I am not getting cooperation from flat owner residing above me. He removed windows and doors of his flat for renovation and did not fix it back .Rain water accumulated in his bed room and leaked in my bedroom. One side wall and roof has fungus and discoloration. I have booked a 2 bhk flat in Revell Orchid Dhanori in April 2012.At the time of booking they informed me from 1st may stamp duty and govt. tax prices will increase, but if we book before 1st May increase will not valid for us. In the application form it was writen that I will be ok with the prices hike in govt taxes", but they informed this is a common application form format and the prices hike will not be valid for us. I paid 2 lakh booking and they informed within a month I have to pay more 6lakh,and then bank will pay as per loan. Now after month when I went for registration in May 2012, they are including prices hike and want me to pay 4 lakh extra.Now after a long mess and as they are not upto there words,I am cancelling the flat and want my complete booking amount back.They are not returning my complete amount and I need some legal or any help...If any one can please help to get right direction...it will be appreciated.

In order to encourage taxpayers, it has adopted a practice of giving concession to its tax payers. According to this rule, the property in question must be used for residential purposes. In other words, no kind of concession is applicable for a property if it is used for commercial purpose. And where this property is self-occupied, this concessional benefit is restricted to 40%. However, there are some concessions if you pay your property tax before a certain said date. Check if you are paying after that date. I bought a flat in June 2012. In december the Builder presented us with a bill for 3.75 lacs for water consumed during December 2011 to Dec 2012,when there was no existing PMC water connection till 26th of Dec.2012. My query to the builder about my not being liable for any expenses before June 2012, was not satisfactorily answered by the builder.And most important Can the builder use up the monies collected for maintenance expenses for water suppplied to flat owners in the absence of any water pipe cannections from the PMC.Is it not his responsibility since he took OC in Dec 2011 and allotted flats in DEC 2011. With the direction from the state government, the civic administration has asked the legal committee to not accept the proposal of increasing the rebate from 10 percent to 15 percent on annual ratable value of property tax and allow them to make bills considering 10 percent rebate for repair for existing properties in Pune.
Also, the PMC has been questioned on their assessment files carried out by them for 2006-07 to 2010-11. I am dealing with Jori builder for their buildin in Mann,Hinjewadi, Pune. I booked the flats in Jan 2012 and possession was promised in Oct 2013. Build has not given possession yet and explains many technical reasons and is demanding late fees now to pay. Which according to Agreement is 24 %. He is also telling me that I can cancel the flats and can take money back(Excluding interest paid by me since last April 2012. He is asking 5.5 Lac as late fees. He says that market prices has been increased now and I must pay extra money in terms of late fees. I asked him official letter of this demand. He is not sending the letter and not giving possession. Please GUIDE me in this case. I am not able to understand what to do in this Black mailing scenario...

They are cheaters. There is no swimming pool in the complex and there is no space left for the swimming pool. Play area and garden are one and the same, and is very inadequate for 100+ apartments. One of the two lifts for each building remains down most of the time. Lifts are of poor quality. Many incidences occurred where people were stuck in the lifts. Builder is very arrogant and does not ever look into your complaints.

I stay near to Dhanori and it is becoming very good society. Not sure about the Wagholi. I urge my fellow common floor community members in Pune to be aware of person named baburao vhankol. Be careful while giving your flat on rent to this person. He stayed in my flat on rental basis in pune pimpri-chincwad corporation area for 4 months and did not pay any rent, he kept on giving payment commitments but never paid anything. Instances like this seem to be increasing these days.

No, it doesn't come under Red Zone. I am also planning to book Flat in GK Royal Hills and i visited the Site it looks bit inside to me and other option i am looking for Arun Blu, Ravet, Pune. As Arun Blu, is on main road atleast rate wise not much difference only thing is that Arun Blu possession date will be in July'2017 but i doubt as GK has ready flats and still they are giving possession in June'2017.No, it doesn't come under Red Zone. Hillock towers reviews, hillock towers by artharaj realty, Somatane phata, Artharaj realty reviews is fraud/ cheat builder. I request all you to go through below points before making any advancement with this builder.
1. While booking flat he showed Hillock Towers Town planning approved plan of A&B wing, Also you can see B wing in model, brochure, internet etc. Now he is claiming that he is not getting B wing land as original owner is refusing to sell. At the time of booking flat he claimed to have that land.
2. Possession date committed for A-wing with amenities as Dec 2014 but yet there is no progress on that.
3. He wont give you approved Plan/ TP sanctioned plan / Parking layout etc with the agreement as he dont have it yet.other builders would give you it upfront.
4. Also he will not send / show you agreement copy in advance so that you could get hidden clauses. such as possession date after 30 months no exact date.
5. He will just take away your money and start another site with your money. we almost group of 40 people have paid 90% amount yet to get clarity on possession.
6. This builder has no good background Jaydeep/Ravi/Abhay no one would want to see you once you make agreement instead always buy from reputed builders.
7. If you don't believe go to site and ask him above questions and see the progress of Hillock towers which was suppose to be ready with amenities in Dec 2014.

It may not be possible for you to claim exemption under Section 54 of the Act as the residential house has to be purchased in the name of the assessee who is liable to pay tax on long-term capital arising on the transfer of a capital asset.According to the provisions of Section 64 of the Act any amount of income arising directly or indirectly to an assessee from an asset transferred to the spouse otherwise than for adequate consideration or in connection with an agreement to live apart shall be treated as assessee's income. In view thereof, payment to PMC on behalf of your wife would be hit by the aforesaid provisions and therefore, income arising from the apartment shall continue to be taxable as your income. In case only a part of the amount is paid, the clubbing provisions would be applicable to the extent of income arising on the amount so paid. It may not be possible for you to claim exemption under Section 54 of the Act as the residential house has to be purchased in the name of the assessee who is liable to pay tax on long-term capital arising on the transfer of a capital asset.

If you love your money don’t go with ARV group
My subject line itself state that your investment with ARV group will spoil your life, having an own home is a dream of many people but with this group your night will be sleepless.
The employee are so unprofessional, they just want your money, once it is paid they don’t even bother about your problems, your issues, your requests etc., they even disrespect laws and order written in property agreement. Their employee even don’t know how to talk to a customer who has owned a flat in their project and other side they are very good, welcoming to customers who come to see the site and who come for an enquiry to buy a flat LoL. I will rate zero to their customer satisfaction.
ARV group employees are trained in such a way to get money from your pocket as soon as possible and force you to do registration process ASAP so you get into their trap. Even you will face issues to get basic documents information that you may need before buying property like NOC, title certificate, sell deed, environmental clearance certificate, building/layout approval, master plan of the area, builder buyer agreement copy etc. They know how to fool people by making false commitments.
Another surprising thing you will never get a chance to meet directors Mr. Rahul Goyal and Mr. Akash Goyal with whom you are making agreement, this is a big funny thing. Even at the time of possession you will not get a chance to meet them.
Other thing ARV group flat size has a big % difference in its carpet area and sellable i.e. super built up area. They sell property on basis of super built up area like if they say, you have to pay 4200/- per sq. ft. on 1200 sq. ft. i.e. super built up area your flat livable area will be only 820 sq ft. including terrace i.e. carpet area of your flat., its approx. 32% margin between what you get and on which you pay to the builder. The rest amount they take for amenities and common area, this margin seems more as compare to other good, reputed builders available in market.
If they walk with customer and help with their open hand, good customer service then definitely they can become a top builder among others. For this they should remove unprofessional, cheat people from their group.

I am not sure on what basis all these builders are charging us but 30 to 35% of loading an extra Rs 4-5 lakh in the name of Infra charges. On top of this, the Pune public is madly booking these flats and agreeing to any demand from builders knowing the water issue in the locality.
I think Shagun Perfect 10 has 40% loading which is very high side.I am not sure on what basis all these builders are charging us but 30 to 35% of loading an extra Rs 4-5 lakh in the name of Infra charges. I would like to suggest you, visit the project site before booking your dream home in it. See the approach road, transport facilities, connectivity, water, and electricity facilities and then go for it.

As the property was in Builders name property tax levied on my flat was 10k .
In same society other flats got a bill of 6k (private owners).
I asked the builder to pay the taxes for Jan-Aug (possession) he delayed and again next year bill was 10k due to commercial owner(40% extra).
He is refusing to transfer the property in my name and asking i get it transferred myself.
this way instead of 6+6+6 (for 3 years) i got property bill of 10+10+10 for 3 years.
Can i pay the property tax myself then get the name transferred and file a consumer case for refund from builder ?

You can do it urself. There are a few steps which will give you an idea if there are any areas you want to pay for the special attention. These include
Foundation - Look at the base of the wall and the ceilings in each room. Are there any cracks in the foundation? Do the same around the outside? Are there any trees encroaching on the foundation?
Drainage System - Does the drainage appear to be away from the house?
Roof - What is the overall condition? When was it last replaced?
Exterior - Does the house look like it will need repairs or repainting soon? Are gutters and downspouts firmly attached? Are there loose boards or dangling wires? Is there asbestos in the exterior material?
Interior evidence of leaks -c Check ceiling and around windows in each room?
Basement - Is there dampness? Sufficient insulation?
Electrical - Do the switches work? Have the outlets been grounded?
