Q: We purchased a flat in Kamal Park Society, at Bhandup (West) in year 2009. We had paid ad-hoc maintenance for 2 years. Apart from maintenance we paid for the Intercom facility which has never worked in last 2 years and also for gas pipeline which is not been provided till date. Mahanagar Gas says that they have not even received any application from the Builder requesting Gas pipeline. The Builder is refusing to let us form the Society, he has not paid the Property Tax for any of the Flats for last 3-4 years and still charging us Maintenance. Can we form a Society on our own? How do we make the Builder pay the Property Tax till date for which he has collected money from us in the form of maintenance charges? He is not giving us accounts of the expenses made till date for the maintenance. Do we still pay him the maintenance charges? Kindly advise.

Q: Not good at all...flooring promised was premium and was also charged a premium rate vs other flats in the building...however the flooring given was vitrified tiles and that too totally damaged...the builder then showed it to diff technicians saying it can be fixed...however all attempts to fix hads failed and not they dont want to change the tiles and are asking us to do it at out costs...i am not sure why do they do this...i purchased this in feb and have lost potential rent of 50k per month since then as it cant be rented also due to bad quality of the tile...please help..as i would like to file a case against them

Hi Khushisha, Having paid 80% of the total cost for their dream homes, the buyers are still waiting to get possession for more than 4 years. The project completion dates have been postponed 12 months every year, with no official confirmation on the final date.

Make sure you visit the actual project site and see the location, how well connected the area is city, how are the roads, what is nearby the place and other important factors. A lot of people book properties in real estate expo and exhibition, which I do not think is a good idea at all.

Q: I have purchased a farm house plot in Saffron City, Wangani village, Velhe taluka, Pune district in 2008. Saffron City with developed bungalow plots, farm house plots, agricultural plots with roads, electricity, compound to plots. This project is situated near Kondhanpur on one side and Wangani on other side. It is at 35 km from Pune. It was booked in this project offered by Saffron developers, Pune with the promise of handing over the plot in 2010 with well developed roads, electricity and water at the doors. The BMC has changed to the capital value based system, that calculates property taxes depending on present market value of the property. The civic body now plans to make the payment of property tax bills online too.
Capital value is the market value of property at a specific time. It depends on the stamp duty which the government revises every year. Category-wise capital values can change like age, user and construction. The categories have different weights and these are used while calculating capital value

While there is some positive movement in both projects, there is no substantial activity that has taken place since the project proposal. This has affected everyone associated with the locality in one way or the other.
I second Lewin. Even the developers have paid exorbitant prices for the land while customers paid premium prices for their properties. Other social infrastructure and civic infrastructure projects such as Seawood-Uran Railway were also planned but are much behind schedule due to funding issues.

According to experts, it does make good sense to buy property in Ulwe in the present scenario. Ariana by Tata Housing may have the name of the bigwig Tata business group but response so far has been quite lukewarm. Also in the first stage they are offering only 1 BHK. Located close to National Highway number 5 is an advantage but with its price of Rs 4000 per square feet for1 BHK, the prime performance ratio does not seem to be right. I would suggest you to wait and watch before deciding on the property just on the name of Tata. The brochure of Tata Ariana does not have much details apart from a lush green landscape.

Ashirwad Villas is located in the center of MR-10 & MR-11 close to the Bombay Hospital. The prime location and good quality of construction has made sure that a large number of villas and flats are already sold. In fact this project has been a huge success with most of the houses and flats nearing completion. Some 3 BHK villas are still available although pricing would vary on the location and the size of the villa. As it is nearing completion, one can check the interiors being done in various flats and villas to get a good look at the quality of construction. Overall a good investment opportunity but downside is that most good locations are already sold.

Yes its true, Amrapali group has only one project in its pipeline in Indore but considering the quantum of the project one can understand why the group is taking is slowly. Amrapali has built its name over a period of time and usually deliver good quality townships and residential apartments on time. So far I have not heard any major complaints about the group. When the Housing Development Infrastructure Ltd (HDIL) won the contract of rehabilitating the slum dwellers encroaching the Mumbai Airport land, it was like a jackpot for the company and its investors. This was country's largest slum redevelopment and rehabilitation project and involved building new tenements for 85,000 families. This would free up 276 acres of Mumbai International Airport Pvt Ltd (MIAL) land which could be used to build a new terminal with other facilities while expanding the runway.
In less than six years, the rehabilitation project has come to a halt while both HDIL and MIAL face each other in court. What is the reason?

When MIAL won the contract to develop and modernize the international airport, it faced a challenge of enhancing the airport and constructing new facilities in the middle of the city. Demand for affordable housing is high in Mumbai despite industry slowdown. Due the high capital values in Mumbai, affordable houses need to be built outside Mumbai. The capital value in these areas is typically in the range of Rs. 2,500-5,000 per sq.ft. Most flats in these areas are built by grade B and C developers. Without proper infrastructure, costs of construction go up and projects become unviable for many of these builders. Many developers blame the government for neither promoting nor supporting affordable housing. They claim that permissions do not come in time and affect the projects.

Ulwe, considered one of the most affordable areas in MMR does not even have basic infrastructure. There are no water channels, drainage or sewage system. There is also no proper connectivity. Lack of public transport system such as buses and rickshaws is another deterrent for prospective buyers.

Prabhadevi sees a high demand for multistorey apartments for rentals. While there is a good demand for 1 and 2 BHK properties, 3 BHK properties see a high demand in this area. The area of a 1 BHK apartment ranges from 250 - 750 sq-ft while the area of a 2 BHK apartment is in the range of 700 – 1,450 sq-ft. For a 3 BHK apartment, the area is between 1,450 – 2,200 sq-ft. The covered area for a 4/5 BHK apartment is between 2,000 - 3,600 sq-ft. The covered area of a 1 BHK house is between 300 – 550 sq-ft, a 2 BHK house is 700 – 1,200 sq-ft and a 3/4 BHK house is between 1,050 – 1,850 sq-ft.

Out of the total demand in these eight cities, the majority demand will come from the middle income group (MIG) and the higher income groups (HIG). The demand from these groups is expected to come up to 2.5 million units. The demand for the lower income group (LIG) units is expected to be low in these cities viz. a mere 3,00,000, due to expected increase in income and housing standards.
Though these eight metros will see a huge demand for housing units, supply will lag behind demand. The cumulative gap between the supply and demand for housing units in the MIG and HIG segments in these eight cities from 2013 to 2017 will be about 45%. The eight cities will see a supply of just about 1.4 million housing units in the MIG and HIG segments. Out of the 1.4 million units, 1 million units will be in the MIG category while the remaining 4 lakh units will be in the HIG category.

The Maharashtra state government has let go the land acquisition of a residential chawl in South Mumbai for redevelopment purposes. Instead, a private developer has taken over the property.
Dattatray chawl is located in South Mumbai behind Bhatia Hospital at Grand Road. The chawl is one among the 320 properties built before 1940s and approved by MHADA for acquisition. It is spread over 2 acres (approx. 87,100 sq.ft) and has about 297 tenements. This is a chawl selected for acquisition based on chapter 8A of MHADA's Act. The chawl is expected to have a development potential in excess of Rs. 1,200 crore according to real estate experts

Since the rates are low today you can go ahead and book a flat at Orchid Ozone which are offering good amenities. There are every possibility the prices will go up in the near future. Since you said you are not very keen to buy property at posh locality, Orchid Ozone will ideally suit your budget and meet your requirements. Hey All, Once this road gets completed, I think It will reduce the amount of travelling time it takes from Pune to Thane at present. I think one can save atleast 25 to 30 minutes of time.

Hi Sandeep, Yeah even I too came across that Indian Real Estate Industry and Indian Retail have posted a 78% jump in the previous year ending 2013. With Govt encouraging FDI, it has boosted the retail market to a great extent. Though most of the growth took place in Tier 2 cities, metro city like Mumbai and NCR region also showed a positive trend.
Yeah Mr Vinay, I fully agree with you. It seems that Foreign Investment Promotion Board has approved 12 major proposals worth 820 crore from retailers. Last year many global retailers entered the Indian market and made a strong presence of their international brands in Indian market.

Hi Shantanu, Did you know that reputed builder Lodha Group just offered pricing around Rs. 22,000 per sqft for their project in Lower Parel when other ready to move in were charging about Rs. 30,000. I think this was just to stay in the game and overcome cut throat competition from its rival group.
True Mr Vinay!!! Same was the case with property prices in Andheri too. Since many new projects were launched, customers have more choice and options. I heard that approx 34 projects were launched in last year and 60 more projects are expected to take off in next 6 months. This itself indicates that real estate market is keeping pace with time and is looking good and buoyant.

Hello Bikram, Hope you are having a good day!!! :) Since I am living in this locality for quite several years I have not come across any major power problems except during summer months where there will be power cuts for some time. Apart from this issue we dont face any power or water issues as we get 24 hrs water in Vartak Nagar.

Hi Vinay, I actually visited their project site and had details with the executive present there. Came to know that it has 2 and 3 BHK flats. The area for 2 BHK comes to about 1270 sqft and is priced at Rs. 1 crore onwards. 3 BHK come with an area of 1665 sqft and the price of the flat start from 1.30 crore onward. The project has excellent amenities like landscape gardens, party hall, amphi theater, childrens play area, swimming pool, steam sauna massage room, temple within apartment complex, club house and lots more.

Hi Abhijit, Yeah!!! Heard that a truly integrated township. Mohan Suburbia has a hospital, a school, a vegetable market, a clubhouse that stretched across 1.5 acres of the property and is paved with wide internal roads. The flats consists of 1,2, and 3 BHK units.

Dear Praveen, As far connectivity is concerned, Mira road is well connected by good public mode of transport. BEST operates many schedules from this locality to western suburbs, parts of Thane, central suburbs of Mumbai as well as to Navi Mumbai. Mira Road also has a local suburban railway station that meets the requirements of the residents living in this part of the city. Fast local trains originating from western line ie, Bandra Terminus and Mumbai Central have a stop at Mira Road station. Besides autos, cabs and taxis also form the mode of public transport.
Hey what about the opening of Sahar elevated road. Will this have any impact on the infrastructure in Mira road. What about the metro connectivity to this place??

Hello Ramesh, Off course you can buy a flat in Nalasopara for investment reasons. Came to know that the rate that is prevailing at present is Rs. 4383 per sqft. Chances are that prices may get appreciated or depreciated since real estate market is governed by market factors. In case you plan to sell the property in future, wait for the right time and then go ahead and sell the property.

Dear Ramesh, Since you are salaried employee you can avail housing loan for which you may have to undergo some basic procedures. Once done with the loan documentation part, loan will be sanctioned in your name. Hi Ashish, Locality wise Dahisar is good for living since it is not that bad as traffic is concerned. Since affording a flat in Mumbai is beyond ones imagination, people are shifting to Dahisar as the property rates are still cheap when compared to prices in Thane, Navi Mumbai and major areas in Mumbai as Dahisar is still developing residential and commercially.
Hi Sandeep, As far transport and connectivity is concerned Dahisar is well connected by western line of Mumbai local as this is the last terminus for local trains. Fast and semi fast locals are available every 5 minutes going towards Vasai, Byander, Mira Road, Goregaon, Andheri, VileParle, Bandra and Khar and Mumbai Central. Even though buses are available from Dahisar naka, the travel time it takes is very long, hence trains are the most preferred option.

Bandra station is just 2.5-3 kms from the apartments. One can reach Khar, Pali Hill, and Santacruz quite easily. Hi Ashish, In fact this is a big relief that there is no water problems in this project since I came to know that some projects located in Ulwe has water crisis or rather irregular water supply. Thank God!!!! There is nothing of sort in this project. Then let me know what are the flats available and the price? How good are the amenities?? Is it worth a buy by paying such huge amount. Hello Ashish, May I know your exact requirements like what units are you looking at in this project. As we all know Juhu is the most sought after locality in Mumbai. It is not only one of the posh locality but also well maintained locality with respect to civic and social amenities are concerned. The locality is the house for several famous celebrities, industrialists, cricketers, film personalities.
Yeah you are absolutely right Mr Sandeep!!. The roads, bylanes and crosses are neatly marked. One can find many gardens and parks in this locality. The place is also well known for beach which attracts lots of tourists and visitors all round the year. Hi Sandeep, Kalpataru Avalon is coming up in LBS Marg which is situated in Bhandup west. The nearest landmark is the Asian Paints office. Bhandup station is only 10 minutes walk from the site. Besides one can also take BEST services plying from this locality to Mulund, Thane, Kanjurmarg, Nahur, Ghatkopar, Andheri and Vashi. Taxis and autos also form the local mode of connectivity. Mumbai airport is located at a distance of approx 12 kms from the place where the project is coming up.

Hi Ramesh, To deconjest the traffic around the Kalyan station, MMRDA has constructed a 1.4 km skywalk at a cost of Rs. 84 crore which is the 3rd largest skywalk after Borivili and Thane. Also heard that a new monorail project is being proposed by MMRDA linking Kalyan-Thane with Navi Mumbai over a 3 year duration at a cost of 3000 crore. The project is still in the planning stage. A four lane expressway is also under consideration which will enable people to travel between Virar- Vasai in western suburbs via Kalyan to Panvel in a matter of few hours. The expressway will have wide foothpaths, subways, over bridges and service roads connecting major towns along the route. With all these developments and projects Kalyan is all set to be another resourcefully, economically and socially developed suburb of Mumbai.

Hey, I too recently booked a 1 BHK in this project for which booking are in progress. Came to know that the apartments have lovely amenities like swimming pool, intercom with WiFi connectivity, 100% power backup, club house, car parking and lots of other good facilities. I am really satisfied with the amenities provided by the builder. Moreover it is centrally located in the heart of Mumbai city with Dadar and Matunga railway stations just a stone throw away from the site. Being close to Mumbai airport and other places like Parel, Dadar and Mahim make this project an ideal option to buy.

Hi Ramesh, Heard that the flats come in 4 and 5 BHK units and there are no 1,2, or 3 BHKs available. It seems that price for 4 BHK is about 7.25 crore and has an area measuring approx 2900 sqft. 5 BHK comes with total area of 4000 sqft and it comes to about 10 crore.

The area for 1 BHK range from 700-735 sqft and costs approx 35.25-36.75 lakh. 2 BHK comes with an area measuring 980-1035 sqft and the price starts from 51.75 lakh onwards. Hi Chinmay, Accord Nidhi Strategically located at Malad West, Mumbai. It offers 2BHK residential flats in 1150 sq-ft where the price/sq-ft is Rs. 15650 that is cost around 1.8 crores. It is a G+18 storeys flats but all the units of this property have been sold out only 2BHK is available in resale option on 10th floor (of 18th floor)

Hi Prashant, Better, buyers do tend to check the reputation of a developer, before buying a property in their project, so it is natural for developers to be nervous about their online reputation. But, an easier way to regain the trust of the buyer would be through timely delivery of projects.

But it is not mentioned anywhere that what about the land in Rural areas ..Can someone explain a bit in the below words meaning ?
@Rajat, But remember this process will apply to those who are direct owners of the land. For those who have leased land from the government, the collector's permission is still required, though the conversion procedure has been made simpler for them as well. The leaseholder will have to offer a certain share of the profitable deal on the land to the government.

@Ramesk, It is not the matter of PMC, i guess any Agriculture land will be able to make na with out approval.. but they have to plan the pass from muncipal corporation...i dont knw something is missing from the news which is confusing.

I too wanted to invest in this project, but after reading all the comments, i diverted my mind. if this builder is fraud, then why dont you people approach the consumer forum.
Do you think Sapna sitting at home and online news will give you the exact idea of the projects, you need to check all specification, connectivity, amenities, approvals, civic issue and location advantages before investing or buying properties in any city and locality of India. Only a site visit can give you the clear picture of any project.

Builder claimed that money was to be paid to the BMC in the form of fungible FSI. They aren’t ready to give us any sort of documents, which only means something is wrong here. Hi, Several flat buyers, who have paid the builder for the flats, are in a similar situation, after the developer called them to his office and informed them that they would only be given possession of their dream homes after paying the additional charges. I have not paid any amount after paying my margin money. Have informed HDIL accordingly, Their sale representative said he knew the account so there is no issue. they have no legal right to ask us for payment as they are not furnishing the requisite papers.

Even in April' 7, after waiting for over three years to gain possession of their flats, home buyers have taken a top developer to task filing an FIR against senior executives of Housing Development and Infrastructure Limited (HDIL), for failing to give possession to people who bought flats in their Premier Residences project at Kurla (W), allegedly after taking full payment from them.

HI, 1 bhk in Adalia A/B block is actually 1 room/kitchen (open kitchen concept). I don't think that living room and/or bedroom has balcony either. Also, this 1 room kitchen has only one bathroom. It's not a master bedroom. Behind ADALIA A & B, and TAMARA Towers, there is pumping station for BMC sewage. So, before investment visit the project site and check it.HI, 1 bhk in Adalia A/B block is actually 1 room/kitchen (open kitchen concept). Hi all, It came to know that the builder has changed plans - the project will now start after 6 months. They are launching another project in Kanjur East - the idea is to have same configuration. Runwal has done significant changes to the project plan. Has the intent to sell 2500+ flats on a land parcel of less than 16 acres, this is a complete paradigm shift from the 1300+ flats which he could only build with the existing DP. Compared to original plan till Jun 2015.....the new plan has MORE THAN DOUBLE the number of flats in a slightly lesser area than original area due to the introduction of the BMC tower at the entrance. The Area where Tower 11 and 12 were supposed to come up is under litigation with the employees of the company M/s Wheelabrator Castings Alloys Ltd. Runwals have acquired this company to construct the Runwal forest project. Over 100+ group of buyers got together and began communicating their dissatisfaction of the changes that Runwal was making. Buyers aggrieved by the builder’s plans to construct double nos. of flats in the same parcel of lands (2500+ flats, as against 1322 as per the existing approved plans) have requested for cancellations (around 30+)
What a joke in the name of luxury premium project-: 1) Around 2500+ flats to be constructed including tower 11 to 12 on less than 16 acres of lands, 2) 3 Lift for 48 storeys building. Isn't sound good? 3) Builder want to extract the maximum benefits of additional FSI under the new DP. Nothing for home buyers. But still buyers are sticking with the project.

I have seen the flat. It has a pretty decent location - on LBS but quite close to both JVLR and Eastern express highway. That particular patch of LBS is far better than other societies in Kanjurmarg or Bhandup like Neptune or Mahindra Splendor.

Do you know Ashish this move has to be regarded as a milestone for the housing sector as every stakeholder of the industry is sure to get benefited. Currently, taking 10.50% as an average interest rate on housing loan, EMI on admissible loan value of Rs. 6 lakh for a15 year loan duration comes out to be Rs. 6632 for each month. Now with the cabinet approving on the credit linked subsidy to 6.50%, the monthly EMIs come down to Rs. 4050 thereby, offering a saving of Rs. 2582/month.

Even i read the news and found that the Housing activist has criticize the state government and said the plan was part of its liberalization agenda. It does not mean that families occupying larger flats are not necessarily wealthy.
As per land lord, the amount which they are getting as a rent is not sufficient to the repair and maintain their properties but as per the housing experts most landlords had themselves bought these properties for a few lakhs of rupees decades ago.

The increasing demand for luxury and ultra-luxury projects is a good opportunity for builders and developers providing to that area. If we talk about the locality threats then high prices are a threat to the area's realty growth as demand for affordable housing is increasing. At the same time limited land availability is another threat that may slow down further growth of the area.

Gud evening everybody, My question is that why residential projects can fly in BKC in the coming days?
Connecting areas such as Kurla, Kalina and Bandra-East (Non-BKC) which do not offer home buyers options of luxury residences, as a result, the nature of demand for houses in BKC will be mostly conscious in nature. The above mentioned non-BKC areas are largely populated by low to middle income groups so in spite of being a stone's throw away from BKC, these locations are impossible to cause a risk (in price points) to projects that are launched in BKC area.

Hi Ashish, Application fee of Rs 28/sq-mtr of plot/built up area whichever is larger for residential projects. The building company submits an application form with plans and all required documents, as prescribed by Section 373 of the BMC Act, at the Andheri Building Proposal Office of the BMC. If all documents are in order and the file is complete, the building company can proceed to payment of the scrutiny fees. Once the fees have been paid, the application file is forwarded to the concerned officer in the Building Proposal Department. Then the file is forwarded to the Survey Office, which make its remarks on the application file and check the remarks from the Development Plan office. If the Survey Office is satisfied with its review,it will send the application file back to the Building Proposal Department within 1 week.

Hi Bulbul, I think, due to the uncertainty in the development plan, the authorities stopped giving any approvals, and we had to hold back on some launches behind it. It is very unfortunate to see these delays.
Right Avi, 2 months after announcing a proposal to relieve the city's 24 yrs old Floor Space Index rules to accommodate taller buildings, the local administration discarded the plan, leaving developers in a uncertainty.

@Rohan Roy, The expected date of possession for Neptune 100 above is June,2018 whereas, Neptune Triveni is giving it's possession in December'2017. Ambevali locality is good for residential and has mostly mid segment buyers..... the place has easy access to Kalyan, thane and Navi mumbai.. its is quite well connected to the industrial and commercial hubs..Planned roads, rapid urbanization and huge development have collectively made Ambivali worthy of investment. Buyers can find plenty of new real estate projects in Ambivali.

As both the localities situated at a distance of 108 and 120 kms respectively from Mumbai. Comparatively Palghar is a growing market where rates are still reasonable and investment will bear good returns in the future. I think there is a chance of good negotiation, because the real estate sales are not good last two years and builder are giving huge discounts in their property. So, anywhere around 2600-2650 will be a good buy. If you are seriously looking forward to buy the property and want to get a good deal, then do not show your eagerness to buy. Hide that over enthusiastic and needy person inside you. Hide your temptation and do not show that you are dying to buy the property.

Hi Navneet, Some of these points are tricks played by agents, and some points are suggestions on what you should do when you meet a builder, broker, agent or sales executive who is showing you or explaining about a project. Here are some suggestion and tricks:- 1) They create artificial scarcity and try to rush you, 2) Don't show the eagerness to buy, 3) do not do any booking only on the basis of the brochure, some presentation or looking at a sample flat, 4) don't feel shy about asking legal documents, 5) Say that you are seeing other nearby projects as well, 6) Dont be tempted with awesome deals and discounts, they are well designed, 7) Ask which all banks have approved the project, 8) Don't get over obsessed with the upcoming infrastructure.

It's a good thought Anup, if implement ......."Thoda Khaye But Achcha Khaye" .....Govt. should think over this policy first.... If we look at the list of cities which have been selected as smart city, many of them would already have annual municipal budgets running into multiple times of this figure. On the other hand, there are few states which have shown doubt for implementing the scheme and if there is not enough support from them in terms of funding and administrative help, it would be difficult to take this scheme to its reasonable result.

Yes, the AAI has restricted building height to make sure a clear way for flights and emergency landing after take-off. Builders must get an NOC from the AAI before they can start construction. But there is some good news for builders, the AAI has raised the cap in some parts of the city. The height restriction around Chembur monorail station, Kurla, Govandi, Mankhurd, Chunabhatti and GTB has been raised to 50 mt from 30 mt.

Hey folks, BMC and AAI will combine their software based on the map. This will allow any builder to find out the building height limit of their area online without having to run to an authority for details. This map will simplify the process and control corruption. The common man can also understand the height restriction of buildings in their area after considering the map.
Right Abhi, For that the Airport Authority of India has prepared a colour-coded map for the city based on the flight path and the emergency route with 5 divisions. If one goes by the colour codes, the south Mumbai, Dadar-Parel and Borivli-Dahisar belts show the highest potential for tall buildings.

Hi Dipesh, You are equally responsible for that. It was not a matter of Rs. 100 or 1000. You were going to invest lakhs of rupees which you have saved for your future. If you have checked all the legal approvals such as IOD and CC, have read the agreement and verified it before buying property then you will be in a safe hand today.
Did you talk to the builder recently? Visit their office and find out the delay reason. If you are not getting proper response then file a case in Consumer Redressal Forum for deficiency of service with the interest from the time of making payment.

Yes, you should stay away from such project otherwise you have to face a lot of difficulties instead of comfort. A builder commit a lot's of fake promises before agreement but once you have finished the agreement process. They will never try to know whether you are living in a rented flat and paying a huge amount for your home loan.

According to me, any area which is close to daily basic necessities such as nearby schools/colleges, banks/ATMs, bus stop, railway station, markets/malls, eating outs is good for investment as well as for end use. If you find that all those basic facilities are nearby to the project site, just go ahead. Q: Nearly a month after nine people died in a fire in a residential structure illegally converted into a chemist's shop at Juhu Galli in Andheri, the BMC is still to take action against 129 such structures in Aram Nagar, Versova. This despite a Bombay high court order to take action against such illegal structures. TOI firsted reported about the illegal structures in its edition dated June 14. An NGO, Disha, which had surveyed the area, had gone to court over the issue. It claimed that there were 129 residential structures converted into commercial. Mehmood Shaikh of the NGO said, "After the nine deaths in a small illegal shop in Juhu galli, is BMC waiting for a similar incident to happen in Versova where hundreds of lives are at high risk? In case of any eventuality, BMC's K-West ward and the fire brigade should be held responsible." Shiv Sena MP Gajanan Kirtikar has written to the BMC, demanding razing of the illegal construction and extensions in Aaram Nagar. Citing a Bombay high court order of December 21, 2015, Kirtikar said that the court had directed BMC to raze illegal structures in Mhada colony, but added that the BMC had failed to implement it. His letter mentions: "There are illegal bars, restaurants, pubs and other immoral businesses being conducted in the area... There are illegal film studios running there as well which cause inconvenience to citizens." Assistant municipal commissioner Parag Masurkar told TOI that there 354 such structues in Aram Nagar, of which 280 have been issued notices. "Demolition is on. Every month we demolish a few structures in the area," he said.

I think the commissioner's decision is right.Anything that is danger to the human lives there has to be removed.
But at the same time, i want to ask the BMC that how did they approved the plan for construction earlier if it is illegal construction now? They should stop the construction in the beginning. What will happen to those residents who has spend there hard earned money on construction of their houses? Some residents have managed to get the court to stay demolition on their homes. For the rest, it is a matter of when the bulldozer will come home.

Right Shrikant!! This project is going to developed in Pokhran Road, Thane. And we all know that Thane is an excellent location as population, residential and constructions. If one is really planning to buy home in Mumbai no other best choice will be than Thane. Hi, It is required to ask for a future date pre-closure statement. After that a cheque has to be signed for that particular amount and thus the closing of your loan will be done successfully. Hello Hamsika!! When you rent a house, you don't sign a lease agreement. What is usually signed is a leave and license agreement. Why? Because this suits the property owner as it gives few rights to the tenant. This agreement grants permission to reside within premises, for the duration defined in the agreement, without granting the licensee any stake or interest in the property.

Well Hamiska!! The reason apartments/flats are often licensed for 11 months is that it allows the licensor to remove or vacate the tenant with minimum notice, as the Rent Control Act (which favours tenants) doesn't apply to agreements of less than 12 months. This notice period will be stated in the contract and is usually agreed upon by both parties.

Q: I am planning to construct a residential project for my family where the plot area would be more than 500 sq. mtrs. and number of units would be more than 8 but these units are not for sale to anybody or to public In this scenario do I need to apply for RERA registration? Because I understand the main purpose of RERA is to protect the allotees (home buyers) from the malpractice of the builders but in my case since I do not intend to sale the units the buyer would not come in picture.

Yes, and it should be noted that Property tax is charged in Mumbai based on the construction of a property, its location, the age of construction and carpet area. Earlier, the built-up area of a property was considered as one of the key components of measuring property value in Mumbai. But, recently, the Brihanmumbai Municipal Corporation revised the parameter of calculating property tax and includes carpet area as one of the key components of calculating your property tax. This new rule will remain effective for the coming next five years with effect from 1st April, 2015.

Q: If the builder has not mentioned the date of possession in written on allotment letter or on agreement then what is the clause or RERA rule to protect the rights of the flat buyer? Is there a compulsory defined period that is taken in consideration in RERA if the date of possession is not mentioned in writing? I have booked a 1BHK flat in August 2010 and the builder committed verbaly that the possession will be given in Dec 2013. It is still pending. This property is located in Mira Road, Mumbai.

As the RERA has come into force from May 2017. So, your property will be considered an old one and you can complain to MAHARERA Authority about your project and delay. I am sure, your state RERA authority will force the builder to complete the project and pay the compensation.
Yes, in case the builder defaults and delays the possession of the property as per the 'agreement of sale', the buyer has the right to claim the refund of the amount paid along with interest. Even in the case, the promoter's registration is canceled, the buyer will have the right to a refund.

The only positive thing is that they have got the MAHARERA Registration number for all their towers but not sure when are they giving possession of those towers. Hello Riya Do your own due diligence before investing in any project anywhere. Ask for all the legal approvals, verify it by a legal expert, visit the project site, check the approaching road, daily basic amenities from the project site and then go for it. There are many negative reviews against the builder and its project.

Q: My father has passed away and we are 3 females in the house. We are staying in ground floor. There is septic tank behind my toilet. which is covered from all the side. The only way to go there is from terrece . There is rod stairs which goes down there. Before, this was not the issue. But after my dad died they are saying we can make anyone cleaning it. You can call for a society meeting and raise your voice. If the secretory of the society is not taking proper action, you can make a complain to your ward commissioner and explain them your issue. I hope they will resolve your issue soon.
Yes, you can deduct the amount from the maintenance charges and then then pay the rest amount. That septic tank is for entire building members so, you do not need to pay every time. If your society is not taking any proper action then file an FIR against those who are fighting with you.
