Q: Has anybody got the latest update on the project. I don't think the Project is in good state. Everytime I visited the site, new story has been narated to me by the officials for the delays and the new schdule. I think it is time that the owners should have a word with the DB officials. As it seems we all owners have taken things for granted. No doubt today the DB Relaty share price would go down, on fridays news of Etisalte want to proceed with legal action aganist Swan Telecome. Why we owners has to take all these issue on our property, have we thought these things at the time of purchase. I strongly suggest we should come together and meet the officials with deadlines. If we don't do this, I don't think project will complete even by 2015.

@Abhijit, This is actually Rs 1000 sq-ft extra as development charges,something new invented by DB Realty to cover their cost, because project has been delayed,this is new way of extorting money from the buyers.

@ Abhishek, Governments impose property taxes on homeowners to finance country and municipal costs. Property taxes pay for police, banking staff, municipal workers and staff, govt. doctors & Nurses, medicine and fire personnel. It helps in public schools and utility services as well. Our municipal or government has a big stake in collecting homeowners' taxes so it can meet its budget. If you can't pay your taxes, the government will come after you. You may lose your home.

HI all, This Project is situated at an important location in Bhandup West. It is in close proximity to Neptune Magnet Mall, Off L.B.S Marg, Bhandup West. Other nearby facilities and landmarks include 2 km from Powai, 2.5 km from the Eastern Express Highway, 10 km from the International airport, Bhandup West, Mumbai., etc.
Hi Shantanu, Currently, the construction work is on progress and expected to be complete by December'2017. The current residential property rate in the locality is between Rs. 13500-14300/sq-ft. This locality is good for investment and end use both as the infrastructure development is happening so investing here will give you a good return in 3-5 years of time period.

Hi Karan, occupancy certificate should be given once the flat is ready for possession.. But before that the developer should have obtained Completion Certificate. Hi guys, We are very close to achieve amended bill which has several penalties clause for the builders. As per the current news, the Parliamentary Select Committee for the Real Estate (Regulation and Development) Bill 2013 is likely to push for more strict clauses that may lead to imprisonment of builders if they do not fulfill their obligations to home-buyers.
Hi Shantanu, If it is true then it will certainly help a lot to the home buyers because financial penalties alone won't work since private developers will simply factor in the cost of these penalties in their projects and pass it on to home-buyers.

Yes Balwinder, And if there will be any important change from the original schedule, specifications or structural design in what is finally delivered to home-buyers is considered as a breach of obligation by the builder.

Q: its totally blunder project, still higher floor construction is going, while we booked it was said that possession will be in 2010, and all slums will be cleared but i don t think it will happen till 2016..2017. it is covered from all sides by slums and sra building is just 8 feet adjacent to evershine cosmic. sra building people will be viewer for swimming pool users. hope all slums will clear, as its very difficult to get through entrance which is covered by all slum tapori over there, its really difficult to stay there till slums are cleared. we have decided to give the flat on rent whenever we get the possession.

I agree with Shrikant.. They can not reveal the features after you pay your first amount.. If OC is not given then you might face trouble in the future like getting home loan.. Not just lodha I believe it is the case with almost all the builders, they are delaying projects and we suffer the consequences. There are not many properties with 3 BHK and beyond in Govandi. The area of a 1 BHK house ranges from 600 - 750 sq-ft while the area of a 1 BHK apartment may be between 520 - 650 sq-ft. The area of a 2/3 BHK house is in the range of 950 – 1,100 sq-ft while for an apartment, it may be between 850 - 1,700 sq-ft.

This is because, with limited parking space, the developer has no incentive to maximize supply of parking slots. This is a big issues... i am also looked into the matter and realized that in several of these locations, there was barely any social infrastructure like schools, markets, hospitals and restaurants. Some projects are located 8-10 km from the nearest railway station. Hence how do you expect to go and stay there?
There are numbers of projects thats are scraped due to this issue.. Mumbai need to accelerate fast in terms of infrastructural development.

Q: What happen to Mumbai real estate? Why it has seen the lowest sales registration?

Mumbai saw the least property sales registrations this September in the last 45 months since 2010. The total property sales registered from September 2012 till September this year fell by 8.6% on a year-on-year basis, to approximately 4,100 registrations.
There are three primary factors that affected the customer sentiments which led to fall of sales registrations. The first one is the fall in the country's GDP. The country's GDP growth was just 4.4% in the second quarter of this year, the slowest since the first quarter of 2009. The country saw a loss of about 2 lakh jobs across different sectors in the last 6-12 months according to a dipstick survey conducted by Financial Express in September. The slow economy has created fewer jobs. Fear of job loss has shown an impact on sales registrations. According to Naredco (National Real Estate Development Council) officials, Mumbai may see a 5-10% change in registrations either in a positive or negative direction. The second reason for the fall in sales registrations is the fall in the value of rupee. The rupee value fell non-stop since April and stopped only at the end of August. In fact, rupee slipped by about 46% in the last two years to hit an all time low of Rs. 68 against the US dollar in August. The RBI has now taken some steps to stop the further falling of rupee. But the fall in rupee already affected customer sentiments.

Well Mr Modi, The specifications include aluminium sliding windows, concealed wiring, false ceilings and pop finished walls. Looks to me this is a decent locality to buy a property for living or for future investment. Since the city of Mumbai is already choking with traffic, pollution and high rentals, this is an ideal place to invest in Thane west as the rates are still competitive and affordable.

Hi Sankalp, I thought I could get a 1 or 2 BHK flat in this project and proudly say that I owe a property in Hiranandani Estate Cardinal with my head high.
Ha Ha Ha. Even I came across that Hiranandani Estate Cardinal has no units available in 1 and 2 BHK. But they have only 3 BHK flats having a big area measuring 1000 sqft onwards. I think they should have targeted mid range units too to attract potential mid income buyers.

Hello Sankalp, As there is little supply coming in the market, any correction in prices looks difficult. This is the best time to drive back home a bargain and also look for a good choice of property. Since many projects are coming up in Ghodbunder Road, the buyers have lot of options and preference to choose the project as per their requirements and budget.

Right Sir, Home Loan hidden charges is a dull area & there are no clear cut rules regarding same. In India, transparency takes a back seat and regulatory bodies are also turning blind eye towards Home Loan hidden charges.
Shreya is absolutely right, There is no standard definition of home loan hidden charges as banks keep moulding the definitions as per their convenience. Here are the list of hidden charges asked by the bank upon their loan, These are Conversion Fees, MODT Charges, Document Retrieval Charges, Administrative Charges, Legal Fees, Valuation Fees, Inspection Fees, Documentation Charges, Switching Loan Package, Recovery Charges, Pre-Payment Charges and Late Payment Charges.

Hi Vineet, Also came to know that Lodha Group is planning to launch its Phase 2 which has residential, commercial and social infrastructure such as schools, colleges and hospitals. The land allotted for this project is 800 acres and consists of 800 residential towers.
Hello Praveen, Even came to know that they are planning to construct 2 million sqft of commercial space which has received good response from many IT, ITES, financial and banking sectors. Hi Praveen, In fact came to know that the Mulund dumping yard is much further away from Ashwa Platinum and this will not have any negative impact on the residents booking a flat in this project. The flats do not have any water issues as it has connection of municipal supply as well as bore water. All the drains are being covered with concrete slabs.

When i checked with them for the last time. The Customer relationship officer gave me a whole new story... "If you pay us remaining value(out of the loan) we will complete it and deliver the flat within 3 months.". I am planning to consult a Legal adviser for my chances. Any suggestion? Hi, In fact in Kalyan the demand is mostly seen by end-users. Kalyan is away from the hustle-bustle of Mumbai, thus, it is preferred most by buyers sitting at mid- level designations like executives and managers. The affordability attracts people who are working in commercial establishments, not only in Thane and Mulund but also in Powai.

Kalyan is a well established locality, while Panvel still needs infrastructure development. Kalyan is not only connected locally but also to major cities such as Pune, Delhi and Bangalore. Hi Praveen, Looks like you too are in the same page by booking a flat in Shagun White Woods. There is no water supply in this locality or in this flats since one will get 24 hrs water from Navi Mumbai Muncipal Council. Moreover the flats also have bore water which are very much sufficient to meet the requirements on daily basis.

Hello Abhi, As per the recent show cause all property owners must have a Occupancy Certificate which the Govt has made it mandatory. Occupying a property without an OC is termed illegal and you may be penalized for not having the OC. Mostly the OC will be given by the builder himself at the time of occupying the property. Most probably you need to pay tax once you have taken the possession of the property.

Hey Praveen, Called up the marketing executive and learnt that the project has been duly approved by CIDCO. The project is coming up in the close proximity to Mumbai-Pune Expressway. It is also easily approachable via Uran Road. Panvel Junction is hardly few kms and one can also take the Panvel-Matheran Road to reach the project site.

The property price in kondhwa as well as its nearby locality is Rs. 4000/sq.ft. Hi all, You are absolutely right but these factors are not the same while buy a new property and resale. For example when we buy a new property or looking for investment we ask for the location advantages, basic facilities and the connectivity of the project then only we decide whether we should buy and invest here or not.
Well said, Then comes Budget, it was considered to be the second most crucial factor while buying a resale property. There are higher chances of negotiations in resale property.

Well, The residents are saying that BMC has done nothing to escape them from being homeless. They are very surprised that no one is paying attention towards their complaint. Chief Minister Prithviraj Chavan and municipal commissioner Sitaram Kunte have totaly different opinion on the Campa Cola dispute. While Chavan has told the residents that he will take up the demands in the assembly.

Well i was told that all approvals and related paperwork's are in place and a 1 bhks of 550 sqft is available from Rs 75 lakhs onwards .. there are also 2 bhks of 800 sqft and above...

Hi, A 2BHK flat in Virar which offers possession in next 2 to 3 years will cost you around Rs 25-30 lakh. The size of the flat is starting from 700-900 sq-ft. As far as the infrastructure is concerned, the area has everything in the vicinity. Schools, hospitals, banks, grocery stores. Moreover Virar does not have water shortages as three rivers Tansa, Vaitarna and Surya, flow via Virar. It is also close to Western Express Highway (5 km) and Virar Railway Station which adds advantages to the location.
But which is best option plot or residential property and in which place of mumbai? If residential then which one is better under construction or ready to move?

Products and services by builder are covered under the Consumer Protection Act. If you have grievance against builder, send a notice to him in writing. Do not worry if he refuses to accept your notice as only proof of sending is required. Hi Guys, I have a property in Premier Exotica Kurla Building 3 and am now being asked to pay 3rd installment as well as register the flat. got a letter dated 1st nov. i also got a similar demand notice in oct for which ive paid the installment. They have along with their demad notice attached a letter from Bidco Engineering Division (bandra East) which mentions that construction work of specific property has been completed upto 2nd floor Slab. Should i make the payment and register the flat/document.? What documents should i be asking from them? Can there be a interest payable by them for the construction delay? can they levy a penalty of 21% p.a (as per their letter) on us for delaying payment of installments ? Will appreciate all the help
Hi Ganesh, However, as a real estate buyer, one needs to know when you are bound to pay these charges and when you should not:- Under two circumstances the developer has the right to charge escalation cost from the buyer. Firstly, if the developer improves the specifications of the unit or adds better amenities during the course of construction he can charge the additional cost with proper notice to the buyer. And secondly, if during the course of construction, the cost of construction increases by more than 10-15%, the developers can charge an additional cost provided this clause is mentioned in the agreement. Thus, it is imperative for the buyer to read the document carefully before buying.

When you are planning to buy any property, first and foremost thing is to check down the title deed of that property. The property title deed is the legal document which proves the ownership of property. You should make sure through the title deed that the property is in the name of solely a seller and no one else is and he has all rights to sell it. The best practice is to get reviewed the property deed by an expert lawyer just to make sure that there are no loop holes.

Yes, you should go for the registration but before that make sure that all the legal approvals are in place. There should not be any land dispute. If you have already paid the 3rd installment, then you must have the payment copy. Present that copy to the builder's office ask to rectify it for further inconvenience.

Hi Ashish, Lower Parel is a prime commercial business centre in south Mumbai. It is also called Upper Worli. The property prices in the locality range between Rs 30000 to 33000/sq-ft. Prime location and the Worli Sea Link make Lower Parel one of the most sought-after areas in Mumbai. Good connectivity with other parts of Mumbai, improved infrastructure adds value to the investments made by the rich.

Hi, You can fetch excellent returns in 1-2bhk flats on Ghodbunder Road which should be located close to the Thane West. General understanding is to hold a property for atleast 3-5yrs to fetch excellent returns.

Some educational institutes include Konkan Gyanpeeth College of Engineering, Asian Institute of Communication and Research AICAR Business School, Dhirubhai Ambani School Lodhivali, Engineering Institute of Bhivpuri, Christian Bible College, Vishwanagar, HOC Pillai International School, Agricultural College, L & T Construction Skills Training Institute, Medicinal Plants Institute and many more. A part of area in Karjat-Khopoli belt is being developed as a recreation hub by MMRDA. Q: Dear Sir We stayed in an apt in Goregaon on rent (Bangur Ngr, Mumbai) from Jan 2013- Aug 2014. While leaving the apt the owner refused to pay us the 20 k from the 1 lakh deposit. He cited the following deductions.Rs 10,200 for car parking, Rs 3500/- for AC repairing, 2665/- rent towards additional days. and the rest towards gas and electricity bill. While we agree for expenses towards rental, light, the contract doesnt mention the expenses to be paid for parking. The AC which was repaired while we moved in broke down within a month as it was already an old one. Also the breakdown is due to internal technical issues and not external. We have not used the pipeline gas connnection and hence we are not eligible for the payment. The contract also has not mentioned anything on the same. The owner have been totally harrowing us since the time we have shifted to his house as that house was full of leakage and he never bothered to rectify the issue. In addition he is now refusing to return our money which we believe is our due. Request your help.

Hi, If you are looking for a property in Andheri West, Mumbai then go for a under construction properties as these kind of properties are little cheaper than ready possessions. Hi, Things to ask to Builder before buying property:- 1) Title clear papers for property on which flats are built. 2) Completion Certificate which is required during registration and stamp duty process and also during resale in some cases. 3) Check if the property has Occupancy Certificate with builder, If not what are the reasons. Common reasons being the FSI of that property used in some other constructions. 4) Ask for the funding banks like HDFC, ICICI BANK, GIC etc are already tied up with builder it is a good sign of saving yourself from non well known and fraud builders. 5) Ask for sample flat and building plan. Also ask and see the floor plan that gives the idea about surrounding and spacing. 6) Ask for additional charges above the charges they show to you like any legal fees, parking fees etc which sometimes is not said in first meetings. Right Saurav, If Salt Pan lands in suburban areas are allowed to change in usage, can be used for creation of low cost housing for LIG and EWC segments. It definitely has the possibilities to affect availability of land for real estate development, but just by itself it may not be enough.
The new policies that have been talked about and discussed earlier, be it the new housing policy for Maharashtra or new norms from the BMC, or even schemes like "100 smart cities" and "housing for all", these should have a positive impact on land availability and usage for real estate in Mumbai if applied it properly.

Hi all, Maharashtra government is scrapping of the Mumbai Development plan. Do you know the result of it? It may put the realty market into more mess, with deals for land deals, redevelopment projects and even private equity transactions for financing these projects in Mumbai getting stuck due to absence of clearness on the city's proposed development plan.
It will effect many of the city's projects have been in stuck since February when the Municipal Corporation of Greater Mumbai declared the new Development Plan 2034. After getting huge complaints for large number of mistakes in the recommended plan, making the state government to discard it on Tuesday. It has also asked the civic body to modify it in 4 months.

There are lot's of things which we have to think on it. Social worker Anna Hazare directed the disappointment at Jantar Mantar against the proposed Act while the whole opponent as well as alliance partners of the NDA, including Shiv Sena and Swabhimani Shetkari Sanghatana, have opposed the new bill by terming it as anti-farmer.

Yes, the delay in passing of this bill has had an effect on the state's solar policy, which is also going through changes commensurate with the land acquisition bill. As per the Minister for power Chandrashekhar Bawankule, had declared that he would be making the solar policy public on February 24, but could not do so since the passing of land acquisition bill in he Parliament was important for the same.

Hello Deepti, No, i have not booked any but planning to book. I have inquired about this project and came to know that the price of 1BHK in 590 sq-ft will be Rs. 30 lacs including stamp duty and registration charges. the current asking rate is Rs. 4800/sq-ft. but it is negotiable.

Well as per their sales guy, the project is near to completion and they will hand over the project till November'2015. The booking price will be Rs. 151000 and rest of the amount equal to 20% have to pay within 45 days.

Yes, Dream Sai Elegance is a CIDCO approved project and all the necessary approvals are in place. All the leading banks and financial institutions such as SBI, Axis etc. have approved this project. As far as transport system is concerned, The chief modes of transport in the locality are buses and auto-rickshaws but there are very few of them. The Navi Mumbai Municipal Transport (NMMT) runs bus services from Vashi, Nerul, Kharghar, Uran and Belapur to Ulwe.

For example, if the applicant is 45 years of age and is set to retire at 60 years, the maximum loan tenure available will be 15 years. Also, in case a bank has a 75-year age limit for a co-applicant, if the applicant is 40 years old and the co-applicant is 60 years old, the home loan will be sanctioned for a maximum period of 15 years only. Better, transfered the property into your name and then go for home loan. Again it depends on your income. Thanks Ashsish & Deepankar for replying. Will i or my parents incur any tax liability(Gift Tax/LTCG) apart from stamping & registration cost for gift deed. Also instead of transferring the property now in my name can my name be added while making redevelopment agreement with builder (as the builder will make an agreement with us for free area and extra area to be purchased). A gift deed needs to be stamped and registered only then it is effective. In case of a will, no stamp duty is required and registration is optional. However, after the death of the testator, the beneficiary will have to procure a probate of the will.

Good Morning!!!! As far as builder is concerned, Oyster Living is a well known developer in Mumbai. They have successfully completed 5 projects. But you can not rely on the basis of their completed projects. I can only say that before buying properties in any locality or with any builder, check out all the necessary approvals, project connectivity, project location, basic amenities nearby and the infrastructural development of the locality. If the builders have required approvals then there will be no delay in possession. And if there is no delay in possession then there is no negative remarks on them.Good Morning!!!! Hi Shaunak, I don't have any proof for that but as per their marketing guys, carpet area of 2BHK is 791 sq-ft. whereas for 3BHK, it is 807 sq-ft. Yes, they are quoting Rs.63/sq-ft. as floor rise charges applicable from Ist floor.

Hi, is near to Navi Mumbai and is gradually developing both residentially and commercially. The locality comes under CIDCO and is most preferred location to live after Vashi as it has attracted many buyers as well as builders. Factors like proposed International Airport and Metro connectivity have left a strong impact on the land rates in Ulwe in recent times. According to me Ulwe seems to be an ideal place to invest in a property taking into consideration all the factors.
I am agree with Ravi. It is just 6 miles from Panvel and close proximity from Kharghar and Vashi it is turning out to be one of the fastest emerging locality in this part of the Mumbai city. With good connectivity by road , rail and sea, Ulwe definitely has more scope for property appreciation in coming years.

Yes, If you are buying an under-construction property, you must go through the approved sanction plan, IOD and commencement certificate issued by the municipal corporation. Again, the key is to establish whether the builder has clear ownership of the land on which the project is taking shape. 'An agreement between the builder and the original owner is not sufficient. The project also needs to have an IOD. This is a set of instructions that a developer needs to comply with so that he can legally construct the project. It is valid for one year and needs to be reissued if the project has not been completed in a year's time

Hi Nita, Did you sign the agreement? What is the clause indicating. Mostly, all the clause are in favor of builders and very few for the benefit of buyers/consumers. So, first check your agreement if it is in your favor then send a mail to the builder asking for refund of money. If you are not getting any response then hire a good legal expert to proceed further.
I am agree with Rakshit. Your booking of the flat is outcome of a contract, with the builder. So, both of you are bound by the terms of contract. You cannot go against the contract and having paid the money, you cannot hope that the builder will return it as the contract is in his favor. Further, the contract is signed and you have made payment in acceptance of the contract. Hence, repudiation is difficult. But still i can advice you to visit the builders office and and ask for the delay refund.

But if there is not a will then according to Hindu Law, both widow and Son have right to get property according to Hindu Law. Widow can claim share in her husband self acquired property while Son has right to get share in both kind of property ancestral and self acquired. You can file suit for Partition for claiming your right in property. Q: I am looking to buy a new ready-to-move property at a maxed out budget of 55L for personal use. Which would be a better option, already developed GB road or bigger flat in yet to be developed Shilphata? I have an eye on Dosti Planet North which should be completing in near future. However earlier post suggest that it was supposed to be handed over by 2015, which is apparently not happened. I am not sure about which scheme to go for in GB road as bigger names have a high premium like the Lodha Amara 1bhk would go beyong 75L.

Hi Sunil, The area is well established and divided between Kandivali East and West. The property price of a 1BHK unit ranges from Rs 75 lakh – Rs 1 crore and more. Locality of Kandivali is good for recurring income but not good for price appreciation over the next few years considering the fact that it has already reached price saturation point. It is an industrial hub with presence of several renowned companies such as Mahindra and Tata Steel, Therefore, rental demand is strong here. The cost of 1 BHK flat in Kandivli East & West are almost same. Rs.15000-25000/sq-ft.

Good evening David!! In terms of premium, L&T is miles ahead from Mahindra. Though further from Western Express Highway, L&T still is fasr better. Mahindra Vivante has a location advantage, but is a non- starter for me. I would travel 20 mins more to stay in a better house. So, for me LNT Emerald Isle will be a good option for you. Thnks

Hello Mitesh, Yes, this project is supposed to handover by December 2017 but still, construction work is going on. I contact the builder office for the delay and I did not get the satisfactory reply from them. Q: The RWA in Orchid island society is one of the most inefficent and most ineffective body.They resort to cohersion to collect welfare funds from the tenants.If you are shifting from the complex they force you to pay Rs 2500 as welfare fund, and if you dont pay they do not allow your truck to move out of the complex. These laws are unilaterally passed by few members, without the knowldge of other members of the society.This practice of charging transfer fee is against the law, and should be stopped immidiately..Otherwise time will come when you will find it difficult to find tenants and buyers.Their accounts to my knowldge are never audited.No one knows how this loot is being spent and on what?Elections have not been held since the last two years.

Q: I purchased a under construction property in Oct. 2018 from a reputed builder and had it registered in the first week of December. As per my discussions with the builder I was supposed to avail loan for the next phase of disbursement in the 2nd week of Jan, for which I had received a sanction in November. By late Dec. I had got paid around Rs 25k for franking and other loan related charges and luckily I was able to negotiate a favorable interest rate on my loan. A few days before the disbursement I was informed by the bank that the builder has not submitted the ROC and they cant proceed ahead. Following which I promptly informed the builders team about the issue and they agreed that the issue is from there end which they will resolve in a few days and also waive off the interest that the builder would have otherwise charged for delay in payment of the disbursement. The builder also assured me that this is normal so I should not worry. However, after around a month of my initial raising of the issue, the issue was not solved and was informed by the builders team that the issue from there end will take another 20 working days which means somewhere in March. The problem is my loan sanction ends in Feb and my banker has informed me that I will have to re do the entire loan sanction process if disbursement is not done in Feb. This means I will end up paying again 1) Processing fees 2) Loan documentation charges such as franking etc 3) Higher interest since the bank will not offer me the discounted interest once again (Please note here I am talking about the difference in spread over the reference rate, which means I am losing out significant amount in EMI all things considered). I have already notified the builder through email and asked them to either complete documentation before my end of the sanction or pay for all the above mentioned three costs since the delay is entirely from his end. Am I justified in my demand and what recourse can I take to ensure that I dont end up paying a significant amount in re sanctioning the loan again and higher interest rates for no fault of mine which the builder has also accepted? Should send a legal notice to the builder?
