Q: Is "Amarpali projects" at Sector-76, Noida safe? Is there any dispute between farmers and Noida Authority ? As I came to know that farmers have given only three months time to authority to solve the problem, till than they will not do agitation. Has any Writ Petition also filed by Noida's farmers (Sector-76) for compensation ? On receipt of demand letter from builder, should I pay the amount or not ?

Hi Pranab & Shenoy, It means "Achche Din Aane Wale Hai". Modi Govt is really doing a great job for this country. Currently, there are many builders who have to be controlled in and the current disciplinary action measures may not work as a sufficient defensive. So, the main objectives of the committee is to see how best they can protect the interests of helpless consumers from the high-handedness of powerful, unethical builders.
Yes, if there will be any important change from the original schedule, specifications or structural design in what is finally delivered to home-buyers is considered as a breach of obligation by the builder.

Hmmm Mukesh this was a long time back demand by home buyers like in January of this year they started the movement. The demand has been made by a homebuyers’ group, Noida Extension Flat Owners and Members Association (NEFOMA).They demanded for proper rules and regulation as there was absence of a proper regulatory mechanism in the real estate sector!

yes Dhananjay...the future is still quite uncertain. The high court has ordered the authority to give back the land to farmers in 2 months time whereas the builders have asked investors to file and appeal in the same time frame....
well more than 1700 farmers of the 12 villages tof patwari wants their land back. they say that the construction work has bought down the soil quality also but they still want their land back...

Q: There are concerns on Crossing republik being 3 sided sorrounded with Dumping ground ( court case in Supreme court), Sewage treatment plant beside golf course and a Crabon polluting factory across the nh24. these three sorroundings are giving a big hit to its future pollution , hygeine and locality. Also its appreciation came on a snail pace after noida extension got a clearance in High court . So Noida extension picked up slowing it down. Indrapuram is hotter place but with lesser planned infra but more accessible. I still feel in future dumping ground and sewage plants can raise a big question on price appreciation and may even depreciate a bit. Its my opnion but yes socitey is too good in its infra and connectivity no doubt. Hope that pulia connecting noida extension and crossing republik gets widend soon!! So please advise what can we expect prospects of Crossing republic down the line 2 years in cost appreciation and 5 years.

well Akshay, you are right about the dumping plant and other problems in crossing republic, but the construction here is done and many are opting for this place. If you invest here now, you get ready to move in property and no apprehensions like noida extension property- whether it will be completed or not. Another point is the widening of NH24 and once that too is done the place will appreciate on the lines of indirapuram as in a range of Rs 5500- 6000+ per sq ft infact more so as crossing republic is better planned and easily accessible.
Hello, on a purely investment perspective i will say that crossings republic is better... the property is ready to move in so you can give it up for rents... and even if you have taken a loan and have to pay for es Rs 20 000 as EMI, you can get almost half of it as rental i.e around Rs 10 000.. so in that sense, investing in crossings is better now. Although greater noida west is not bad but properties are under construction and so it will take another 3-5 years for the property to give you returns.

yea the group it seems has permssion only to build 11 towers of 11 storied , but they planned a twin tower of 40 storeys and the RWA moved the court as the is new building will hamper light and air in the other towers...

@Geeta, yeah even i heard so and asked about that to the Hyde park representative. he told that there is nothing there and the Mahagun project is the neighboring project and there are shops, parks and schools in the vicinity...

Well Sashiti, recenlty buyers of PAN Oasis towers in sector 70 protested to the fact that the 3 builders of these towers are delaying construction and has used bad quality materials in construction...
Hmmm.. but the company maintains that the construction quality is good and the delay is because national green tribunal has refused to give completion certificate to the building near the okhla sanctuary.. also noida authority has not given completion completion certificate and towers are in final stage sif completion according to them..

Well Vikram, there are options of 1 bhk and 2 bhks available. i had enquired for 2 bhk and that is 900 sqft and will cost approximately Rs 35- 40 Lakhs. This project has 5 floors and as you move up each floor the price will be less by approx Rs 50,000.

Well Mr Chandra, this is not under construction. this project is in the soft launch phase and is expected to be launched by 2nd week of July... construction work will start in august and possession can be in 3 years after the construction starts....

Homes in areas with low absorption rate are less costly, but are suitable only for long term investors, who have a time frame of at least 5-10 years. You should invest in such properties only if you are an end user with no plans to dispose the property.

Good morning friends!!!!! And if i am not wrong, it will take at least 40-45 months to find buyers for unsold inventories in Mumbai. The unsold inventory is between 8-12 months in an efficient market.
@Shivshankar, But still there is demand for homes at the right price. Developers are getting land at cheaper prices than a few months ago, deals are being stuck at lower prices. So, builders have to negotiate a little bit which in turn will allow to cut selling prices adding to the price correction.

Q: As per new bylaws of Noida Authority in 2015, delay in construction on plot will result in 4%, 5%, 6%..... 13% penalty from 3'rd to 10'th year of registry/allotment. In case i construct after 3 years, whether i will have to pay 4%+5%+6% = 15% or only 5% penalty to Authority ??

Right Sanjeev..... Those who have been allotted land by the Noida Authority for residential plots but have failed to start construction within the stipulated period of 2 yrs or according to the number of years mentioned in the lease deed, now will have to pay lighter penalty. The penalty was charged at the rate of 4% of the allotment rate in the 3rd year, 5% 4th year and 6% in the 5th year.
Noida Authority officials have been asked to conduct a inspections across the city to identify the allottees who have failed to construct on their plots within the stipulated time period. If no reasonable reasons are recorded with the Authority for delay in construction, these residential plots will also face lease deed cancellations.

Investor and buyers hard earned money in danger, they have to pay huge EMI and rent for the existing flat. I think we should also raise the issue and ask for the compensation for EMI amount and the rent which we are paying since the said possession date.

Q: I work as an executive at a manufacturing company of auto parts in Okhla, born and brought up in UP through out. I used to live with wife and my kids at East Delhi and my parents and all live in home town Kanpur. For investment purpose in 2011, I bought some property in Gaur City a project from Gaursons. Everything was going fine till 2015 the time I got to move to Ludhiana as I got promotion and transfer to Ludhiana. So I decided to cancel my booking at Gaur City. And I cancelled my property in august 2015. Also it has been 4 years since I have paid all installments on time. I mailed my details and concern to gaurson’s team and to get my refund ASAP. I was panicked to hear the response from them “what so ever money you have given to us , we have invested that same in construction , we can’t get money out from construction . We will refundyou once the flat allotted to you is sold to someone else.” It got afraid as I was going to move to Ludhiana and they were saying that they will refund it after myflat gets sold. Also it would be difficult for me to follow up for my money from Ludhiana. Also I was worried about my investment made as it was all I have earned from my hard work and If something wrong happened or I got cheated then I would left with nothing for me and my family. I went to gaursons office. And meet with concerned persons discussed my issue with them. They assure me that there won’t be any such issue. They assisted me every way possible but still I was quite nervous and was doubtful about my refund. Finally in March2016 I got my refund. It took 6 -8months get it done but still I am thankful to the cooperation by gaursons team that I got my hard earned money hassle-free refund in a year. Entire market is struggling due to slow down in the real estate industry. Lots of buyers are crying for their money refund after cancellation or facing lots of issues from builders. And in such condition gaursons cooperation left a good experience for me. And additional thing is patience is very crucial in such cases as builder is also quite right at their perspective that whatever money they got from buyers they invest that in construction work so it is tough for a builder to refund the amount instantly and moreover any builder doesn’t want their buyers to cancel the booking of property.

Hi Sai, After consulting couple of brokers of the locality, i am getting final offer of 3650/sq-ft.for a 3BHK flat in1340 sq-ft in sub vention plan in Phase-2. I tried to get information about this builder from outside but i am not sure why it is not much known outside ! Do you have any idea ? Also if you could guide me about the documents which i need to look into of the builder to be very sure on the safer side, it would be helpful for me.
Hi Rehan, As far as builder is concerned, Exotica Housing is a decent builder and has good past performing projects in IP with the name of Exotica East Square and Exotica Elegance. I think this builder does not have too much of advertising budget i guess, hence is not a very well known name and does not even have multiple projects running so has limited but i would say good presence in the market. Documents to be asked:- IOD, Commencement Certificate, sale deed, change of land use certificate, NOC from fire fighting dept., environmental clearance, check terms of allotment letter, check terms of builder-buyer agreement, mother deed, approved building plan etc.

Yes, their commitments of assured return cheques are repeatedly getting bounced for last few months, due to insufficient fund. They are unable to clear/payback & honor these bounced cheques in spite their repeated promises. Company is not even in a condition to pay the small amount of Rs.60000 for last 4 to 5 months.

Hi Pradeep!! Any updates on Amrapali Dream Valley-2, Tech Zone IV, Greater Noida? When are they giving possession of this project? It seems to me never ending process. Their 3 years are not coming i think time has stopped for them otherwise, they don't promise to their buyers to deliver the flats in 3 yrs.
Hello Kajal, But in April 2016, Amrapali CMD, Anil Sharma promised to their buyers that they will deliver all the towers by 2019 when ABP news took an effort to make customers meet the builder with whom they had complaints

Hi Rahul, Even, i have booked a 3 BHK flat in Amrapali Crystal Homes, 2 years back and till now construction has not started. They have no funds for construction and they making people fool. Stay away from this builder and don't don't invest any of their projects. All their projects are delayed by 3-5 yrs. Nobody picks up your call when you go to their office. No one is there to meet you. Q: Hi, I had purchased a flat in 2013 in Noida sector 75. UP and builder is giving the possession now i.e. 2 years delay. due to the halt in construction i also delayed in paying the builder, so now at the time of possession builder has charged interest 18 p.a. and giving 5 rs p.sq.ft as penalty (which are as per the BBA). I tried to persuade the builder to waive off the interest which he has charged but all efforts went in vain. Builder has also applied for the OC with Noida authority on 9-Oct-2016 and RERA in UP was notified on 27-Oct-16. Now with the RERA in place in UP, i see that the builder and project is registered on UP rera website, but i am not sure if the builder comes under the RERA act, Which if applied should compel the builder to compensate me on the same rate of interest which he is charging me. Could you pleae help to identify if the builder is under the RERA? and if i should go ahead and take the action against the builder and register the complaint against him on the UP RERA website.

As per your agreement when was the possession date? If builder will have given you delay possession then you can file a case against the builder for delay possession and ask for the compensation. And secondly, if builder has not register its project with RERA then the entire project will considered as illegal and builder has to pay a hefty amount the Noida Authority as penalty.As per your agreement when was the possession date? Hi Ashish, Vihaan Golf Way by Vihaa Group is an under construction project. It is offering 1, 2 and 3 BHK residential flats. Sizes are available from 425 - 554 sq.ft in 1BHK, 2BHK from 815 - 990 sq.ft and 3BHK from 1196 - 1624 sq.ft. Its current rate per square foot is Rs.2500. As per developer, its possession date is January 2019.
Hi Ashish, What is the possession date mentioned in your agreement? If the builder has missed the deadline, you can file a case with UP RERA. Aware them about your project status and possession date. If said possession date is December 17 or January 18, then you have to wait for few months so that your case will be more stronger. There is no need of booking cancellation or asking for the refund. Builders are already in great difficulties after implementation of RERA. So just wait and watch for this month at least.

At the same time i found that this prime project is in prime location ector-150 Noida as all the daily basic necessities are nearby.
