Rate of Stamp duty on development Agreement increased from 1% to 3.5% and on transfer of immovable property as capital contribution by the partner introduced at 3.5% from existing Rs. 10K. 2. According to the recent judgment of Hon. Supreme Court, certain transactions of the developer and civil contractor become taxable as works contract. There is already a provision in the Gujarat Value Added Tax Act, 2003 to levy lump sum tax at the rate of 0.6% for such works contracts. But in absence of legal clarity, some contractors have not paid the tax. Now, since there is full clarity, in order that such contractors be able to make the payment of tax retrospectively, the State Government has decided to announce a scheme for this purpose. Under the scheme, if the registered as well as the unregistered dealers engaged only in civil works contract, makes the payment of due tax retrospectively at the rate of 0.6% for the past years.HI all, H1. Q: Scheduled completion is March-2014 as per my discussion with Swagat Official. But payment plan of 30 months suggest completion suggest October-2014. What is going on....

Hi Jack, In my point of view, this project is vey much suitable for IT people. This project is located to GIFT City i.e IT Hub. Lots of educational institutions like NIFT, DAIICT, NID, IHM, St. Xavier's School, Deen Dayal University, etc, are situated in this prime location. It is near to Vidhan Sabha, Sachivalaya, Akshardham, Swaminarayan Temple, and just 20 minutes drive to Airport.

Hello Sanchita, Now the time to wait and watch, a parliamentary panel has asked the union ministry of housing and urban poverty alleviation to bring the bill soon to the parliament for its passage.
May be......the existing version of the bill provides for setting up state-level housing regulatory authorities and tribunals, and includes all residential and commercial projects over a certain area under its limit.

It is always better that you hire an attorney if you’re either gifting or selling the property. Quit claim deed is also signed in order to transfer any ownership interest of the owner without making any promises regarding the properties interest. The ONGC office already had its own colony loaded with all novel facilities, its own Kendriya Vidyalaya school, club, dispensary and even a stadium. Hi All, In Ahmedabad stamp duty is charged at 4.9% and registration charges 1% of the market price of the property or the transaction value, whichever is higher. Currently female property owners are exempt from the registration fees of 1%. This offer of registration fees for females is aimed at empowering women and motivating families to register properties in the name of female family members.
Yes Chanda, And apart from these charges, an additional service tax of 3.50% also has to be paid for under construction properties worth less than Rs.1 crore and 4.2% for properties worth more than Rs.1 crore.

Hey Guys, As per the recent news Reliance Capital has received 5 laks square feet of space in Gujarat International Finance Tec-City (GIFT) in the International Finance Service Centre (IFSC), Special Economic Zone. It is heard that the company will base its Global Alternate Investment Funds, its commodity exchange and other international business in this location.

Q: I purchased a 2BHK apartment in Meadows Shantigram by Adani in Ahmedabad at the rate of Rs.2,650/ sq ft and if I exit now, I am losing money. Hi Vikash, I am not very sure as to when you entered this project.We are assuming that you have entered into this project say 2 years ago, then it will be good to exit at loss and invest in other projects at better locations. The problem with this project is its location, which is perceived very far from the city. Thus, it will take about 2-4 years to appreciate. Hi jyothi, The state government is working on a new policy under which it will give incentives for redevelopment of old housing colonies built by Gujarat Housing Board, Slum Clearance Board; and civic bodies such as Ahmedabad Municipal Corporation (AMC) and Ahmedabad Urban Development Authority (AUDA).
@ Jyothi, Government plans to come up with a policy for redevelopment of old, dilapidated housing colonies under Public Private Partnership (PPP). The aim is to increase the availability of low-cost housing for lower and middle income groups, said sources in the state government. Hi Vikash, As per my knowledge, Ambawadi & Navrangpura are nice locations & fully developed also. Even as of now some infrastructure development is happening. Both locations are prime residential decent location. From connectivity point of view, both locations are well connected with other parts of the city by city transport , bus, train & railway. Rental appreciation is very good & high in these above said localities.
Hi Vikash, As per my knowledge, Ambawadi is an old developed residential area which makes demand for rented apartments from the professionals working in the IT companies situated in and around the locality. Hi Guys, According to me, cities of Gujarat are growing at the fastest pace ever and have seen urbanization transform the perception of the cities from a mere trading city to an emerging global metropolis. People come here for jobs and to earn a livelihood. This increasing population has impacted the society as well. In any given developing economy, people move into an area and infrastructure follows. Whereas in Gujarat, the infrastructure has always been better than many of the other Indian cities and migration has only made sure that the developers kept up to the pace of development.
Hi Jack, In my point of view, urbanization has resulted in the makeover of the cities in Gujarat. As a result, Gujarat today stands out as one of the best investment magnet and that is driving the migration and urbanization. Right Devesh, Let them do their duties. UPA has got long years to prove but failed. As per the present provision, anyone buying more than 4 flats in a project is treated as a promoter. Yet, to find a solution to this trend of a few buying more flats and having monopoly in management of affairs, the committee is recommending that all such buyers will get "one voting right" like that of other buyers. But the UPA's statement was very rude in the Parliament.
I agree with you Saurav, They have given long years to prove and we have seen their work. If you are not able to do let them others to do. And it was a very shocking statement given by to AIAMDK and Samajwadi Party have told, as per him Center has no right to make laws on real estate as it is a State matter. Ohh common........ how successfully you both parties are running your State, country knows it....you just don't need to know what real estate want or what NDA has to prove.

According to me it will be a benefit for both buyers and the developers if the govt. has applied that the Builders/Developers should sell only ready to occupy house/apartments. Govt. should ban selling of prelunch / under construction projects..
Right Sir...... It is very difficult to deal with these kind of developers in the current real estate market. But as per the new real estate bill 2015, if wrong declaration of information about the project is found from the builders side then payment of 5% of project cost will be imposed. The Bill provides power to the regulatory authority to cancel their project registration in case of continue violations and decide on further course of action regarding completion of such projects.

But decision is yet to come.....and hoping for the best... Now, housing projects on more than 500 sq-mt would have to register with the proposed real estate regulator as opposed to the threshold at 1000 sq-mt that was fixed earlier. Also, the interest rate payable by the promoter or allottee in case of any default by either would be the same now.
We have nothing to do except waiting Sanchita..... And if failure to do so would lead to a penalty of 10% of the project cost. For subsequent violations, they will be charged another 10% of the project cost or sentenced to a three-year jail term. This decision would really protect buyer interests and encourage investment in the real estate sector.

It is true Bulbul, In this way we will never get our bill passed in the parliament. Next time we have to think more when we caste our valuable vote to these people. They should never come in parliament. At the same time a builder or developer will have to enclose details of its existing projects, details of approvals, land title and payment dues while applying for registration of any project with the authority. The panel define again the carpet area, according to them, the net usable floor area of an apartment, excluding the area covered by the external walls and that under service shafts, exclusive balcony or verandah and open terrace areas, although it would include the area covered by the internal partition walls of the apartment.
Right Sujan.... In the mean while it came to know that Housing Ministry has accepted a proposal of a Parliamentary panel's recommendation on the Real Estate Bill to make the provisions stricter and increase the 50% threshold but not lower it. The Housing and Urban Poverty Alleviation ministry has also accepted all 38 recommendations made by the 21-member Rajya Sabha select committee which submitted its report last week.

Hey guys, We are very close to achieve this amended bill which has several penalties clause for the builders. As per the current news, the Parliamentary Select Committee for the Real Estate (Regulation and Development) Bill 2013 is likely to push for more strict clauses that may lead to imprisonment of builders if they do not fulfill their obligations to home-buyers.
If it is true then it will certainly help a lot to the home buyers because financial penalties alone won't work since private developers will simply factor in the cost of these penalties in their projects and pass it on to home-buyers.

Yes, but the final report of the Select Committee of the Rajya Sabha is still under preparation and will be tabled before the upcoming monsoon session. If it comes then there will a provision for imprisonment of up to 3 years or a fine extending up to 10% of the project cost or a combination of the two, but only in cases where developers repeatedly fail to register their projects with the regulatory authority or do not obey with orders for registration.

I don't think it will come into force soon. The Congress members have also demanded that the regulatory law be made applicable to all realty projects without making any exceptions. The panel has recommended inclusion of smaller sized projects under the limit of the regulatory authority but it has limited it to plots larger than 500 sq-mt or with 8 apartments or more.

And it is a good idea even the plot having 1000 sq-mtr. of area should register with the regulator....and most of the members are in favour of doing away with provision of treating "bulk buyer" as developers since this may put a brake on the investment flow to the real estate sector.

@Devesh, DREAM City was likely to be completed in 3 years. This project had been planned in such a way that establishments of all important sectors like housing, hospitals, hotels, educational institutes, residential and commercial buildings would come up there.

Famous for its diamond trade with different parts of India and overseas, the city is now set to host a smart city in the state of Gujarat. Subsequently, the bank/financial institution will pay 70% of the value at various stages of development following which the customer will pay 10% more. Yes, govt. should support them first. "Jyada Khakar Bimar Hone se Achcha Hai ki Kum Khakar Healthy Rahe"......... Government grants will be leveraged to attract funding from internal and external sources but unless there is a possible business model or guarantee from the centre, this would not be easy. Also, the track record of Public Private Partnership (PPP) projects is at best mixed and when there would be multiple parties involved like the center, states, local bodies and private entities, the task would be even more challenging.

Hi Amelia!!!! But i think that it would be better if the Govt's focus on smaller number of cities first and then developing them as model for others going forward. Under the mission, it will be operated as a centrally sponsored scheme and the center will give financial support to the limit of Rs 48000 crore over 5 yrs, which is on an average Rs 1000 crore per city per year. And an equal amount, on a matching basis, will have to be contributed by the state and urban local bodies.

The result is not just a drop in demand for building materials and create challenges for lenders with big mortgage but also a generalized slow down in GDP growth. It is the only sector which drives 50% of India's capital expenditure and 30% of its jobs break down.

The recently made flyover that connects Vastrapur to IIM has cover way for stress-free commuting. No congestions on this road during peak hours. With an already strong infrastructure, the new constructions are 3-BHK and 4BHK which range from Rs 1800 -2500 square feet and Rs 2800 to 4700 square feet respectively. 3 BHK are being built numerously due to the demand of luxurious yet flexible houses.
Thank you for your valuable inputs but I would like to tell that if anyone looking for investment purpose carrying a high real estate value, Vastrapur is not only an eye-catching area for Amdavadis, but non Gujaratis too. People from the interior areas also are looking for a house in this area for a new buy.

Yes, Last year too was not good for the real estate sector. It seems to me that property market is going through correction phase. This difficult situation will continue all through 2015, perhaps even longer. There has been a effortless response to purchase of properties. Actual buying is too low.
Right Rubiya, Maharashtra Govt. has generated Rs. 6000 crore to Rs. 8000 crore revenue in a year but the current data shows Rs. 4000 core and below. The property market is so down that big developers too are facing the issue. Some have already started cutting their additional expenditure to survive in the current mutable market.

Hi Manilal, It is a long pending demand of the industry. On national level Minister M Venkaiah Naidu is working with 6 ministers and he has a group of ministers meeting. He has held 4 rounds of meetings with secretaries and ministers of environment, defence, civil supplies, civil aviation and others for that.
Yes Bikram, The govt. seem very active now on it and the last meeting is on October 14 after that they will submit the report to Cabinet and then they will go ahead because they are getting permissions from these departments and by the beginning of the next year, and i am sure they will have this in place.

It is come to know that the first proposal was received from the Rajasthan government, which has proposed a total investment of Rs 6457 crore over the next 5 yrs. for developing Ajmer, Jaipur, Kota and Udaipur as smart cities.
In Ajmer, retrofitting will be taken up over an area of 1334 acres in north and west parts of Anna Sagar Lake to promote infrastructure, green building and safety and security at a cost of Rs 925 crore. Pan City Solutions for improving urban mobility and traffic & transportation management and city -governance will be taken up at a cost of Rs 375 crore.

This is due to buyer's carelessness. When they invest huge money in any of the project, they should check all the legal approvals and searched for the builders track record. But we simply heard about the project and the locality we go for negotiations and make a deal. We forget that if a builder is negotiating with the price it means there is something fishy, specially when the locality and its infrastructure is good.This is due to buyer's carelessness. Never go for a pre-launch project because builder invest the money in their stalled project raised from the pre-lauch booking and buyers of the pre-launch project has to wait for the their properties. They never deliver the project on time. They do such business fearlessly and it is not possible without the help of a govt. authority and the politician.
You are right sir. As per analyst, lack of necessary regulations and transparency as the main cause of the problems faced by the real estate sector. Unlike other financial institutions, anybody can start a realty firm. There needs to be some parameters. If you are one of those stuck in a delayed project, move to a consumer court or ask for appreciated valuation (if it has) of your property.

It is illegal and you don't need to pay any scanning charges. If builder is forcing you to pay then challenge him in the court. Builder is charging unnecessary charges because Ahmedabad Municipal Corporation has asked the developer to pay "Betterment Charges" which he want to recover from the buyers.It is illegal and you don't need to pay any scanning charges. Builder is charging unnecessary charges because Ahmedabad Municipal Corporation has asked the developer to pay "Betterment Charges" which he want to recover from the buyers.

So, the total stamp duty is 3.5% + 1.4% = 4.9% (i.e. Rs.4.90 for every Rs.100 of sale consideration or part thereof. Q: The entire real estate market of India seems to be notorious due to the lack of transparency. Buyers, most of the times, find themselves locked in the property that has several defects or end up paying charges which they should not be liable to pay. It is even worse when the buyer is just forced to shell out money to fund fines that are actually levied on the builders.

Ye Priya.....the investors, who have been duped by unscrupulous builders, cannot be left high and dry. Any builder or developer who dupes by motivating, attractive, painting false pictures, selling and diverting the offers and then arm-twist the investors, has to face tough legal actions now.
It is also seen that the builders often attract investors into depositing the amount in cash only to escape from tax liabilities and once the investors fall into the trap to such a situation, they are then silenced through the fear of prosecution by tax authorities.
