FSI is the floor space index. Municipalities and governments allow only a certain FSI. Otherwise very tall buildings in a narrow space would be constructed leading to parking and various other problems. Government had drafted a policy for FSI through out Maharashtra. I have purchased a farm house plot in Saffron City, Wangani village, Velhe taluka, Pune district in 2008. Saffron City with developed bungalow plots, farm house plots, agricultural plots with roads, electricity, compound to plots. This project is situated near Kondhanpur on one side and Wangani on other side. It is at 35 km from Pune.
It was booked in this project offered by Saffron developers, Pune with the promise of handing over the plot in 2010 with well developed roads, electricity and water at the doors. A fencing and plantation in the plot will be provided by the developer. Nothing has been happened till today. Anybody has any idea about it? Is there anyone who has booked plot here?

What i think is that the proposed Land Acquisition Bill would not impact the real estate sector as well as the developer in the country if handled in the right approach and right manner. Buyers had a difficult time dealing with the builder. Please be aware that builders charge 18-24% interest if there is delay in payment from our side and if there is delay from their side, they charge only 9% interest or no interest. I got a mail from them yesterday saying they are running behind schedule and are not getting approvals so I have an option to get my money refunded at 12% simple interest. This is cheating of highest order. Please note, they have sent such a mail to buyers from Tierra (A, B) and Cielo (C, D). Being a small retail buyer, I do not have any power against these powerful frauds. Can we create a common group and fight it out? We have been receiving very high property tax bills on the properties in Mumbai and that too it is increased without giving any prior information from the govt. The bills have even crossed a crore in South Mumbai which has provoked the people to protest. We booked a flat by paying a token(5Lacs) in the month of Nov'12 in this Project Rising City by Hubtown and 3 other builders. We were assured that the CC would be coming in by Mid Dec. It did not come till Mid Jan'13 when we were told that if we want we could withdraw with full refund before the balance payment was made. We did the same. However, since then we have not received the refund as promised and in fact attempts have been made to prove that the money should actually be forfeited! recently they asked us to sign some false unreasonable documents as a condition for refund. Completely unethical and unprofessional behavior

Hi Vikas, that is so unprofessional of them. I would suggest you to take legal help as getting a notice from a legal adviser would hold some weight then going anonymously.. Dear All,I am planning to buy a 2BHK in Clarion. Basically I was looking for some 2BHK in Kandivali (E) and the broker took me and shown the site.He was all gang-hoo about the project and said that he has a investor flat at good rate with good appreciation in future. He also mentioned that work was stopped but now it is in full swing. But thanks to the reviews by all the users in this forum, I want to be doubly sure before taking a plunge.So just like to know1) Is it a good time to invest. I am ready to wait for some time but just dont want to be stuck in the same indefinitely in hope of good returns.2) Was CC for higher floors the only issue or there are some other issues. CC issue could be (or might have been resolved) after the BMC approval but if there are some internal issues (like as mentioned cash crunch, land title) that they are very difficult to resolve and could stop the project for a long time.Thanks in advance

I agree with Arup. Also, there is option of Down Payment which requires you to pay the entire price of the property at the time of booking. At the time of booking themarket interest rate was around 8.5 to 9 % where as lodha was offering 6% ( ie rebate of 2.5% approx.)if loan is taken from this 2 banks. This rebate was suppose to be paid by lodha to bank after a year from disbursement.
Now when I approached them they seems to make some excuses. Hence I want to know if any body has got this benefit.

The Thane Municipal corporation has announced that all owners who pay property tax for the whole year within the month of June will be able to take advantage of a 4% concession. A similar 5% concession was given to all owners who paid property tax in the month of May. As time proceeds the concession percentage will further reduce. 3% concession will be provided in July and 2% concession in the month of August.Hi,

I feel Borivili east will grow in few years.. It has the potential to grow. It has good road connectivity via the Express Highway to rest of the city along with inter- state connectivity to Gujarat. As of now, the property rates in Borivili east have increased by 10 to15% in the last one year. Ongoing capital value here is between Rs 12,000 and Rs 14,000 per sq ft.

Hi All, Hope u guys are aware of the latest news about the Worli ( Campa Cola Society) demolishen. 170 flat owners have been asked to leave just because they did not have the occupancy certificate.. Although the flat owners had paid their yearly taxes and had the flat registered 20yrs ago, the govt has declared it to be illegal.. This only reminds me that few blocks in PWC are still not given with the OC.

Hi Sankalp...there is no clear picture of the project.I came to know that the builder is also delaying agreements of people who invested during pre lauch offer. The brick work, internal and outside plastering upto 15th floor were completed by March 2010. Thereafter, the work was totally stopped. As per the commencement certificate issued by CIDCO, the builders were permitted to construct G+15 floors for "A" wing and G+16 floors for "B" WING. They are asking for Rs 1750000 as other charges which needs to be paid in cash once the booking maount is given. There will not be any receipt that will be paid to me other than the receipt for booking Amount. Kindly let me know the bifurcation of this Rs 1750000. Also, why is the receipt not paid for this amount ? If i assume this amount to be Society charges, corpus finds etc then it should be paid at the time of possession not now. The connectivity is good as I have taken a possession in Phase 1 in Lodha Splendora. The project is located at a distance of approx 10 kms from Eastern Express Highway and about 12 kms from Thane station. Yes the project has been duly approved by TMC and comes under TMC limits. Got in touch with executive and mentioned that the apartments have sufficient water to cater to the daily requirements. The flats have corporation connection as well as borewater connection which is more than enough to meet the daily requirements. Vasai station on the western line is the most important railway station and also the last terminus for Mumbai locals. we are leaving in andheri and we have 18 member in all we stay on 8th floor my wife is teaching drawing /Art to small kids but society committee has raise objection and in AGM without agenda they discuss the use of lift by small kids and minuted that under the head COMMERCIAL USE OF FLAT :- the misuse including damages to elevators by children attending tuition condected by member and other related issue including parking by parents further it is written after extensive deliberations it was decided that that all the damages in terms of escalated electricity expenses and lift maintenance expense due to use of elevator by children be recovered from the member.further decided to collect on trial basis 10% of the monthly common electricity bill and 20% of the lift repairs and maintenance expenses(other than regular AMC charges) to compensate the damages to society dueto commercial use of the flat by us.
the committee was instructed to intimate the same to the member(that is us) and ensure that the member do not construe this collection fro them as any protected or obligatory rights created in their favor.
we are seeking your legal opinion as all the small kids coming for tuition to learn drawing is of the age group of 4 to 10 years and all are from good family and nobody has damage the lift how the committee can discuses this without agenda of the AGM and in our absence it was decided within few members and because of some few biased and prejudiced age old committee member they have minuted the same to create problem for us in future ?

one more point we would like to highlight that before we came to the society 2 years ago there was old building redeveloped and out of 18 new member 9 were old member and are relative and one member was already running coaching classes to teach french/ Japanese languages and other activity and they even put a banner also within society but nobody has taken objection for that but we are targeted intentionally by few committee member for the reason best known to them so please advise me what should we do and what reply should i give to them i will be highly oblige .

1) I booked flat in CASA UNIVIS (Now CASA Splendora) TEIRRA- C 1802 in Aug'2009.
2) With the assurance of possession in March'2012 Sale agreement also prepared. However till date possession is not in place.
3) Every now and then their sales executive informed me new possession dates and now almost more than 2 years of delay there is no confirmation on possession date.
4) In line with agreement I have paid entire amount against builders demand letter. However at this stage, in spite of delay from builder side builder is not giving me compensation calculated @ rate of 12% per annum on the amount paid by me (part of agreement).
5) Builder informed me that this delay in completion project is, due to labour problem, getting CC is beyond their control and he is not responsible to pay for that. This argument is not at all acceptable as this is prime responsibility of any builder to take care such issues.
6) I am currently staying nearby locality on rental basis and paying heavily as a rent, in addition to it I am paying heavy EMI.
7) I want builder to give me compensation and handover flat as per the current confirmation i.e. Sep'2014

At the same time pre-launch and new launch are too risky even if its a good builder. Prices are too high for others that are close to completion. Good area is also another issue. I signed an agreement in 2006 with one builder for a project in Goregaon West .
Project got delayed for 6 yrs . The orignal builder tight with a new bigger builder to complete the project .Now the project is complete and they want us to sign a supplement agreement under new builder name which includes flower bed and dry areas . The amount to be paid for these extra areas is shown zero on the agreement ,but the old builder who still partner with the new builder and who signs the agreement on behalf of big builder is demanding cash from his buyers for the extra dry area and flower bed .
Without Signing this agreement we wont get possession .
This builder is also holding my cheque payments which i gave for the completion of the project .
Our agreement was already signed in 2006., hence they cannot charge any more money and that too after 7 years delay of the project .

They didn't get any approvals like Commencement Certificate and IOD from BMC and they have send demand letter for 10% from the flat owners. Check all the legal approvals twice before buying property from any builders. Inquire a lot before investing your hard earned money in real estate market.Hi,

Wanted to know if the NOC from CIDCO is required for transfer of housing society membership for re-sale flat. The flat is in a building constructed on plot based on tri-party agreement. The price of flat has been fully paid up to the seller, without any loan, and agreement duly registered.
To give a brief history. after the OC from CIDCO, and after Housing society was formed, just when builder in process of providing conveyance, which he eventually did, one fine day a letter from a lawyer was given at the gate. It mentioned that the set of heir's of original plot owner had put up a court case against Builder, CIDCO and another set of hier's. Former set of heir's were claiming that latter set had shared the compensation with them. We, the members of housing society, consulted a lawyer, who told use this is not unusual in this region, we should not worry, as the case has not been filed against us, unless there is direct notice to us.
But now after few 3-4 years, when resale of flat went ahead, now the present Housing society committee are denying to transfer membership to the new owners, after CIDCO has not provide NOC.
So is NOC CIDCO required for resale of flat not built by CIDCO, and when there is no home loan involved ?. And a housing society deny transfer of membership to the new owner with CIDCO NOC ?

The civic administration failed to demolish unauthorized extensions in residential structures in Aram Nagar at Versova, despite a high court order, claimed the Maharashtra Housing and Area Development Authority (Mhada).
Mhada vice-president and chief executive officer S S Zende said the authority has already paid BMC Rs 70 lakh for the demolition work in Aram Nagar, a Mhada colony spread over 40 acres.
“Tenants have encroached upon the open space in front and behind their row houses, built compound walls and even illegal floors. Many row houses have been converted into bungalow-like structures and the use changed from residential into commercial.As most of the encroachers are from Bollywood-related businesses, the row houses have been converted into production houses, studios, hotels and gyms,“ said a Mhada official.
“Mhada has been pursuing the matter with the BMC since 2011. The BMC issued notices to the offenders, but did not take strong action,“ said a Mhada official. In March, a Mhada executive engineer wrote to K-West ward office, which covers Versova, accusing it of razing a few structures just to “show off “.
On June 7, Zende dashed a letter to municipal chief Ajoy Mehta, pointing out that the high court may take serious view in this regard if action is not taken immediately . Referring to the HC order on December 21, 2015, Zende said, “The court had directed BMC to file an affidavit regarding action taken against unauthorized construction in Aram Nagar. If no effective action has been taken to comply , the court order may amount to contempt and may take serious view in this regard.“ Mehta assured that he will instruct the local ward office to take action against the illegal extensions.
“In spite of Rs 70 lakh being paid to wards demolition, no effective action has been carried out by the BMC. This fact has brought to the notice of the local assistant municipal commissioner and executive engineer,“ Zende said in his letter. He also attached photographs of encroachments including a hotel, production house, coffee shop, gym, dental dispensary and a few bungalows. Zende told TOI, “All encroachers are financially sound. I wrote to the BMC to speed up the demolition work and we hope it will.“

Nearly a month after nine people died in a fire in a residential structure illegally converted into a chemist's shop at Juhu Galli in Andheri, the BMC is still to take action against 129 such structures in Aram Nagar, Versova. This despite a Bombay high court order to take action against such illegal structures.
TOI firsted reported about the illegal structures in its edition dated June 14.
An NGO, Disha, which had surveyed the area, had gone to court over the issue. It claimed that there were 129 residential structures converted into commercial.
Mehmood Shaikh of the NGO said, "After the nine deaths in a small illegal shop in Juhu galli, is BMC waiting for a similar incident to happen in Versova where hundreds of lives are at high risk? In case of any eventuality, BMC's K-West ward and the fire brigade should be held responsible."
Shiv Sena MP Gajanan Kirtikar has written to the BMC, demanding razing of the illegal construction and extensions in Aaram Nagar. Citing a Bombay high court order of December 21, 2015, Kirtikar said that the court had directed BMC to raze illegal structures in Mhada colony, but added that the BMC had failed to implement it.
His letter mentions: "There are illegal bars, restaurants, pubs and other immoral businesses being conducted in the area... There are illegal film studios running there as well which cause inconvenience to citizens."
Assistant municipal commissioner Parag Masurkar told TOI that there 354 such structues in Aram Nagar, of which 280 have been issued notices. "Demolition is on. Every month we demolish a few structures in the area," he said.

According to me locality is good for investment seeing the development in the locality. All the daily basic facilities are within stone throw distances. Transport facilities are also good in the locality. Property price has also increased recently due to huge demand of residential property.

I rented a 1BHK flat in Andheri and signed 11 month leave & license agreement 5 days ago. There is a 6 month lock-in and 1 month notice period. Due to some misunderstanding and lack of furnished items in flat and owners mean behaviour, I (the tenant) want to cancel the agreement . However the owner said he will not return the deposit of 50,000 but he will return the cheques of remaining deposit and monthly rent if we sign the cancellation agreement, thereby waiving him of 50,000. Is it legal for the owner to do so ? And if there is any way I can get my money back without legal troubles with owner in future on cancelled or stop cheques in case I don't agree to waiving my deposit left with him ?

Do not know about this Oyster Living Clublife but Oyster Living at Dahisar East on highway which has 1 and 2 BHK at low rates. There is separate thread for the same. It is an SRA and apart from sample flat there is no progress on ground for more than 2 yrs. Do not know about this Oyster Living Clublife but Oyster Living at Dahisar East on highway which has 1 and 2 BHK at low rates. There is separate thread for the same. I think you should immediately visit the builder and force them to get your flat register. Why are you paying all those EMI if builder is not registering your flat. Stop EMI until your flat get registered. You can not take any legal action if builder deny to give you the said amenities. They have taken around 1.35 -1.5 lac+ Society maintenance Fund from each member. but While handing over the society, we have noticed that they have paid their employee salary and huge Diwali bonus from this Society maintenance fund. Before the formation of apartment owners association, it is the duty of the builder to maintain the apartment and its amenities. Most developers provide a corpus fund for the maintenance of the apartment and its amenities. The builder collects maintenance fund from each buyer which will not be shown in the basic sales price of an apartment. The maintenance fund collected from each apartment owner is deposited as a corpus fund.
The Corpus fund is generally not allowed to be utilized for the attainment of the purpose, but interest or dividend on such fund can be utilized. You can take the legal action against the builder in the consumer forum.Hello Tushar,

My father has passed away and we are 3 females in the house. We are staying in ground floor. There is septic tank behind my toilet. which is covered from all the side. The only way to go there is from terrece . There is rod stairs which goes down there.
Before, this was not the issue. But after my dad died they are saying we can make anyone cleaning it. Anyone can go and die. Previously i paid from my pocket but every time i cant do that. They dont even accept, if i cut the amount and pay the rest maintainence.
i called septic tank cleaner they cleaned it. But one of the socity member started fighting.
Again i m facing same issue. my toilet smelling worst and whenever water goes it started sound of not going water properly.

Hi! I had bought two units in Imperial Heights, Goregaon W, Mumbai in 2015. The handover has been delayed repeatedly and last year in RERA the builder had declared June 2019 as handover date and now they are applying for extension to June 2020 to RERA. We can't afford paying rent and EMI every month. What is the legal recourse that can be taken?

There are six important provisions in RERA that may prevent the builders from delaying the projects and stick to deadlines rather than making a default.
RERA has taken steps to not only make the promoter accountable but also make them pay compensation and penalty in cases of default of any provision of the rules. So, if your builder will ask for the extension, in that case, RERA will ask them to pay the penalty of delay.There are six important provisions in RERA that may prevent the builders from delaying the projects and stick to deadlines rather than making a default.
