Sorry, I am a Customer of Subh Grih Project, Boisar. I got a letter from Tata housing, tata housing not giving Possession in Jun-11. Before one Year Tata Housing had sent completion letter, about 70% complete. In Jul-11 Tata Housing had sent completion letter, about 90% Completed. I had submitted completion letter in Bank for next installment. I would like to inform you that I am living on rent. I pay 7,000 Per Month and had paid 18% interest of late payment installment to Tata housing. 18% is too much I have paid fine. Now, Possession being late. So, I need compensation 7000/- Per month. Tata housing Send mail and letter also: reschedule the delivery to November/ December 2011. Now saying, building not completed and not giving possession date also. Before one year Tata housing proudly had told me, Will give Possession before deadline. After getting all payments, not giving possession date. Now Saying Seven month More. Not ready to give compensation.
Hi Chandra, As per my knowledge, in case like this, buyer can file a complaint before the Competition Commission of India if the builder is a dominant entity in the market and using his dominant position to the detriment of the buyer. If the buyer is over-burdened by the excessive hidden charges in the buyer builder agreement, the buyer can file a civil suit in a civil court.

Q: I had gone to site on Sunday 22/07/12 at 11 am. About 10 workers are working on Exotica site Bulding 3, and few about 15 on site building 4. The plastering work is undergoing at SRA site and Tile work is going at Phase I Premier Residence . You can visit and see yourself. The work is slow and Mr Vinay is right, this will take another 2-4 years to complete Phase II.

The highway connects to the national and international airport, both being a short ride away. Mumbai University will be your neighbor locality. Shopping Centres, Local Market, Banks, Cinema & Entertainment are all just so very close. Dhiru Bhai Ambani International School, St. Anthonys School and St. Charles High School are also at close proximity. Moreover, the Mumbai Cricket Association (MCA) & the preferred Grand Hyatt are again just a few minutes away. Q: Guys, you all might be knowing that CASA UNIVIS project is now known as LODHA SPLENDORA. The D/E/F wings in cluster IGNIS are ready for possession and many of the flat owners in the IGNIS must have got the possession (fit-out) demand letter. Even I've [E-1504] got the fit-out possession letter. If anyone has taken possession and shifted there, please share us the experience with the possession formalities, flat inspection, living @SPLENDORA, any issues living there without OC or any other issues etc etc. This will help other fellow owners who want to shift there. I've heard that while doing the paper works for possession LODHA is asking buyers to sign some declaration that there're no dues from both the parties to each other and all payments have been settled and no parties can claim anything from each other. Is this true? Please share us the details. This is something really important others should know. Thank you.

My apprehension is agents and brokers are pushing Ulwe as lower-to-medium income group node. The rates being charged are not in sync though. The current rates in Ulwe are 2800-3750. Hi Bhavesh, now I think the ongoing rates in the project is around Rs 12500 per sqft and currently it is stuck in approvals.. Builder has units for sales but I would advice home buyers to wait for the perfect time, so that the approvals are in place.. @Padma, Are you talking about the first phase of 23.4-km Belapur CBD to Khandeshwar Metro project, then it is really a sad news for residents of Mumbai. Do you have any information about its delay?
@Padma, Well!!! according to CIDCO, they are to make certain changes in the original structural plan. They have decided to increases the rail car width to 3.2 metres from the original plan of the 2.9 metre keeping in mind that in future the Mumbai Metro, which uses the standard gauge rolling stocks, may be integrated with their metro.

Well Lalit, According to the official, apart from the civil work, the systems work will commence in a few weeks and will take 30 months to complete because CIDCO is developing the Metro project in three stages, comprising the 11.1-km Belapur-Pendhar section, the 8.35 km Khandeshwar-Taloja section and the 2-km Taloja-Pendhar inter-connection corridor.

Q: Hi All, Hope u guys are aware of the latest news about the Worli ( Campa Cola Society) demolishen. 170 flat owners have been asked to leave just because they did not have the occupancy certificate.. Although the flat owners had paid their yearly taxes and had the flat registered 20yrs ago, the govt has declared it to be illegal.. This only reminds me that few blocks in PWC are still not given with the OC. Note: This is not to create any worry, just a concern that we all need to squarely plan and resolve.

It seems the residents of Campa Cola society refused to move out of the compound when the civic squad and police arrived for the demolition of the illegal floors as the Supreme Court had set 11th November as the deadline to vacate the the flats.

Mumbai is known for its fast paced growth. As such, it has been seeing a massive growth in residential as well as commercial projects in the last few years. The western stretch especially has seen massive growth in infrastructure projects and hence residential projects.
The important factor contributing to the demand for residential projects on the western stretch is their proximity and connectivity to Bandra-Kurla complex and Powai. Bandra-Kurla complex is the first of the growth centres in Mumbai. Powai has an SEZ which houses many well-known commercial institutions such as Deloitte and CRISIL. Powai is also just about 5 km from Mumbai International Airport.

It seems property prices in areas like Chembur increasing by 25% over the last two years, areas closest to the freeway’s entry and exit ramps will emerge as stronger locations. These are the Anik, Chembur-Mankhurd Link Road and Panjrapol Link Road areas. :D :)
Areas like Powai, Kanjurmarg, Kurla and Ghatkopar saw residential property prices increase by 32%, 29%, 27% and 23% respectively in 2012.

Is the Eastern Freeway operational or it is yet to get operational?
The Eastern Freeway is a 16.8 km controlled-access freeway which connects P D'Mello Road in South Mumbai to the Eastern Express Highway in Ghatkopar. The freeway was built by the MMRDA. A 13.59 km stretch of the freeway was operational from June 2013 and the remaining stretch is expected to become operational from December 2013.

The primary intention of the freeway is to reduce commute time between the eastern suburbs and South Mumbai. It is also expected to ease traffic on P D'Mello Road, Eastern Express Highway, Dr. Ambedkar Road and Mohammed Ali Road. Apart from easing the traffic flow and reducing commuting time, it is expected to decongest Dadar, Chembur and Sion.

A government resolution (GR) was issued in accordance with an order from the Bombay High Court (HC) in 2005. The HC order prohibited construction of any type of buildings within the vicinity of 50 meters of the mangroves. A day before demolishing the structures, BMC officials asked the residents for any proof of appropriate permissions to build residential structures in the area, but they got no proof.
There was no notice given to the residents. The BMC carried out a 2-day demolition drive and razed the buildings the next day on Monday (09-Dec). Five locals were taken into custody under the Maharashtra Regional and Town Planning Act of 1966, for violating norms and constructing buildings in the mangrove area without permission. Six persons were detained before demolition and six more during the demolition to ensure smooth demolition process.

Most rental apartments available in Kalyan are 1 and 2 BHK apartments. The size of 1 BHK apartments is usually between 600-650 sq.ft while the size of a 2 BHK apartment is between 850-1,000 sq.ft. While the rentals of a 1 BHK apartment is between Rs.5,500-6,000 per month, it is between Rs. 9,000-10,000 per month for a 2 BHK apartment. Kalyan has a very good social infrastructure such as schools and colleges, hospitals, entertainment and recreation facilities, public parks and playgrounds. The locality also has a good water and power supply.

I have been living in this locality for last 6 years and haven't faced any major power or water crisis as such in this locality. Only during summers one may face unscheduled power cuts for brief period. Absolutely the locality is safe for women who return after late night shifts from work. Crime rate has drastically come down due to intensified patrolling by the local cops.
Yeah I agree with you Mr Anuj. Not only from safety point of view the area is safe but also have good civic infrastructure facilities like wide roads, street lights and adequate drainage system.

Since the project is developed by Lodha Group, the apartments have world class amenities like Wifi connectivity, swimming pool, club house, multi gym, landscape garden, children play area, community hall, jogging track and other fantastic amenities.

Many BEST buses originate from Mulund bus depot going towards western suburbs, central suburbs and also towards Thane and Navi Mumbai. There are local trains touching Mulund station going towards Thane, Kalyan and beyond. One can also take the trains going towards the down direction ie towards Ghatkopar, Sion, Matunga, Dadar and CST. Hi Rakshit, Seems that cost of pre-development work is estimated at Rs. 2358 crore includes Rs. 1538 crore of land development. The land acquisition process for the upcoming Navi Mumbai International Airport (NMIA) is still in the works, the City and Industrial Development Corporation of Maharashtra (CIDCO) on Wednesday floated a global tender for the Rs 9,500-crore project.
Hello Bikram, The project, spread over 1,160 hectares, still has 247 hectares left to be acquired that is being negotiated between the government and the project affected people (PAPS) from five villages. They are yet to accept the government's compensation.

Hi, Yes you are right Rakshit. I too came across that rates in Khar west and Dahisar west are increasingly gaining momentum in present times. It seems that these two localities have registered a overall growth of 15-20% appreciation in property prices. As per a recent survey conducted property values for multistoreyed apartments in Khar west range from Rs 37,000-39,000 per sq ft and in Dahisar west the values range from Rs 11,500-13,000 per sq ft.
Hello, Major reasons for this interest are its well-built roads, social infrastructure and good connectivity. Connectivity through roads offers regular travelers easy commuting to the commercial establishments in the city. They have completed many projects in Pune and Navi Mumbai and still coming up with more launches these citites.

Hi Rakshit, Tata Gateway Towers is one of the luxury in class projects recently launched by Tata Housing in Mulund East. Got in touch with the sales executive and got to know that the price for 2 BHK comes to about 1.74 crore for an area measuring 1453 sqft. The price is even much higher for the same 2 BHK having an area measuring 1556 sqft which comes to about Rs. 1.86 crore.
Hmmm.K. Thanks for the updates. Besides 2 BHK what are the other specifications available in this project? How about the amenities provided and connectivity. Please do let me know about it.

Hi Rakshit, Came to know that 1 BHK in NRDL Viviana costs between 13.50-26.53 lakhs. The flats have area ranging from 435-855 sqft. The present price is Rs. 3103 per sqft which is being charged by the builder.

Yeah Rakshit, More than 900 ready-to-occupy tenements constructed under the ambitious rental housing scheme in the prime Vartak Nagar area are lying vacant for close to a year now in the absence o f any clear plan to lease out these homes to the needy.
Hello Bikram, The Mumbai Metropolitan Region Development Authority (MMRDA) had in early 2013 handed over possession of 1,429 tenements to the Thane Municipal Corporation (TMC) who in turn was expected to lease out these properties. It was touted to be one-of-its kind scheme aimed to provide temporary shelter to the needy families and was expected to correct the inflated rental market rates. A year later the dream project has failed to take off and the two 11-storied buildings are almost empty.

However the plan might change without any notice and information, depending on future contigencies or unforseen events or factors which is already mention on floor plan. Hi Sankalp, The construction work is still going in Block-A/B. The previous possession date is going to change due to some reason and the new possession date will be February'2015.

Well Lalit, Mulund is one of the greenest and safest places of Mumbai. The cleanliness is average, even though the population density in this locality has grown tremendously in the last few years. The area has easy connectivity to the Eastern Express Highway and Navi Mumbai through the Mulund-Airoli Bridge. Its distance from premium areas like Juhu is about 21 kms, Mulund East is about 16 kms from the airport and about 32 kms from the Railway Station. Some of the reputed schools in this area include JA Meghani English High School and TJ Academy. It is well connected to other suburbs and cities by sufficient network of trains, BEST buses and roads including a national highway. As we all know that the real estate market is unpredictable and demand supply theory being put into practice, one cannot really say what % of returns one will get in next 5 years. But the above statement says that project location and the connectivity is good so you can expect for a good return in future.

hmm.. i read too that this new metro link will connect the north western suburban areas of versova-andheri with ghatkopar and will have a major impact on the realty scene of the area.
Hmm..yup..there was a report that the land value has seen a 22% variation in areas with metro proximity and even traditionally, increased transport facility and better connectivity does have a major impact on the nearby areas.

@shantanu, If we accept that 99 year lease is there in PALAVA and then look into the comparision with other projects I see PALAVA is a very good option. It's already connected with good wide roads (Pipeline road that goes toward Badlapur) and Taloje highway will provide connectivity to Pune Mumbai Expressway and Panvel. If the promises of a mega township (Facilities inside the township schools, club houses, quality of constructions, gardens, dance classes,photography etc....) are fulfilled this is a good place to live with in the PALAVA city.

Hi Sheela, Since none of the builder neither harmed me nor benefited so it may not be good to spoil someone's sale because one point may be bad in my opinion but may be good for others so I will just compare on few points from buyer (end user) perspective only, not sure how much informative it will be. But I also like you to make at least 2-3 site visits and roam at least one km in all direction from your desired project then you will visualize the future shape within specified time frame , discuss with local people as much as you can !! This is the best experience in my opinion to finalize any project. Yes, it is true and i read some of the poor news about them. Well I was advised a basic price of around Rs 28000/sqft for this project and so i think the smallest size flat will be costing anywhere Rs7 Cr and above...

Well they have 2.5, 3 and 3.5 BHKs and 32storeied residential tower with 2 dedicated car parking for each apartment as well.. this is a 5 acres project which has 3 towers in total 2 are commercial towers and 1 is a residential tower.

Hi, If they price it anything below 50L, (All inclusive) for a good size 2BHK (1200 sqft+), then it would be a GOOD buy. provided it has a golf course view and low monthly maintenance (say Rs3 psf on carpet). Anything beyond this price range, would be a bad financial decision for both the investors or end-users. Hi Padma, The location is not in mumbai region. The mumbai town region ends at Bandra. Beyond Bandra we have extended mumbai suburbs for 10-15km. You can not consider this location as mumbai region. This is semi-rural area at least 70-90km from town. Even at 2psf on carpet area maintenance, the builder would be making huge amount of money. Rs. 3psf is quite high, it should be around 2.5 psf on saleable area. 11 KMs from Panvel station, In between Old Mumbai Pune expressway & NH4., Before Hiranandani Panvel. Landmark- Shedung Toll Plaza
@Lalit, Livability is a major issue at the moment. Investment point of view, it may be great if airport, nhava-shewa comes there. So this project is good for investors-my view.

Q: The roads havent been developed around the building and it looks a little shady. Is the area safe? how is the resident quality in the building? The building maintenance will depend on how well educated the residents are. It would also depend on the social class. Are they working class or mostly business class people. What would be a fair price for a 965 sq ft, 2 bed house in the building currently.

Hi Sankalp, This is a under construction project and expected to be completed by December'2016. Almost all the leading banks and financial institutions are funding this project. Omkar Meridia is a MMRDA approved project and all the legal approvals are in place.

Hey Dinesh, What is the reason for the delay in possession? Is the builder going to give any kind of compensation for the delay?
Ofcourse, there is a rule for compensation on delay project. Check the agreement first, is there any clause mentioning compensation on delay. If yes, then mail the developer or send them a notice mentioning compensation on delay. If they are not agree then consult a good legal adviser and proceed further.

The price of 1BHK in 765 sq-ft. is Rs. 38.25 lacs. onward, 2BHK 1289-1499 sq-ft. is Rs. 64.45 lacs to Rs. 74.95 lacs, 3BHK from 1385-1980 sq-ft will cost around Rs. 69.25 lacs. to Rs. 99 lacs, 4BHK from 2100-2425 sq-ft. will come under Rs. 1.05 crore to Rs. 1.21 crore and 5BHK in 5000 sq-ft. is around Rs. 2.50 crore onward. Stamp duty and registration charges are extra.
Payment plan :- Token Money - 5 % for 2 /3BHK, EMD ( to be paid within 30 days) - 15%, Completion of plinth slab - 20%, Level-wise equal installments - 55%, On Possession - 5%..

if you have been charges extra interest, you must have the receipt of those payment. Contact a legal adviser, ask him whether the chaged interest is legal or not. Q: The prices at the Kanjurmarg project are really lucrative. Plus the amenities are good and the builder is reputed. My only concern is that everybody has told me that I could get stuck with a delay of 4-5 years additional over and above the committed delivery. In that light, would this be a wise investment? will it appreciate and come at par with the other projects in vicinity?

Q: I've booked flat from a reputed builder. Agreement is done. But on one occasion i was being given receipt for amount paid by someone else. As per builder it happened because of similarity in name. Gud Evening....Pradyuman, The fact is that vast majority of people who work in BKC do not reside in and around the location creates normal housing demand. The corporate customers of BKC can be categorized as high-income earning. This is a class of people who have purchasing power and is desirable. Therefore, given that land is quite expensive in BKC for developers to provide large housing, high-end and luxury homes are expected to provide grip to sales in this area.

In 5 years you might get 30000 - 32000/sq-ft on possession assuming 10 -12% per year and if you are lucky and Indian economy starts refreshing then 40000/sq-ft. Q: Dear Sir / Madam, I had approached Indiahomes in second half of 2012 for buying a flat in Malad/Goregaon viccinity and was presented with a detailed report regarding Shivshakti Enclave by Saaga Infra Projects. This was supposed to be a redevelopment project and bookings were open in Prelaunch stage. India homes representatives (Mr Prashant Zodge & Mr Mitesh) arranged a site visit and then negotiations with the developer thereafter. Being new to Mumbai, I hardly knew about the developer but was well aware that Indiahomes verified project would be a safe investment. Personnel from both - the developer and India homes followed up for payments and the flat was booked in 100% white transaction (Flat E-101). Alas my hopes were dashed when I followed up back with both parties regarding progress status and the project till date has not even started as yet and the old society still stands as it is. To my surprise both Indiahomes and Saaga Infra Projects refused to let me know updated status just avoiding my calls or requests for a refund. The site office has since been closed and even the main office of the developer has shifted once. Mr. Uday Surve - a supposedly reputed name in the industry has refused to meet even once in my follow up for the last 2 years ans so has the staff from India Homes simply flashing 'Project Unavailable' - Status on their website. Any number of enquires for this project are not retured with calls / sms to their office. I feel swindled of my hard earned money and pity the cheap marketing techniques employed by Indiahomes without checking background information on the project which have left buyers like my without a shelter in Mumbai. I am thinking of initiating legal action / consumer court complaint against both Saaga Infra Projects & India homes for cheating and fraud. Hope this complaint gets noticed and long delayed feedback is given. kind regards

Hi Miheer, If you don't see a sign of possession in near future and if the delay is beyond a reasonable limit, you should file a legal case. You can file a case in consumer court or file a civil or criminal suit as the case requires. Hi Mansoor, Under the amended MCA, premium payment starts only from the 4th year after the completion date compared with the 1st year previously. That is a significant relief to both developers and lenders because most projects end up with debt service coverage ratio of less than 0.8-1.0 time in the first 3-4 years after completion date.
The govt. has also increased the scope of revenue shortfall loans to include projects where judicial declaration effect cash flows. Considering end of project that do not progress even after a year of award gives greater clarity on the termination process.

Q: Hi, I have resold a flat in Lodha Palava ,Mumbai of which I have possession. There is no OC and no society has been formed. Lodha has asked for NOC charges in cash and not in cheque. They said that even bank like ICICI, HDFC etc. can not give loan. Is it true? Is this NOC and these charges valid. And does buyer and seller has to bear 50:50? I am salaried.

Hi, There is no need for flat owners to seek NOC from builders before sale or re-sale of flats. There is no such provision in the Maharashtra Ownership of Flats Act ( MOFA). As Maharashtra CM Prithviraj Chavan declared in 2012 that it is a illegal activities by the builder for pressurizing flat-owners to seek NOC.Hi, There is no need for flat owners to seek NOC from builders before sale or re-sale of flats. Ur Welcome Ravindra, This is quite right and this new rules now consider as the start of the runway as the point to calculate height restrictions for new buildings according to officials of Airports Authority of India (AAI). As per earlier rules, building height permissions around the airport depended on the height of other existing structures in the concerned area.

Hi Abhishek, Both these gentlemen are right. After preparing the lease agreement, the most important task is to get it registered because only then it can be used as evidence in the court in case of any litigation.
Right Vibhor, And as per the Section 17 of the Registration Act 1908, it is compulsory to get the agreement registered only if the lease period is more than 11 months. For registration, stamp duty and registration fee have to be paid.

Hello Vibhor, The basic reason for making it on 11 months basis by the property owner is to away from the law of giving 6 months notice. If he makes it for 1 year i.e 12 months, then he has to give notice of 6 months at the end of those 12 months but if he makes the agreement for 11 months then there is no pressure of giving notice, he can give him minimum period of notice which he think say 7 days notice .

Q: I am looking to buy a new ready-to-move property at a maxed out budget of 55L for personal use. Which would be a better option, already developed GB road or bigger flat in yet to be developed Shilphata? I have an eye on Dosti Planet North which should be completing in near future. However earlier post suggest that it was supposed to be handed over by 2015, which is apparently not happened. I am not sure about which scheme to go for in GB road as bigger names have a high premium like the Lodha Amara 1bhk would go beyong 75L.

Ltd. is a reputed in name in MUmbai Real Estate market. The handover has been delayed repeatedly and last year in RERA the builder had declared June 2019 as handover date and now they are applying for extension to June 2020 to RERA. We can't afford paying rent and EMI every month. What is the legal recourse that can be taken?

The RERA authority may extend the registration granted to a project on the basis of the facts of the case, where the delay in the particular project is not due to default on the part of the promoter. However, in any circumstance, such extension shall not exceed a period of one year.
