I am planning to buy a flat in Chennai. The apartment is a large project. As per current MMDA regulations at least 10% of the flats should be single bedroom. The builder has got approval for single bedroom. He has merged two single bedroom into one double bedroom and selling as a single unit with 2 documents, electricity etc.
Is it a serious violation if so what kind of consequence will happen for this violation.
Becuase the flat is at an important locality and has future prospect I am looking to buy the flat.

Top floor is always a problem if there is no proper lift in your building. Otherwise, there is hardly any difference between lower and upper floors. The apartment has 'A' Khata (BBMP Khata certificate) in builder's name which is yet to be bifurcated into individual flat owner Khatas. The selling party informed that builder will try to bifurcate the Khata after 4 months. Is it wise to buy this property? I have a flat registered in my name in a cooperative society.I took a bank loan on this flat so all the original papers are with the bank. But the flat is still not in my name as the share certificate is with the bank. Society also gave me NOC to purchase the flat. Society management says there is no need as property is already registered in your name. i m a bit confused if it is name change in the share certificate is legally required in my case? please help

After paying 40 % amount,they are asking me to pay the remaining amount in cash as this includes....well as said "2 no ki kamai".
They hv promised that the receipt given to me will be of the full amount paid by me.

I have booked a flat in one residential project in Noida Extension, UP,India in Feb,2013. The builder office is in Delhi. I have made 20% payment(amount is around Rs.6,50,000.This include the service tax of around Rs.21,000).
Till now builder has not made builder buyer agreement.After forcing him to give the BBA, the builder said that the booked flat is not approved by greater noida authority.Builder insisted me to take another flat in some other tower which is approved.Builder has put me in dark till now.
After this fraud i decided to cancel my booking and given the cancellation request.Builder is saying that the amount will be refunded after deduction of the service tax which was already paid by me.
Query-----------------------------------------------------------------------------------------------------------------------------------------
(1) If the flat is not approved by the greater noida authority then is it possible to deduct the service tax?
(2) Can i get back my deducted amount?

Some time authority will give partial approval of project and builder is selling the unit saying that within a month unit got approved . avoid taking that kind of flat . as in you case u have already booked unit so consult with the builder for more clarity. If unit is not approved then u are not able to pay ST as per law. and u will get entire ST amount . one more option u can say builder to adjust that amount in approved unit .
