Most of the owners who have booked their flat in smondo-3 would have receied mail/call to pay the stamp duty of 20000 thousand. My friend who had taken an apartment in another property paid only 500 rs, I am wondering is it a must to pay the complete stamp duty charges of 20k now, or can we push it till we do the final registration.

It is advisable to go for properties having A Khatha as in case of B Khatha you are not entailed to have building license, trade licence or loan from banks or any other financial transactions. Hey Amarnath, I do not agree with you totally they must be one of the reputed builder but they do not provide timely projects. One of my relatives bought a flat from DS MAX properties in Bangalore in 2007. I am a resident of Ullal Main Road near Bangalore University Quarters, Mallathahalli, bangalore - 560056. In the first cross at the entrance of the street there is small house around 10 x 15 sqft which is occupying almost half the width of the road causing hindrance to the public as large lorries or JCB cannot pass to that road.
The people residing in the houses of that affected street have already approached BBMP and demolition of the illegal construction was done twice. Again the person has built up house at the same location and says he has submitted an appeal in the court. But we are not aware of what is happening and how long we need to tolerate this situation.

I recently booked an under-construction apartment (95% work done) of super built up area 970 Sqft. in Bangalore. The builder sales guy calculated Service Tax (12.36%) on 25% of construction value ( Flat Cost + Car Parking - Land Cost). But after booking during agreement he is saying that norms has changed now and service tax will be charged at 40% of the construction value. He is saying that norms changed since 1-Jul-12 however they did not get confirmation and now only got the confirmation. Please suggest what is current service tax rule is. He is making 2 agreements (1 for land and another for construction). And he did not reveal the modified service tax till I paid booking amount. Also he is asking for 4% VAT on Construction Value. Yes Service Tax and VAT is only for under construction property. But if you buy flat/ unit only after the builder obtains Certificate of Completion from the Competent Authority you need not have to pay any of them. Hi Rakesh, Kindly check your sales agreement where the builder has mentioned about the payment scheme. After I enquired with the builder they told me that this month end i.e by oct end they ae expecting to get approval from BMRDA. Soon after they get approval they will start doing registration. In our case we were interested in this project but the problem occurred from their end, they have not received the 4th floor plan approved.
Now they are saying that you can refund the amount only if some other investors will invest then only they can refund. This is how big names & Banners torture the middle class. So please be careful with their papers. They also recently faced problems in Airoli Project.

Yes I agree with the above member. I know some people who have been living in Shriram Smrithi as they got their possession last year. The club house is well developed but there is no activity happening as of now. It is not the imperative of the builder but the residents to develop the clubhouse into a multi activity center. There are not many residents as of now. When more people move in after the possession is given for the second phase, I expect positive developments. The swimming pool, club house and other amenities will blossom once the RWA is formed eventually.Yes I agree with the above member. I was interested in SAMRUDDHI Lake Drive project and had got a initial quote from their manager. The quote was close to my budget and I was on 2 week vacation after that discussion (which was intimated to their persons). But I had a surprise when i came back, their General Manager spoke to me over Phone and gave a exorbitant quote as the hiked price (this was 40% above the quoted price).
After discussions (back n forth) with other managers, they gave me a revised quote which is 10% above the first quote. I am confused whether to really proceed with the revised quote and go away from the project as this was break of trust without notice. They couldn’t keep the committed price, how will they be committed to other promises with their project.
Appreciate if you could share your experiences with SAMRUDDHI.

I would say yes definitely it is profitable to invest as the area is well connected and you can get apartments and properties at an affortable rates. As the area is close to IT hubs and business district, it is expected that the property price will increase and good returns can be expected in 3- 4years.

We intend to register our apartment association under THE KARNATAKA APARTMENT OWNERSHIP ACT, 1972.
As far as sharing of common expenses are concerned, the proposal is to have a hybrid model, where day-day maintenance expenses which do not depend on the unit size (eg electricity bills, lift maintenance, landscaping etc) are to be divided on a per flat basis, while expenses which has relavance to the flat size (eg painting, structural repairs etc) are to be on a per sq.ft basis. We have incorporated the basis by a clear table in our by-laws.
However, clause 10 of KAOA 1972, states that The common profits of the property shall be distributed among and the common expenses shall be charged to, the apartment owners according to the percentage of the undivided interest in the common areas and facilities.
Now, my question is : Are our by-laws valid? is it in violation of law?
How will our by-law affect the way we share profits when there is any redevelopment?

I heard builder has a record of delivering projects with delay to the tune of ~2 years. Builder and his team are not even attending buyers who have already paid money, without work done builder is asking 100% money. And such trend is followed by builder in all his projects and buyers are feeling helpless as they are not even able to communicate their concern to builder, his last project Balaji Elegance is ~2yr delayed. Even few buyers got notices from KSFC (builder has taken loan from KSFC) asking for money. Still builder does not have BBMP approval and they are committing to complete feb 2016 and providing CC & OC.

I booked a flat in VKC Ch. M. II and then cancelled it. Lost 10% of my booking amount as per their T&C. Was not informed about this during booking and got cheated. During my first visit they did mention they would refund entire booking amount in case I cancel the booking but its all verbal assurance only to cheat you- no value for it.
Reasons for cancelling -
No Water. Only tanker water and maintenance cost is bound to go beyond 5000/- per month
Their clauses in agreement are totally favoring them. They even mention they are not responsible for connection of electricity or water And they are not ready to modify this after discussing with them face to face.
Checked out with flats in Phase I, some of them did not even get OC - occupancy certificate !
Pls dont get fooled by their offers even if its 3200/- per sq ft and dont beleive in their extra obedience
Sincere suggestion is to avoid them. In case you wish to book, pls read all their terms and conditions, understand them and then sign their deals.

Ever wondered why House Rent Agreement is not made for 12 months or more!
Here is the simple answer.
The main reason behind the 11 months agreement is to skip the registration process. According to the clause (d) subsection (1) of the Registration Act, 1908, registration of the property that is on lease for a year or more is compulsory. Therefore, the standard duration is 11 months for which the Rental Agreement is framed.
If somebody wants to make a Registered Rent Agreement for 12 or more months then it needs to be –
1. Registered and.
2. Parties need to pay heavy stamp duty.
In Order to avoid confusions and unwanted troubles a Tenant Or an Owner should be bound for a period of 11 Months in Rental Agreement, and in case want to increase the duration in special cases, pay higher stamp duty.
