Q: Hi, I have requested to Proview persons many times but they are not able to provide the same. I have doubt Proview will face major problem to get completion certificate of Apartment. Proview team manipulating calculation to get extra money from apartment buyrs. I have requested to all Buyer please ask to Proview about the flat bult-up area and calculation and area of common facilities.

Righ Arpit, The number of fights have seen between home buyers and realty developers due to delay in project completion and it can come down if the bill is making it mandatory for the builder to maintain 50% of customer advances in an escrow account within 15 days of receiving the money from buyers.

Q: Each time I call the builder to enquire about the status, they say that it is ready and possession will start soon and to wait for their call. Till date I have not heard from them. Could someone advise me on the status of this property? Reena

We had purchased a 1000 sq yard property from Ocean Seven Buildtech known as Kot Farm in 2007 and till date we have not received possession of it. We have visited the site many times and it remains undeveloped till date. We have contacted the builder many times and each time they promise possession within 2-3 months time. We had send them a legal notice and now we have filed a case against the builder at the State Consumer forum in Jaipur. If there are other in this forum who have bought plots at Kot Farm and still waiting for possession and would like to file a case against the builder.

Hi Rubiya, I recently heard from news that, government on Monday sought to allay apprehensions on the Land Acquisition ordinance saying even farmers whose land was acquired for critical projects like atomic energy, petroleum and highways will also get compensation. By bringing this ordinance, we have done something which would benefit all the farmers.

Hi, I heard from news that, Land Acquisition Bill that deals with the developers who have termed the center's move to let the land acquisition bill fall through as "disastrous". According to them the decision will affect infrastructure projects such as the coastal road, the nuclear power project at Jaitapur and other industrial projects across the state. Even national projects such as the industrial corridor will face difficulties. Land acquisition for railways, airports and power plants will be difficult.
Guys, Yesterday, Finance Minister replied back to the developers saying, let the land acquisition ordinance to lapse is not a problem for the government and the different route assumed by the Centre will provide greater flexibility to the states to deal with the issue.

Q: I would like to purchase a plot of land in Gautam Budh Nagar. I have identified one plot which is owned by real estate company in a village falling under gram panchayat. The land is currently Agricultural Land, which the company says will soon become Non Agricultural Land or Residential Land. The company has developed the land in 3 phases and is selling plots of residential and commercial (for shops) land which are 50-60 square yards each. For the residential plot, it is charging some Rs. 4000 per square yard. Someone I know has already purchased a plot and got it registered there. Please tell me, What precautionary measures should I take. .Specifically, HOW DO I ENSURE THAT:- 1. the plot which has been shown to me actually belongs to the real estate agency and no one else has claims over it - I know we have to see the title deed for it. But how does one know that the title deed that is being shown is for the land that contains the plot that I am being sold and not some other land. How can I know that the my prospective plot of land falls within the land for which I am shown the title deed? 2. the plot will become non-agricultural or residential within the specified period; 3. the plot offered to me will be of the specified dimensions (60 square yards); (will that be specified in the agreeement, or the sale deed, or the torrence plan or map of my prospective plot?) 4. will be at the specified location (i.e. how do I know that the plot that is being sold to me is the same that I have seen on my site visit and on the layout map of the township); 5. will be registered to me alone (i.e. how do I ensure the same plot has not been sold to other people as well?); 6. will not be disputed in any time in the future by any previous owner or anyone else who may also be sold that precise plot of land (What do I need to see for this - the title deed, the previous title deeds; get the encumbrance certificate? How do I get the encumbrance certificate? What do I look for in these documents?) 7. will have all the promised infrastructure facilities (roads; electricity poles, lines, connections, meters; water pipes, connections; drainage; boundaries, etc.); 8. will have the promised infrastructure facilities within the specified time frame (I will have paid the entire cost of the property within a month of booking. However, the infrastructure will only be ready later. Then can I be sure that the company will put in all the infrastructure even after it has been paid all the amount?) 9. will not be liable for payment of any dues (such as remaining taxes etc. Can I ask them for the Tax Paid Reciepts - what does one see in the tax paid receipts even if they do show them? How do I know that the tax paid receipts include the plot which is being sold to me); 10. I will not have to pay more than what I have been told i.e. the cost of the land (area x cost per square yard) + the registration charges as specified by the government.

Subho, Thanks for your response. What is the House Plan Approval necessary for? As of now, the land is rural land, it falls within Gram Panchayat area and not municipality. Noone wants to build any house right now. As of now, it is agricultural land and we want to buy the land so that we can build a house later on. But good to know that the process has been made automated..
Hi Anjor, Yes Housing Plan Approval is very much necessary. As per my knowledge, applicant should submit the application seeking approval of building plan with necessary enclosure to the local body. Then Local Body will examine the application. The building plan should satisfy Municipal Building Rules in case the sites lies in the Corporation, Municipality, and Town Panchayat. or Village Panchayat Building Rules in case the site lies in Village Panchayat.

Hi Tushar, As per my knowledge, recently, CREDAI recommend strongly to developers in the NCR to complete their existing projects before starting new ones. Definitely it is a good step taken by CREDAI. Perhaps, the developer fellowship needs to take the indication. Till that happens, buyers need to be aware of their rights.
Now a days delay in project, buyer paying huge tax & builder or developer not listening to the buyer is becoming a common issue in India real estate market. Suppose buyer is following the construction link payment plan or down payment plan of a project , paying everything at right time by taking loan then why should the buyer will wait for more than 1 year to get his/her home. Does bank negotiating or giving any concession on EMI?? No definitely not.

These are some common questions in their mind. As always, location plays an important role. This means that the rental market for such a property diminish gradually.

Hi Mr Tushar, Facing criticism for inordinate delay in the completion of Western Peripheral Expressway (WPE) or KMP expressway, which is one half of the ring bypass around Delhi, Haryana government on Monday made a commitment to the Center to find a solution to the stalled project in the next one month.
As per authority the options being weighed are replacing the present concessionaire and to undertake the remaining construction work under government funding mode. As per Haryana Chief Minister , completion of the stalled project is one of the priorities of the new state government.

The housing authority, however, said it would not delay the process of final allotment which is slated to start in the second week of this month, when DDA will hold a camp for the successful applicants.

Hi Mr Akash Kanojia, Urban local bodies(ULB) has asked all municipal corporations in the state to furnish details of property tax collected in the past 10 years by the end of this month. It has also asked for specific records including data of tax collected in keeping with the taxation policy of 2000-01 and the difference in revenue after the policy change in 2008-09.
Hi Akash, Details of the extra burden on the exchequer after the previous government ordered a wavier in 2009 have also been sought by the ULB. As per ULB authority the corporations need more funds to provide water supply, sanitation, sewerage management, and building and maintenance of roads. If ULB continue to stick to the existing policy of Re 1 per square yard, it will only increase the burden on corporations and local bodies.

I also held meeting with law secretary and UD secretary prior to firming up this proposal. First, we gave three years' protection to all such colonies from demolition and sealing. Then we got Cabinet approval to regularize them. Hi James, The recent amendments to the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, is expected to ease the way for creating new hubs, townships and cities. The amendments are also expected to check the usual delay in development of any infrastructure project and will take the country a step closer to achieving the ‘Housing for All by 2022’.

@ Rajesh, Continuing previous comment, the same is the case with commercial properties. GCE Road is one area where your property will be rented as soon as it is completed. This makes it a safe investment. Investors must, however, have an investment horizon of at least 4-5 years to earn reasonable gains here.

So to work out this program, there is a necessity of a different non-agricultural permission (NAP). This is because if the land for the project comes under a zone designed in the master plan of the city/town as residential;giving additional floor area ratio, floor space index(FSI) or transferable development rights, as well as modifying density standards for slum redevelopment,low-cost housing.

Hi Rishabh, Delhi government has lifted restriction on sale of leasehold properties which will benefit lakhs of property owners and may trigger hike in real estate prices. The Revenue Department has asked all registrar offices to allow purchase and sale of leasehold properties. Although there were restrictions, transactions had been taking place through general power of attorney. Properties that have changed hands but were registered through power of attorney or sale agreement will be allowed for sale and purchase transactions.
@ Mr Jain, As per my knowledge, an agreement to sell in respect of immovable property is covered under section 17 (1-A) of the Registration Act and is a valid document to be registered if so desired by the parties and as such all these documents cannot be refused by Sub-Registrar.

Hi Mr Gautam , As per my knowledge, after receiving coercive property tax notices from the New Delhi Municipal Council over the last two months, a group of individuals, corporates and residents welfare associations in New Delhi have sought early hearing of the writ petitions filed by them against the way the civic body levies property tax on them.
@Mr Das, In 28 writ petitions that were filed in the Delhi High Court a few years ago and were clubbed together, the group has alleged that under the new NDMC bye-laws 2009, the civic body is charging property tax on vacant, unconstructed land at a rate equal to the constructed area despite the fact that in a large portion of the NDMC area no construction is permitted on vacant land because of Lutyens Bungalow Zone restrictions or Archaeological Survey of India regulations.

Yes, 35 cities and towns have a population between 1 and 5 lakh. There are 21 cities with population ranging between 5 and 10 lakh, 25 cities have population of above 10 lakh and below 25 lakh. A set of 5 cities are in the population range of 25 to 50 lakhs. 4 cities namely Chennai, Greater Hyderabad, Greater Mumbai and Ahmedabad have population of about above 50 lakh each.

Hi Surendra, As per sources, the draw date is around July End. It is getting late because some clearances are still on process. For example like environmental clearance & ground water level. Booking has been close. Approx 5000 applicants have applied for around 500 apartment. Those who will be lucky, will get this HUDA approved apartment, financing by any private & govt. bank .

Hi Rahul Kumar, As of now, NCR real estate market is not showing much impressive or aggressive improvement. Somehow long term investment is a only option here but good time to buy though. Builders are forced to cut down apartment prices as the unsold stock is piling over. Without selling the previous stock, how come they launch new project? Is not it running the reputation of builders?

Q: Respected Sir, I booked a flat in Greater Noida in June 2010 and received the offer of possession letter along with final demand letter (with additional charges and additional demand in form of payment to the farmers and VAT charges, electrical meter installation charges) in end of the September 2014. When we visited the site, there was lot of work was pending not only in the flat but also inside the society, like, plaster work, wooden flooring, tabs, toilets seats, washbasins and sinks were not in toilets and kitchen, electric pipes were uncovered, electricity and water supply was not available in the flat and parking place, club, swimming pool, parks nothing was ready at all. In all, the flat was not ready to take possession. I sent an email and reminders too along with the photos of the flat to the developer but no reply came from their side. When I contacted them in January on phone they told me to first make the full and final payment then they will give the NOC and letter of possession, thereafter the work will be completed. By the end of March 2015, I made almost all the payment and on 25 April 2015 meter Installation Charges and an advance cheque for VAT charges were paid and got the Certificate of Possession and NOC. After submitting NOC at site, in June 2015 I got a mail regarding completion of work done in the flat and we took the actual possession on 9 July 2015. Registry was made on 3 August 2015. I got an electricity bill to be paid from January-August 2015 amounting Rs.22,000/- whereas I took the possession in the month of July 2015. Kindly advice me that when I am applicable to pay Electricity bills and other maintenance charges. Kindly suggest my Maintenance starts from the date of Offer of Possession Letter (22 September 2014) got or the Certificate of Possession and Possession Handover Certificate (25 April 2015) got after making the full and final payment or when the Actual Possession has been taken. Developer is forcing me to pay the electricity bill (Meter charge @Rs.75 for 8KV including various taxes) from January. Please suggest that should I pay the meter charges from January 2015..kya mera electricity bill and other maintenance charges January se pay karna banta h. If not then what action I have to take against the developer. Kind regards,

I hear the news. A government order in this regard has also been issued by the principal secretary of UP Housing and Urban Planning department to all development authorities across the state. Hi Praneetha, This has been done to accommodate small developers and land owners who want to build housing schemes under Samajwadi Awas Yojna. As per the new order, the minimum plot area must be 2.5 acres.
At the same time, the government has also reduced the width of a project's approach road from 18 metres to 12 metres. The move followed many private builders complaining that many projects failed to get sanction because of the clause.

Hi Ashish, Now we are expecting that the government would take thoughtful steps closer to the budget and provide further rate cuts to guide economic growth. The residential real estate has been the worst affected due to high interest rate and slow sales for the past couple of years. Current unsold residential inventory levels across India stands at over 6.9 lakh units and this would take more than 2.5 yrs to round off.
I am not ignoring it but at the same time, hope that both Finance Ministry as well as the RBI push all the Banks to transfer the benefits to the end consumer, else these moves will severely stop short of benefiting the consumer and only help in buffering the bottom lines of the bank.

Hi Lakshay, Power of Attorney is nothing but a simple document which lists out the powers that you want to share with the POA holder. It is primarily used by NRI to manage their property in India. Please note that it is NOW mandatory to have the POA registered specifically for property matters. Reach out to the office of Registrar (commonly known as office of sub-registrar) for your residential location with 2 witness to sign the POA in front of registrar.
Hi Lakshay, As i know, you should carry all the documentary proof documents like address proof, voter ID card, passport, Aadhar card in original along with their photo-copies for registration of property in your name. You never know what they can ask for. I could not find any official published list of documents and hence advise to carry as much proofs as possible to avoid inconvenience. Do not forget to carry the POA with you.

Q: In spite of the fact that interest at higher rate is charged from consumer for delay and minimal interest is payable by the builder by his own delay.

This is a cheating and criminal breach. Matter has not been solved yet and Aggarwal alleged that he also filed a complaint before State Consumer Dispute Redressal Commission where a settlement was arrived at, as per which a plot measuring 335 sq-yrd was agreed to be given on further payment of Rs 22.23 lakh.This is a cheating and criminal breach.
