This is AMIT PATNAIK a fellow owner (IGNIS-E-1504) in the project CASA UNIVIS by LODHA in THANE. I recently joined the group and started sharing some of my experiences of dealing with the builder on various issues. To name some issues like 5% MVAT demand, Delay in possession, denial in paying the Compensation for delay possession etc. I think we should group together and start sharing our thoughts on how we can handle these issues. We’ll take the same initiatives like others have done for fighting against the builder for harassment to customers.
The first thing we can do is we’ll start with a formal meeting and create an Association and register it. In this way we’ll l get government recognition as a BODY and have a good stand in the Consumer Court for fighting against the builder. Please share your thoughts and also if anyone has better suggestions we’re listening. Hope to hear from all.

Hello Vishal..i don't think there is any such rule which specifies that builder should provide any particular amenities. It entirely depends on the builder. Few basic amenities which i know are provided by every builder are water supply, electricity, power back up, lift (for higher buildings), parking . If the owner or the housing society fails to carry out the order, the civic body concerned can conduct the check on its own and recover the charges from the society or the owner. They are asking for Rs 1750000 as other charges which needs to be paid in cash once the booking maount is given. But nothing can be said about future prospects since it totally depends upon how volatile the real estate market is in the coming years. Yes there is no point in going to court for filing cases against such incidents. These types of mistakes do happen in all buildings and try to take precautionary care like parking your vehicle away from the place where the children keep playing. There is no power or water crisis as such in this locality. The area receives 24 hrs power and water without any interruptions. When compared to other localities, Panvel is considered to be the safest place to reside. Though there are some minor incidents of crime that have taken place , no major incidents of crime or robbery has been reported from this locality in recent times due to constant vigil being kept by the local police. I spoke to one of the sales executive and he told me that this project was launched in the year Nov 2013 and most likely the possession will be around Dec 2016. I think this is a good project to invest as the location is excellent with sublime climatic conditions. The location is not in mumbai region. The mumbai town region ends at Bandra. Beyond Bandra we have extended mumbai suburbs for 10-15km. You can not consider this location as mumbai region. This is semi-rural area at least 70-90km from town. Even at 2psf on carpet area maintenance, the builder would be making huge amount of money. Rs. 3psf is quite high, it should be around 2.5 psf on saleable area.

As you have paid a sum of amount to the builder for your flat and still waiting for the possession in such cases you can file a case in the consumer forum.

Within 4 months of the sale deed one needs to pay stamp duty and registration charges else we will have to pay penalty.

"Sale Deed" is the instrument/agreement by which the property is actually transferred by vendor to the purchaser after the receipt of the full consideration amount. (Actually sold and purchased). I like the discussion......it is really a eye opener for first time buyers. I would also like to suggest you that do not do any booking only on the basis of the brochure, some presentation or looking at a sample flat.
Make sure you visit the actual project site and see the location, how well connected the area in city, how are the roads, what is nearby the place and other important factors. Under the Maharashtra Ownership of Flats Act, 1963, the developer is liable to refund the amounts received, with minimum 9% simple interest. This interest can range between 9-18%. Also, the interest is payable only on the amount that be proven as paid to the developer.

I deposited the pre-launch booking amount of Rs. 7 Lacs.
This was my first investment as NRI in India, I had made and I feel cheated as no receipt and allotment was issued to me.
I was told during collection of cheques that allotment will be given in Jan2015 . Once my money reached into the Ajnara’s account after that their worry was finished and it was my turn to start worrying so what I am doing yet. Having several calls with Ajnara people and Ajnara servicedesk even on mail(even putting Mr. Harish Gupta/ Tanzeel Ansari/Renu/ Mr. Anand in CC does not helped) also nobody was telling me the date even month of launch even.

From an year now i am struggling for refund.
When i delivered my refund document they said refund will be processed in 3 to 6 months (Here you have to notice that, Ajnara is not able to launch project and even they are not refunding money, not my fault).
They asked me to sign a affidavit which says i will not ask for any interest and compensation and i am taking refund due to personal reasons. I also gave them thinking that let the process make easy.
Now, days-months-years passed, First Ajnara team do not responds, if they they respond, from 6 months i am only getting following template.

I visited Platinum Heritage over one of the weekends as I was really interested to invest in their project Tower 1 Building.
To my surprise I noted some serious design flaws in the flats. Noted below are some of them out of many
There is no provision you can install ACs in the flat no matter whatsoever because of balcony designs. Strangely I was pampered by their sales team that our flats are AC ready!!! Imagine staying in a luxurious flat, but not possible to install an AC due to lack of any open area to place the outdoor AC unit. This definitely brings down their property valuation.
Secondly I noted that their bathroom fittings are placed at some of the most pathetic positions. Towel hanger is just below the Shower !! Imagine your towel also takes a bathe along with you!!!
Geyser electric socket is 1 meter away from the place where the geyser is fitted !! No geyser comes with a 1 Meter long wire.
They have forgotten to keep water drain outlet pipe for washing machine in the dry area !!! Hence Washing machines cannot be operated in the flats of Platinum Heritage. Imagine a Mumbai apartment with no provision to operate even a washing machine.
Sales team tried to impress me that Kitchen is going to be fully furnished with Modular fittings including state of the art Kitchen Chimney. However during my visit, I overheard a group of existing buyers busy discussing that builder is not fulfilling the commitments such as Kitchen Chimney, Shower Cubicles, Vanity boxes in bathroom.
Moreover the sales team says that all flats are sold. Sales team is just exaggerating the fact. The real picture I got to know from some of existing owners is not even 40% flats sold and builder (Soham Group) is struggling with financial problems due to its strained partnership with its business partner (JVM Spaces).
Good that I did not purchase the flat. Save from a big nightmare!!!

I have bought an under construction flat in Bhubaneswar and I am hearing I might be called for registration. But I am currently located in USA and cannot be present physically to register. Do I need to prepare Power of Attorney to someone to do the flat registration. I heard since it is a flat and not a land I do not need to even give Power of Attorney and instead all the registration docs can be just sent to me to USA and then I can send it back with my signatures. Mohan Group has Delayed the Possetion for four years.Although the possetion date was written in the sale agreement. Also some of the flat were having leakage issue in Mohan Greenwoods. Also Builder has taken one time society maintenance fund from all of us. They are calling it as Soeciety Maintenance Corpus fund. and the same will be hand over to society after society is formed. Our Society is formed but builder has not handed over all the money properly to society. Out of that lot of money used by builder to pay their employee salary and to hieght Diwali Bonus that too huge. Which is very wrong. They have misuse our hard earn money. Guys be aware about these issues which we have faced. This might help someone. We got be wise and alert.

Thanks for the feedback. New buyers should alert about all this trick. Real out all the required clause in the agreement carefully before sign into it. Verify all the legal approval, check the said amenities, water & electricity facilities, connecting roads and infra development in the locality and then proceed further. After implementation of RERA, builders are playing some new tricks to make buyers fool.Hello Raj,
