I bought a resale flat in Jan-2011. The building was completed in Sep-2009 and had Occupancy certificate. Previous owner bought the flat from builder. Now Maharashtra govt has notified for VAT payment at 5% for the property built between 2006 to 2010.
I am not the person who bought the flat from builder, rather bought from the first owner. So in case builder demands, am I anyway liable to pay VAT?

Saffron City with developed bungalow plots, farm house plots, agricultural plots with roads, electricity, compound to plots. This project is situated near Kondhanpur on one side and Wangani on other side. It is at 35 km from Pune.
It was booked in this project offered by Saffron developers, Pune with the promise of handing over the plot in 2010 with well developed roads, electricity and water at the doors. Amol, property tax funds a wide range of services like the road maintenance, education and so on.. I have already paid 60 % of the flat cost and yet to avail bank loan.
As Iam not satisfied with the quality of construction , I wish to come out of this transaction.

The current buyers were promised completion in Feb 2013 end. But possession has not been given till date. Few people have started illegally occupying the flats. Builder has not yet obtained completion certificate. It is not clear whether the application has been rejected, or whether the application for the completion certificate was even made. The completion certificate is supposed to be issued by 'Hinjewadi Town Planning Authority' but the contact details of this organization are not clear.

As per the agreement the Apt should have been handed over by Dec 2012 considering all the grace periods of more than 6 months. The building has only reached 6th floor out of the 12. How many are such agreived parties? Can we join together and issue a notice to the builder?

and they said they will charge around 25 to 30 % of the property tax payable i.e. the tax payable is 7250/- so the charges are around 1812/- to 2175/-...
so I want to know is this the correct fees and also are the docs sufficient as I do not want to keep pacing between my place and the tax office...

I purchased a house in Wagholi, Pune in Oct 2011 (date of registration of the house) and got the possession in Jan 2012. All formalities, payments & documentation were completed before possession except the deed of apartment, which the builder (& broker) said will be done soon. After much persuasion, the said deed was given to us by the builder in July 2013. Now, in order to get the apartment deed registered, the builder is asking us to pay the change in stamp duty which taken place since the time we bought the house (stamp duty has changed from 2% to 5% since). My qs is why should we pay for the fault of the builder? the onus of the delay completely lies on the builder. What is the way out?

Hello Leeni, First check with the sales agreement if the builder has mentioned anywhere that if the delay is from their side they will give you some kind of compensation, if yes then you can sue him. Need not worry about this!!!!.You want to pay tax for current financial year?? What you can do is you can refer the property tax receipt that you had paid for previous year and you can come to know the property tax number. Or else visit the nearest office where you pay the property tax and tell the concerned officer about your tax details like your name, property address, locality, zone and he may further assist you with getting your property tax no. Occupancy Certificates is an essential requirement under the MOFA (Maharashtra Ownership Flat Act) and the buyers of the property cannot legally occupy unless the Occupancy Certificates is obtained by the Developer. In absence of Occupancy Certificate you will have to bear heavy penalties.

According to the Maharashtra Pollution Control Board it was decided to grant consent to establish for construction of residential project on total area of 19500 sq-mtrs. and total construction BUA of 46783.2 sq-mtrs subject to verification of stop work from SRO/RO, by imposing following conditions:
1) PP shall submit bank Gurantee of Rs. 5 lacs toward compliance of consent conditions.

The entire project is to be completed in 4 phases, Phase-1 has been successfully completed and Phase-II has been recently launched by the company. Thereafter, the remaining phases would be executed. After Sale Deed registration, the builder will ask you to move into flat without Occupancy Certificate. Once you complete interiors and move into your flat, you will start noticing problems like temporary electricity connection, leaking taps, patches in painting, Lift will not be working continuously, Incomplete parking lot, Drainage problems etc.Hi,

I am disappointed with delays in getting our home. Assured frustration. We are sick of empty promises, they guaranteed to give us possession by Dec 2014, and we took their word for it and now we are paying Rent and EMI. Uncertain about the possession date though given in writing which is farther then the verbal promises, In fact the date promised by a VP has also changed. Split AC, Modular Kitchen, and Hob and Chimney everything changed from as presented in sample flat at the time of booking. They are not open, ethical and transparent the customers. They have only one answer for any of you questions is a management decision we can not do anything. Careless in terms of documentation and need to follow-up many times. Construction is very slow and had stopped for months. And they have their golden rule to always adhere to timelines and commitments.

Hi, truly speaking this project is a very big project developed by the builder and project is constructed in phase wise. Right now phase 3 and 4 are open for booking. As per salesperson Phase 3 is going to complete in Dec 2016. No roads, light, water and other amenities. 75% of the plots in the scheme are demonized by old owner as he claimed. Meaning that there is some legal issue. Hi, I have got possession of my Flat on October 2013 and this year I have received property tax for 3 years (2013-2015).
I just wanted to know that when property tax started to calculate after getting the possession.
As per my understanding its started as soon as you received the possession and calculated on every 6 months. In my case I have received possession in month of October 2013 so for year 2013 my property tax should be for half year instead of full year? While as per tax bill they are charging full year (2013) of tax.

I urge my fellow common floor community members in Pune to be aware of person named baburao vhankol. Be careful while giving your flat on rent to this person. He stayed in my flat on rental basis in pune pimpri-chincwad corporation area for 4 months and did not pay any rent, he kept on giving payment commitments but never paid anything. Dear All please be aware of fraud builder Shiv Parvati builders also called as Natu Paranjape developers. We got possession in late Aug 2013 delayed by 3 years. Builder took 2.5 laks as infra charges for covered parking but last week some of us were handed over parking that does not have roof at all. While showcasing project we were promised garden swiming pool gym and what not. These things are not there after 6 years of project starting. Be careful with your purchase and agreement with this builder. Construction quality is cheap and non branded tiles are used for project.

Hi Arthi, I think you should take the permission of the municipal body for their non-agricultural plans. If the land was confirmed by occupancy right in the Land Tribunals As per Maharashtra act, Deputy Commissioner is the authority to issue conversion order. Long Term Capital Gain will be = 1500000 – 800000 = Rs. 700000
In order to get full exemption u/s 54 F he will have to invest the full sale consideration of Rs 1500000 in construction of a house property before 31st March, 2016 or purchase a new residential house property before 31st March, 2015.
