This is AMIT PATNAIK a fellow owner (IGNIS-E-1504) in the project CASA UNIVIS by LODHA in THANE. I recently joined the group and started sharing some of my experiences of dealing with the builder on various issues. To name some issues like 5% MVAT demand, Delay in possession, denial in paying the Compensation for delay possession etc. I think we should group together and start sharing our thoughts on how we can handle these issues. We’ll take the same initiatives like others have done for fighting against the builder for harassment to customers.
The first thing we can do is we’ll start with a formal meeting and create an Association and register it. In this way we’ll l get government recognition as a BODY and have a good stand in the Consumer Court for fighting against the builder. Please share your thoughts and also if anyone has better suggestions we’re listening. Hope to hear from all.

Hi Dhiraj..Jal Nigam is taking these steps. They will first try this at Indira Nagar and Gomti Nagar by September 2013. And these meters will gauge the amount of water wasted also. All the six schemes are located close to Wardha Road (4), Amravati Road (1) and Bhandara Road (1), which are the key areas of the city. And all schemes have easy access to the Outer Ring Road and this will give good road connectivity.

Any other things to be checked out..??.before registration..also..??. I am planning to put EC upto current date on my own, even though buyer gave me the copy of the EC for 25 years. One of my cousins has bought a flat in this project and the rates quoted that time was Rs 3800 psf with overall cost of Rs 51 lakhs for a flat saleable area of 1100 sqft. I have bought a flat in Lodha Luxuria (westgate B) Thane from an investor. I found an error/mistake in the floorplan layout page in the agreement done between Investor and Lodha.
I have bought 2BHK flat with a balcony on 16th Floor and it is located at the right hand side from the lift area and also the floor has actually only 4 flats right now but as per the floor plan layout which is attached in the agreement it shows that my flat is one bhk and it is located at the left hand side from the lift area and the floor has 6 flats on the floor.

Look for areas that are still cheap and are supported by industries near by like Bhiwadi/Dharuhera, Raj Nahar extension, Crossing Republic. Selling any units of project without getting all approvals is also not allowed. This is actually a good initiative. But at least marketing could have been allowed I think. I booked a flat by paying 50K in Dec 2010 & paid remaining cash 40% (of total amount) in 2 months. Flat completion date was Dec 2011, but got delayed and we got possession in Dec 2012. As per agreement, builder can max delay for 6 months only. Now there are 2 main things for which I need suggestion?
1. Builder is asking for extra service tax as ST got revised after March 2012. If completion is done on time, we cld have get registered it before that BUT we got the registration on July 2012.
Does builders have any legal rights to ask for extra ST? What option I have?
2. Club house and other amenities, got completed recently and Builder is not allowing ppl to access even if u have 1 Rs as pending to pay...People have not paid full amount as pending work is going very slow and still lots of things, like service lift, permanent parking etc are pending....

Hello, I had purchased a flat in Indore last year in June-2015. As the building is under construction The builder is charging me Service Tax of 3.5% on the total agreement value.
Now the property is constructed & at the time of registration, builder is asking for 5% VAT on the total agreement value. My question is VAT amount is calculated on the total construction cost of my alloted area (as in this case 1190 sqft) & not on the Total agreement value of selling? Also he is not providing me with the receipt of the VAT charges applicable.
Also can you clear me with the current registry charges + any other charges applicable at time of registry?
The builder is asking for 8.5% of the total agreement value, but i think the registration is done on the market value not agreement value?
