Yes true Mr Dixit.. FSI is also the ratio of the total floor area of any particular property to the size of the land of that location.. An FSI of 3 would indicate that the total floor area of a building is three times the gross area of the plot on which it is constructed. I have booked a flat in MAN OPUS in Aug 2010, I was told while buying that Pay 10% now, 10% in another 1 - 2 month, post plinth is ready another 10% & then 5% each after two floor & so on. But till date post 2 & half years of booking their plinth is not ready yet. I have been hearing that they have sold many flats to direct individuals & through HDFC & ICICI property research & has almost sold more than 60% of flats. Initially it was suppose to be a 6 blocks society now they have extended it to 14 blocks. I have been just hearing dates after dates from last 1 & half years from the concerned sales team that work will commence soon in full swing, but status quo till date. Hi Akanksha, I heard in Dec 2012, they are now running an inaugural offer and flats were sold at Rs 4299 per sqft. Compared to the other new projects in Kalyan getting developed, this one is good. Others are present at further deep down khadakpada/adarwadi side.

But present condition is that there is only plinth on the sight and if u ask them they are saying we will give you possesion in one year. The 18 months have already passed (i.e. in Nov. 2012) and from then I am in contact with builder but they are not answering me properly. But as a compensation they just offered me a 30 days free stay in there resort and that too they are counting it from January.
I am asking them to give a possesion date on paper but they r refusing so wanted to stop there payment till possesion.
I have taken a DHFL loan and they are just charging me interest and cannot start EMI unless there is full disbursement as per there policy.
So I want to know
1. Can I take a legal action against builder and ask for compensation?
2. Can I stop there payment till possesion and if I stop there payment can they charge me a penalty?
3. Can I quit from the project and get the curreent market rate?

Hi Anjali, you can take legal help against the builder and you might get compensated for all the harassment faced.. If you stop the payment, then yes they may charge you with penalty and show some other calculations.. As far as I know, there is water problem in the building and it does not look like getting resolved in near future. I would advise you to make a group and visit the consumer court or local ward office for relief.. In earlier times Malad west was full of slums and slums and villages but now it is quiet the opposite.. Hi All, Hope u guys are aware of the latest news about the Worli ( Campa Cola Society) demolishen. 170 flat owners have been asked to leave just because they did not have the occupancy certificate.. Although the flat owners had paid their yearly taxes and had the flat registered 20yrs ago, the govt has declared it to be illegal.. This only reminds me that few blocks in PWC are still not given with the OC.

Spoke with the executive and got it clarified that the locality is currently approved by MHADA and shortly will come under TMC. As far loans are concerned, the builder has tie ups with HDFC, Axis, ICICI and India Bulls. There is a Supreme Court judgment that clearly states that these documents should be handed over to the buyer, which honest builders adhere to. I think you didn't read my reply seriously. It is clear mentioned that if you had paid the VAT and registration fee at the time of registration then you don't need to pay but as you said that you pay only stamp duty and registration fee. Stamp duty and registration fees are two separate charges. So, you have to pay 1% as a VAT. It is better if you take the advice of a legal adviser. They will clarify it.Hi Neeraj,

we are leaving in andheri and we have 18 member in all we stay on 8th floor my wife is teaching drawing /Art to small kids but society committee has raise objection and in AGM without agenda they discuss the use of lift by small kids and minuted that under the head COMMERCIAL USE OF FLAT :- the misuse including damages to elevators by children attending tuition condected by member and other related issue including parking by parents further it is written after extensive deliberations it was decided that that all the damages in terms of escalated electricity expenses and lift maintenance expense due to use of elevator by children be recovered from the member.further decided to collect on trial basis 10% of the monthly common electricity bill and 20% of the lift repairs and maintenance expenses(other than regular AMC charges) to compensate the damages to society dueto commercial use of the flat by us.
the committee was instructed to intimate the same to the member(that is us) and ensure that the member do not construe this collection fro them as any protected or obligatory rights created in their favor.
we are seeking your legal opinion as all the small kids coming for tuition to learn drawing is of the age group of 4 to 10 years and all are from good family and nobody has damage the lift how the committee can discuses this without agenda of the AGM and in our absence it was decided within few members and because of some few biased and prejudiced age old committee member they have minuted the same to create problem for us in future ?

one more point we would like to highlight that before we came to the society 2 years ago there was old building redeveloped and out of 18 new member 9 were old member and are relative and one member was already running coaching classes to teach french/ Japanese languages and other activity and they even put a banner also within society but nobody has taken objection for that but we are targeted intentionally by few committee member for the reason best known to them so please advise me what should we do and what reply should i give to them i will be highly oblige .

Is the construction good. whether the land is freehold or leasehold and whether the title is clear. whether the land is not a notified area like a forest land by the govt. will the builder give all the amenities as promised. What i think is that the proposed Land Acquisition Bill would not impact the real estate sector as well as the developer in the country if handled in the right approach and right manner. Buyers had a difficult time dealing with the builder. Please be aware that builders charge 18-24% interest if there is delay in payment from our side and if there is delay from their side, they charge only 9% interest or no interest. It fully depends the nature of the developers. So, we need an efficient real estate regulator.Hey folks !!!!!!

The prices will not fall at least in the near future. if you have seen the proposed payment in the DCR 2034 to the BMC, you would see that TDR payment has gone up for builders. Previously it was based on the RR rate of 2008. Now the govt. has announced it should be 60% of RR 2015. This itself increased the project cost by crores. Now according to 2034 DCR, the rates are to be 70-100% of RR of the present year. This will lead the developers to increase the flat cost.Hello Khushisha,

If you have booked a four wheeler parking then you don't have to pay for the two wheeler parking. You can park your two wheeler along with the four wheeler. Yes, no demand for Wing-B yet. I recently visited the site. Previously, there were three basement parking but now there is a four levels of basement parking which is indeed good for all of us. Wing-A has completed its plinth level, Wing-B has completed it's plinth level, Wing-C and Wing-D will also has also been constructed till its second basement. I assume that by mid or by end of February B to D wing will also complete its construction till plinth level. The construction work is in progress so there is nothing to get worried.Hi Sankalp!!

As per Real Estate Regulation Act (RERA), builders will have to pay 10.9% per annum for delayed possession. Date of posession promised while booking the flat was sept 2014 while in the contract they mentioned dec 2015 as a late date. Even after that we are waiting for the posession. Builder is not replying to mails and gives rude response over phone calls. They are saying it is delayed due to delay in power grid making by the govt authorities and they are not responsible for it. ON WHAT BASIS THEY PROMISED POSESSION OF SEPT 2014. We are staying in a rented flat and paying EMIs for this long awated flat.

There are two way to reach Thane West from Santa Cruz via Eastern Express Highway and Western Express Highway. Via Eastern Expressway, it will take around 1 h 10 m to 2 h 30 m if u are leaving the office at 6 pm. Via Western Express Highway, it will take around 1 h 15 m to 2 h 30 min. And if you are commuting via local train, you can reach your destination within 1 h 50 m. So, i think train route is the best route to commute for you.Hi Mithun!!

I do not think so. One of the worst Developer in Thane. There are lots of negative reviews about the developers and its project? Almost all of their projects are delayed by 5-7 years. I am very surprised that nobody has taken them to the court. The real estate act applies to all buildings under construction and is pretty clear that unavoidable circumstance clause can not be used arbitrarily. I assume someone has at least sent a basic legal notice by now.Hi Ramesk,

No the said exemption is only for residential RWA societies, for commercial it is applicable from INR 1, if the association is having aggregate turnover above 20 L per annual as per GST law.Regarding second query if the association is working as pure agent , where actual liability is of the unit not society, than not applicable however in you case connection is in the name of society and same is collected on actual consumption basis GST shall be levied. The commercial unit can claim the same as input if they are registered. ?

I have also invested in this project in phase-1 and construction work is in the slow pace. I will advise you do your all due diligence and verify all the legal documents by a legal expert and then go for it. Project locality falls under slum area.
