Q: Hello, I purchased new flat (under construction flat) in Bangalore in June 2011. Basic cost of my flat is 30Lakcs. And 1.5 Lacks for Car Parking. Total basic cost is 31.5 Lacks. My Builder charged me 5% of VAT on 31.5 Lacks (Basic Cost of Flat + Car Parking Amount). My Builder also charged me 2.7% of Service Tax on 31.5 Lacks (Basic Cost of Flat + Car Parking Amount). Do I need pay both VAT and Service Tax to my builder? Do I need to pay VAT? If yes, as per Govt. norms how VAT I need to pay to my builder? @ Suresh, buying property having deviation can create problem in future such as: it impossible to avail Home Loan on properties with major deviation and more than 5% deviation against approved layout plan will not get Occupancy Certificate or Completion Certificate.

The builder has given us the cost break up which has Rs.2,62,000.00 as service tax and VAT on the property which cost Rs.32Lakhs (basic cost + car parking). Kindly clarify me, what is the calculation for service tax and vat? Also pls clarify me what is the need for two separate agreement, say sale agreement and construction agreement? As as far i know VAT s 4% and Service tax is approx 5% of the total cost of the flat (Unit Price, Car Parking, Power/Water, Generator, Club etc whatever you pay to the builder). This doesnot include maintaince.

Very Informative but I want to know who decides the FSI of the cities.
The FSI in Bengaluru is calculated according to the size of the plot and road width. For plot size of up to 3,875 sq. ft. with road width up to 40 ft., the realizable FSI is 1.75. For plot size of 3,875-10,760 sq. ft. with road width between 40 ft. to 60 ft., the FSI is 2.25. The FSI for plot area of 10,760-21,520 sq. ft. and road width between 60 ft. to 80 ft. is 2.5. The FSI for plot area of 21,520-43,050 sq. ft. and road width between 80 ft. to 100 ft. is 3. The FSI for a higher area and road width beyond 100 ft. is 3.25.

FSI for a project can be obtained by dividing the total carpet area of all flats in the project divided by the land area of the project. In Bangalore the FAR is decided based on the Plot area, Road Width, Area Development category (A,B,C). etc.
Floor space index (FSI) or floor area ratio (FAR) basically defines the ratio of the total covered area of construction to the total plot size. For example, if the FSI/FAR is 1 and the total plot area is 2,000 sq. ft., then the maximum buildable area of the building must not be more than 2,000 sq. ft.

Q: I recently booked an under-construction apartment (95% work done) of super built up area 970 Sqft. in Bangalore. The builder sales guy calculated Service Tax (12.36%) on 25% of construction value ( Flat Cost + Car Parking - Land Cost). But after booking during agreement he is saying that norms has changed now and service tax will be charged at 40% of the construction value. He is saying that norms changed since 1-Jul-12 however they did not get confirmation and now only got the confirmation. Please suggest what is current service tax rule is. He is making 2 agreements (1 for land and another for construction). And he did not reveal the modified service tax till I paid booking amount. Also he is asking for 4% VAT on Construction Value. Is it correct and is saying that later on he may charge service tax on maintenance cost as well. Please advise.

Hennur is not well developed yet and there is a great need of infrastructural developments. However the locality has a bright future prospect. Mriganka, am currently in the process of choosing a plot around bangalore east side and checked this project out and met the sales team. Did a personal sort of due diligence on the company Cornerstone Properties. They have been around for quite some time and have a good B2B reputation as they have partnered with many builders for land needs and a few JDs too with Shriram. However I suggest you visit their offices and form your own opinion. HTH.

According to market news, the draft plan will be disclosed to the public very soon and the government will invite objections from public before finalizing it.

Q: *I have finalized a 3BHK flat in Purnima classic which is JV between land owner and the developer in Basapura near Hosa road junction near Concorde Midway city, which is New but its 1 year old flat with built up area of 1719Sft. The apartment society had not been formed yet. *Builder quoting 3k/sft(negotiable). Which makes it RS.51,57,000 basic cost for just the flat. *But he is charging additional 2 lakhs for parking, *Deposits 2,57,850(Rs150XSFT), *VAT & TAX @8%(Basic cost+Car parking +deposits=4,49,188), *Registration(1500rs X AREA+ Car Parking X 6.6%=1,78,035) *So the Total cost of the flat is coming up to Rs.63,03,115. which is 11,46,115 extra from basic cost of the flat. Can any one plz advice me on this additional costs and taxes are legitimate? And what are the things I should point out while negotiating with the builder? What are the Usual additional costs and taxes apart from the basic price of the Flat? Any advice is highly appreciated. Thank you.

HAL has revert back with the idea and is keeping the proposal under consideration. However, news from various sources confirm that officials of HAL do not find it a feasible idea to increase the height of the radar. HAL further corroborates that the present safe-height regulation is highly conservative, in regard to the improvements made in the field of aviation. According to Credai, the sole objective for the “highrise” move was to delegate the homebuyers with more areas and open space. Given the fact that Delhi and Mumbai airports too have given a nod to highrise developments, HAL is also expected to deliver a solution which will not change the midcourse of their take-off and landing regulations.

I completed agree with Mr Girish connectivity and affordability are the two reasons why the region is developing so fast. Road widening has greatly impact the KR Puram Budigere belt positively. According to sources, we can see lot of development happening in this part.

Hebbal is an area in Bangalore which is better known for the Hebbal lake and flyovers that connect the Outer Ring Road and Bellary Road. Hebbal hosts several reputed companies because of which other residential areas around Hebbal have also grown rapidly. Hebbal has seen large number of projects both mid-segment and upper-segment.In next five, Hebbal is expected to see an average price appreciation of 94 percent. Hebbal has seen a complete makeover in the last decade. The area has gained importance as a preferred destination with the establishment of Bengaluru International Airport at Devanahalli. The area has a great potential and the properties have started seeing the appreciation. Heya Adnan, Whitefield main road, ITPL road and Pattandur agrahara or Nallurhalli Lake are some of the expensive areas of Whitefield, having capital values in the range of Rs 4000-Rs 6000 per sft. While Borewell road, Kadugodi Road, Channasandra road, are all near Whitefield and are comparatively cheaper. For investment these area will see better upside.

Phase 1 delivery is expected around May 2015 and Phase 2 delivery is expected around Dec 2017. You can also talk with the builder about the same.

Eternity' primarily focuses only on residential projects and its core strength is to provide quality execution. They have six projects in a row which are under construction. Other than that there is not much information available about the builder over the net.

As far as I know the project 85 percent of the project is ready and they are going to give the possession with four months. LGCL Luminaire offers villas with size ranges from 2554 sqft to 3554 sqft.
I also inquired about the project and the marketing person told me that there are only two villas available for sale. The project has been approved by BBMP and all the major banks. The rate per sqft going on is Rs 8000 and the price of the villas starts from Rs 2.57 crores.

For 1 bhk it was Rs 5 lakhs which has been revised to Rs 7.5 lakhs and they are planning to quote Rs 10 lakhs for their future projects. For 2 bhk it was Rs 7.5 lakhs which has been revised to Rs 17.6 lakhs and they are planning to quote Rs 25 lakhs for their future projects. For 3 bhk it was Rs 13.5 lakhs which has been revised to Rs 25 lakhs and they are planning to quote Rs 35 lakhs for their future projects.

I feel that you should go with Smondo 4, it is a township project. Moreover the builders are also giving discount on the rate per sqft they are quoting. Electronic City is a better option for investment and you can also except good returns in the coming future because of the PRR project. As far as I know the project has been approved by BMRDA and the expected possession of the project is by another one and a half year from now. The rate per sqft going on is Rs 2800.

Q: I have bought a flat @ Vandana Earls court because I liked the spacious design and privacy of the flats but after moving in I understood the quality of material is very poor and quality of finishing is sub standard. And most horrific is they have constructed this project beside a Granite factory which runs 24X7 producing enormous amount of noise. They have not taken any initiative to the complaints of residents. They have not even corrected electrical problems. Amenities also not completed properly. They have not provided proper lighting for the corridors.

If we look at the list of cities which have been selected as smart city, many of them would already have annual municipal budgets running into multiple times of this figure. Currently the cost of apartment in this project starts from Rs 57 lakhs on wards. Yeah even I heard that there is some offer going on like Rs. 400 Per Sq.Ft. but it is for limited period of time. Yeah even I am not so sure about the offer so I ask Vishal to confirm once with the builder. Yes they are going to provide OC and CC. Banks like HDFC, Axis, LIC Housing Finance, State Bank of India, Federal Bank and Indiabulls have approved the project.

Q: Also I need more information what could be maintaince cost in many high end appartments like Mantri or so , is it good for investement purpouse for example in Kankapura road we can get rent until 14 to 15k , will that help , as i see more money need to payed for mainatance. Currently the rate per sqft going on is Rs 3100 and they are offering only 2 bhk apartments with size ranging from 998 sqft to 1242 sqft. Yes the builder is going to provide OC and A Khata for this project.

Hi Nakul, I have a little information on it. These two projects are the largest such commercial complex in Bengaluru. One of them is Mantri Energia which is spread across 13 acres and will offer about 1200 apartments, while Mantri Lithos will offer apartments and penthouses spread across eight towers.
Thanks for the information Abhishek, Piramal Fund Management is also looking to expand assets under management to Rs 22000 crore by the end of March from Rs 18000 crore, which includes Rs 5000 crore equity.

The project is not yet launched. There will be a total of 80 units and the structure will be G+4 floors. The size of 2 bhk ranges from 1201 sqft to 1340 sqft, 3bhk ranges from 1646 sqft to 1809 sqft and 4 bhk duplex with 2 car parking will be 2300 sqft.

Hey Manish, As the said the project is not yet launched, so it is not possible to talk about the approvals. Usually a project takes at-least 3 years to complete so by that calculation it might get completed by 2018. :) :D

The project has got approval from banks like SBI, LIC Housing FInance, HDFC, ICICI & L&T Finance. The project was expected to be completed by January 2016. Any update about the same?

Q: We have learnt that the sanction plan of this project does not show 3BHK apartments. The two 3BHK apartments are shown as one 5BHK unit in the originally approved plan. Builder is not giving information on this issue at all.

Hi Daksh and Nakul, You can look at the Magadi Road. One of the main factors that work for Magadi Road in the western part of Bangalore is that it is easily accessible from the center of the city. As most of the development in Bangalore is focused towards the east and south of the city, the western corridor is still relatively green and serene. Also, good connectivity through Nice Road, Outer Ring Road and the Purple Line of Namma Metro give Magadi Road easy accessibility to other parts of the city.
But investing near Nandi Hills would be a wise choice as this locality is very close to Kempegowda International Airport. Investing in Nandi Hills will fetch you good returns as the locality is close to new International Airport and the government has also announced the set-up of a 10000 acres ITIR Park. The locality is good for long-term investment.

The builder is lying for giving possession by next year but it will take at least 1 more year after the case is resolved and if it is in favor of builder. if the case is not in favor then god know about your hard earned money.
