes, i am agree with Gautam. If possession is not delivered on time, a purchaser can send a notice to the builder first, claiming refund of the amounts paid along with interest and/or damages. The buyer can also file a consumer complaint for ‘deficiency in service’ as defined under the Consumer Protection Act, 1986 against the builder.

As per the news, IFC and the Asian Development Bank will together hold 70% stake in the joint venture, while the rest will be with Shapoorji Pallonji Group. The company has launched its first project in Howrah, Kolkata. And now they are coming up with their second project called "Joyville" on the outskirts of Mumbai in Virar.
