There is no lock-in period and the agreement clearly states that, both parties can terminate the agreement by giving 1 month advanced notice. The are so many promises made by our state govt. but still pending. Hope this will get quick approval & instant implementation. Even the Housing Minister Prakash Mehta recommended a decrease in FSI-TDR rates to make land available to developers in return for a specific percentage of free homes to the government, which could be sold at low prices to the poor classes.
At the same time , through this, the govt could eliminate its Rs.350000 crore financial debt pressure got from the past program.The are so many promises made by our state govt. but still pending. You are right guys.. if there is no demand for houses, then there are chances that builders will decrease prices. But when there is demand increasing situation then they will be happy to make more and more profits. Why do they bother about buyers? Government should do something in this respect. It has to form schemes or norms such that they are forced to cut rates and clear their inventories. Hi Kian..as far as i know.. GPA registeration and sale through it is banned in India. This means that you cannot register the property but it gives you the right to transfer that property. How are the terms on Occupancy certificate mentioned in the Sale agreement or Construction agreement?
I am looking at purchasing an apartment from a fairly new builder (has done 2 small projects so far).
I asked for a term to be mentioned in the Sale agreement. I asked for the below two
1. That builder commits to providing Occupancy certificate within 6 months of possession of the flat by the purchaser.
2. That the last payment 5% (or could be 2.5%) would be made only after Occupancy certificate is provided by the builder to the purchaser
The builder is willing to provide '1' but not willing to add any clause that says what if the occupancy certificate is not provided within 6 months per the term '1'.
Is this good enough?
The project is on Sarjapur road in a area of over 1 acres.
The builder is confident of providing Occupancy certificate.
From where the construction is today (it's a G+4 with 2 Basement parkings), there seems to be no significant deviations.

In my point of view, you should check with builder regarding building plan, lay out approval, NOC (no objection certificate), Certificate of completion, basic amenities , clear title & Approval of conversion.
You may ask why these are necessary to check, i will say that before buying any property, ensure that you are asking the builder or developer for all the above said documents to be sure that you are buying a property that does not and will not have any legal hassles in the future.Hi Mr Puneet,
